Payday loan sue

I borrowed from ace cash 1 year ago. I was going to pay but my father got I'll and passed away this march. So stressfully And financially I didn't have the money. I'm with an agreement to pay them and paid them two payments already. Now my bank card was stolen, I haven't received my new card yet and told them its being sent but there giving me a time limit to receive it! If I don't receive by the date they want with my new bank card info can they sue? Or must they wait because I've been making payments. I live in Cleveland Ohio not sure how the law works on that kind of scenario
