I filed bankruptcy late last year and my bankruptcy was finalized in Mar 2012 and the Company that Midland is representing is STILL sending me letters of payment due. The company I owed money to was included in the bankruptcy and the debt was cleared. The bankruptcy attorney had contacted every company that I declared bankruptcy over and Midland is the only company that is still harassing me. Can I sue them for harassment or what are my options to stop this once and for all.


When you were going through the BK, was Midland involved at that time in trying to collect the debt? If Midland was ever notified that you were represented by an attorney, they are in violation of the FDCPA there as well--they are not allowed to contact you if they know you are represented by counsel, all communication is to go to the attorney on your behalf instead of to you. If they were in any way a part of this back when the BK was going on--such as if your attorney informed Midland of the BK, then let us know. But yes, as others have said, do contact your attorney and let him/her handle MCM from there. If they continue to try to collect, then it may take filing a civil action to get them to stop.
