Help with PDL and collections
Date: Wed, 09/26/2012 - 11:02
Today, I called them but they can't help me because they transferred my account to a company called Credit Protection Dept...which sounds like a credit collections agency.
So what should I do now? Should I call the collections agency and offer to pay just the principle of the payday loan? Or do I now need to pay the whole thing?
I am unsure what to do now.
Thanks!

Nope! You got lucky and now you get to keep the money. Now that they have sold you to collections all you have to do is cease and desist the collector (return receipt requested) stating that they loan contract is null and void due to being lent in a non PDL state (Pennsylvania)
Here is a sample C and D that I use when I need to; remember to use regular business letter format.
My name is (insert name) and I am writing in reference to (collection agency name) account number (insert here). I hereby demand you cease and desist ALL contact with me and all of my family/friends in regard to account number (insert here), original creditor (insert here)
You have already violated the FDCPA by collecting on an illegal debt. I live in the State of Pennsylvania and pay day loans are prohibited in my state.

No, you dont. They've sold the account to a collector. You are no longer morally obligated to pay them the principal; in fact you were never legally obligated anyway.

Thanks again for the info
One last question...MCN had access to my bank account. Would they be able to give access to Credit Protection Depot?
Thanks
