We currently have loans from the following lenders:
One Click Cash
GECC
Sure Advance
American Web Loan
Western Sky - now Cash Call
Plain Green Loans

We live in Louisiana and no sure what steps need to be next. They were all taken out a few months ago but the finance charges are killing us. Of course they were OK at this time but they all come out on the same weeks-almost 900 every 2 weeks and one every month for 295. The 900 will come out this week by the way. Advice please??

One Click Cash ILLEGAL TRIBAL
GECC IS A BROKER, NOT A LENDER
Sure Advance NOT SURE
American Web Loan ILLEGAL TRIBAL
Western Sky - now Cash Call ILLEGAL TRIBAL
Plain Green Loans ILLEGAL TRIBAL

http://www.debtconsolidationcare.com/paydayloan/explain-pdls-laws.html
Look up LA state laws and call the regulator to check on the two I am not sure on.

Follow the link in my signature line for information on how to deal with illegal lenders,

None of these lenders is legal.

One Click Cash - tribal
GECC - offshore and supposedly doesn't offer loans in your state
Sure Advance - unlicensed and possibly offshore
American Web Loan - tribal
Western Sky - now Cash Call - tribal
Plain Green Loans - tribal

You should only repay the principal balance of the loan. No fees or interest are payable. Follow the step by step instructions in my signature link.

Well I started today by going to the bank and putting an ACH revocation on all of our online payday loans. They were very helpful. No questions asked. One thing though I wanted to ask- do any of these online payday loans use other names or dbas that you know of? They are OneClick Cash, Government Employees, Sure Advance, American Web Loans, Plain Green Loans, and Cash Call. My bank said that if they try to put through under another name I would have to wait until they post then fill out another revocation form so I could get my money back. Our other option is to just close the account-which I really do not want to do unless I have to. I'm sending my emails to the loans so hopefully this works out well without too much hassle. Any extra advice would be greatly appreciated:D

They will use other names. There are too many to keep track of all of them. Ask your banker if they can either block all ACH transactions or make your account deposit only. The only other way around it is to close the account or have them assign you a new account number (which is basically the same as closing it).

I sent my emails to the payday loans companies and received the first one back from Sure Advance. Here is part of it:

Your outstanding balance is $506.00 which includes the principal borrowed and interest assessed based on the terms of the loan. As a result of your misunderstanding of the terms and conditions of the loan and our commitment to customer service, we will accept a settlement of $300.00. Once we receive the $300.00, I will forgive the remainder of the balance as a courtesy. Keep in mind that you will not be eligible for future loans with our company. We have temporarily frozen the interest along with future ACH payments from occurring on your loan.

The amount borrowed was only 400.00 and we have made 3 payments of 106.00. What should my reply be to this one and future ones?

Dear Sureadvance...

Since you are unlicensed in my state, I owe you principle only. I have made 3 payments of $106 which totals $318. I borrowed $400 which leaves me a remaining balance of $82. Kindly forward me your mailing address and I will send money orders to pay off this account at my convenience.

Or:

Dear SureAdvance,

Since you are unlicensed in my state, I technically don't have to pay you anything more. I'm willing to repay what you deposited into my account, which was $400. I've already paid 3 payments of $106, I will pay your the remaining $82.

You can either send me an address where I can send the $82 or I will pay your nothing. Your choice. Final offer.

If the principal and interest payment is not made according to the terms of the loan???.or the settlement offered???., your loan will be placed into a write Off status
The request was made on our website in Delaware, not in the state of Louisiana.
Would you like a copy of the terms and conditions that were agreed to?

Not sure what my response should be.

I'm sorry I didn't make it clear that this last one was about American Web Loan-another loan that had just emailed me. Our initial loan was 1400-we've made 3 payments of 420. Their response was that:

Well I have a dilemma with American Web Loans and do not know how to proceed. They sent me a few emails and I asked for a copy of the loan agreement. This is my dilemma:

This loan is made and entered into with you by American Web Loan, Inc., an arm of the tribe, wholly-owned and operating under the authority and laws of the Otoe-Missouria Tribe of Indians. This Agreement is subject solely to the laws and jurisdiction of the Otoe-Missouria Tribe of Indians. By entering into this Agreement, you acknowledge and consent to be bound by all the terms in this Agreement; you consent to the exclusive subject matter and personal jurisdiction of the tribal courts for all disputes arising from this Agreement; and you understand and agree that state laws or regulations do not apply to this Agreement, the interpretation of this Agreement or the enforcement of this Agreement.
We value the opportunity to serve your needs and want you to be completely satisfied and comfortable in all your dealings with us. War???*groxi (Thank You)!

GOVERNING LAW: You understand and agree that this Agreement is governed only by the laws of the Otoe-Missouria Tribe of Indians and such federal law as is applicable under the Indian Commerce Clause of the United States Constitution. We operate solely in the Indian Country of the Otoe-Missouria Tribe of Indians and have no operations in any state. As such, neither we nor this Agreement are subject to any other federal or state law or regulation, unless so stated in this Agreement.

Now what??

send them this.

since i am not a member of this here tribe unless you extradite me to that tribal ground that governing law means jack.since you want to treat me like i'm stupid which i'm not i will just keep sending my original email and ignore further stupidity like this.you know my position and an email meant to insult my intelligence will get you nowhere.

send that.then deluge them with your original email.they will get the hint eventually.just know they are lying to try and confuse you.don't fall for it.

I have not heard from any of our loans since I had the payments stopped from our account. But today...someone from AWL called my husband's parents(in another state) and said there was a claim against us. My husband called the number and they said papers should have already been served. Now what? Is that just another scare tactic they use? I wanted any suggestions on what to do next? Thanks.

All payday lenders in PA are illegal which means you are only morally obligated to pay back the original amount borrowed, nothing more nor less. On this site, click on sticky on how to deal with unlicensed lenders, follow every step and let us know how you are doing. Good luck!!
