Payday Loans in NC

I do have a few questions that I haven't found on the boards. WIth NC, I saw that the payday loans are illegal but under the webpage that was listed for NC, it does say something along the lines for criminal action it has to have a closed bank acct for the check that was given? I can't find the exact page I saw that on b/c I have looked at so much, my eyes are swimming, lol. I know that they can send everything to collections and all of that stuff but because they are illegal, I am not worried about that. Can they serve me papers in NC? I know that they might threaten to do it but can they do it legally? I am going to let my work know in payroll so that they can't do anything with wage garnishments, but I just worry about them getting any sort of judgements against me. I read a post on here where someone was taking to court by Western Sky or Cash Call and I can not go to court, my husband would kill me.
I have had loans with the following companies over the past year. I am going to list all to see if I can get some help with if they are legal or illegal in NC and to see if I have overpaid them and will take that up with my bank!
Ezpayday Loan
QXL
Big Eye Lending
One Click Cash
Beachside
Cash Jar
VIP Loan
500 Cash
Bottom Dollar Payday Loans
Hydrafund II
GTI
I am now in the process of getting the letters for my bank and work. I am also getting the email set up to contact my current lenders and advise them that my acct with my bank has been closed and no further withdraws will happen.
I am going on Monday to sit down with someone at my bank. I wanted to see if anyone would suggest asking them to dispute the last payment that was made for the current loans I have already paid all of them back for the principle so technically the last amounts I paid just went towards the interest that they charge? Or should I just walk away and be done with it and not dispute it?
I have opened up a new account with a new bank bc of some other concerns we had with our current bank, so all I need to do is close it down and advise them that I want it to be closed and allow no further transactions on the acct right?
My husband and I are also in the middle of changing our cell phones numbers because we are going with a new carrier, so I am going to just not forward my new number which works with what is going on right now. But I do expect them to contact my work, which worries me. For most of them, I didn't use my contact number b/c it is a direct line into my gate at work. I work for a call center and if they don't get me, they go to another representative in my department. I know that there have been a couple that have had to verify my employment and I have had to give them my direct line number into my gate so that they could be taken to my voicemail. Any suggestions on how to handle this as this is my biggest concern?
I also did not use the correct phone numbers for any of my references and didn't provide their real name. With that, will they be able to contact any of my other relatives? I know with public record information, they can reach my relatives and that concerns me as well. I don't want them calling my mother in law because even though I can tell her that they are all scams, she won't believe me and will turn all of that against me and cause huge problems with my family.
I am worried about all of this and worry what consequences my work will face, but I am prepared to fight and not pay a penny more to any of these scamming companies. I feel very lucky to have found this site and look forward to working with you all! Thanks so much for reading my book and any advise or knowledge or past experiences will be greatly appreciated!
Did you follow Ohiogals primer? There is nothing illegal about
Did you follow Ohiogals primer? There is nothing illegal about closing your account. You do the ACH revocation first and give a copy to your bank. If they try putting a check thru, they are in violation of your revocation.
As for attempting to sue you, the contract is dirty which means it is null and void. If they do send you to collections, simply send them a cease and desist letter, indicating the the debt is in violation of your state law.
Thanks Soaplady
Hello! Thanks for getting back to em so quickly!
Is there a website or a way to find out if these companies have a license in NC to do this? I was just looking at Big Eye lending at their legal stuff and it says that they can and will report us to the credit agencies.
Thanks again!
