Getting out of the vicious cycle of PDLs
Date: Mon, 09/24/2012 - 08:36
I thought I wanted to start this thread to share my experience with getting out of the vicious PDL cycle. Over the past two and a half years I have sunken deeper into this trap, but I have now made a decision to get out. I have discovered that none of the companies that I have been dealing with can legally provide loans to residents in Iowa where I live.
Below is a summary of the loans that I have accrued over the past years. These are not numbers that I am proud of but it is a reminder of how bad it has become.
I am going to follow the plan outlined in other threads and get my account closed, revoke ACH authorizations and wage assignments and demand refunds of overpaid charges.
I will try and update this thread with any progress. Is there any place where I can find email addresses for contact for three lenders?
Any additional advice will be appreciated.
Thanks
Dennis

First steps complete
I have now successfully closed my bank account and notified the lenders that the account has been closed, revoked my ACH Authorizations and wage assignments. I have also notified my employer and they agreed to reject attempts to garnish my salary. I have also file complaints with BBB, FTC and notified the Iowa Division of Banking.
I am looking forward to see what happens with my refund requests with the companies.
So far so good.

I received the following reply from Nationwidecash
[QUOTE]???This is a St. Vincent company. St. Vincent and the United States are

I am pretty sure that this is a bunch of BS, and I took a brief look at the treaty mentioned and couldn't find anywhere saying that they would be exempt from obtaining state license.
Any thoughts?
Thanks,
Dennis

Admittance of illegal activity
I responded to them that I needed to be pointed to the section of treaty that would exempt them from obtaining license to operate in the US.
Basically they are saying they don't need to obtain license because of a free trade agreement. I thought it was the other way.. Because of the treaty, the US cannot prevent them from obtaining a license to operate in this country ;). But they have not done so!
On the good side they state they will abide by Federal law, which means they will have to acknowledge the ACH revocation as it is according to Federal regulation.
It will be interesting to see what happens after 10/5 with this as that is the date my next withdrawal was scheduled.

You can play around with them like that if you want. It's actually pretty entertaining to see the crap they pull out of their asses. That said, remember that they are in the wrong and you are in the right. Your state law prevails. Also don't let them try to point you to the supremacy clause as i've seen them do that. Just remember you are right.
PDL to installment with Nationwide
This morning I received an email from Nationwide saying they would waive the financing fees on my remaining balance and I could pay the $800 over 3 paydays . This is on an original loan of $1,000 on which I already have paid $1,355. So I told them that my account should be marked as paid in full and they should refund my overcharged amount along with overcharged amounts on previous loans.

Progress so far
After exchanging a couple of emails with Nationwidecash last week I have not heard from them again. My access to Zip19.com has been revoked, but no response to my initial letter. I have also not heard from Loan Shop Online yet.
This morning I send emails to all lenders again asking when I should expect to get my PIF letters and refund checks.

Nationwide Cash paid in full
I had received a payment reminder from Nationwide Cash as I get paid Friday. I emailed customer service and reminded them that I had revoked my ACH authorization and an attempt to withdraw money would be a violation of Federal Regulation E. Besides, I have closed the account so they wouldn't be able to put an ACH through.
I received this response indicating that my account has been paid in full

Loan Shop Refund
Hello,
I have received an email from Loan Shop (Mr. Mashburn) that they will agreed to a partial refund (almost half of my overpayment) - if I sign a Release agreement. Has anyone had experience with this? They will not issue the refund unless I sign.
Thanks,
Dennis

I had to sign a release agreement with one of my lenders before getting my refund. Everything went according to plan. I suggest that you keep the email regarding the PIF as well as the agreement in a safe place for future reference. :o
Zip19 BS
I finally received a response from Zip19, and it seems to be the usual BS. Loan agreements are governed by EU/Malta laws, they will waive finance fees and will agree to split the remaining balance out over 5 payments. Since neither EU nor Malta laws apply to me I am not sending them another dime. At least the agreed to ceased all collection activity and telephone communication while the account is "under investigation"
I'll keep you all posted on any developments with this.
First Payday without PDL withdrawal
This is my first payday in a long time where no automatic withdrawals from PDL companies has come out. A status of the three companies that I am dealing with:
Loan Shop Online: Account is marked paid in full and partial refund of overpaid charges should be on its way.
Nationwide Cash: Account is marked paid in full. Company refuses to refund overpaid charges. I have continued bugging them to repay.
Zip 19: So far company has waived finance fees and offered a repayment plan of outstanding balance. I have refused the offer asking that account is being marked paid in full and that they refund overpaid charges. I am also in correspondence with BBB of Mainland B.C in Canada, where I filed a complaint. Company has responded, but I have not found that their response is satisfying my complaint.
I have not heard anything else from BBB of Delaware where I filed complaints for Loan Shop and Nationwide Cash, and nothing further from FTC. I have also filed complaints with eConsumer.gov - that handles cross border complaints but nothing from them either.
This forum has been really helpful in dealing with the illegal lenders.
Thanks
Dennis
