It has come to my attention that payday loans are prohibited in my state. Therefore, the loan contract that I have with you, according to my state’s laws, is not enforceable. I have contacted the Arizona Office of Financial Institutions and the Arizona State Attorney General’s Office regarding your internet payday loans and was informed they are indeed illegal in Arizona and was advised to pay what is due according to principle amount only of the loan. Although I am not legally required to do so, I am willing to repay the principal balance of this loan. To date, I received a deposit of $ 500 on (4/24/2012), and have had 9 bi-weekly withdrawals of $115.02 debited from my account. This results in an overpayment of $535.18.
At this time I am requesting a return email acknowledging that my loan has been paid in full. Also, I would like a refund of the $535.18 overpayment. A refund check of $535.18 should be mailed to me at the address you have on file.
I am also revoking authorization for ACH withdrawals and any wage assignment I may have signed. I have given a copy of these revocations to both my bank and my employer. Any future attempts to collect funds in this manner will be blocked.
I demand that any contact be made through US Postal mail or email only. I will need everything in writing to keep accurate records of all communication as per instruction from my state Attorney General's Office.
I prohibit you or your affiliates to contact me via telephone at my place of employment or my home telephone number. I also prohibit you from calling my references listed on my loan.
Please respond to this email with acknowledgment that my account has been satisfied in full. Details of when I can expect the refund check, as discussed above, should also be included in the email

I dealt with Plain Green and they blocked my access to account. They turned me over to a collection agency in New York. Richard Broudreaux & assoc. best I remember. They hounded the heck out of me and I finally settled with them. According to PG I owed 1700.00 and I settled with the CA for 1200.00 in 12 payments of 100.00. Owe about 3 more and I'm done. My loan with PG was originally with Think Cash which was funded by First Bank of Delaware which I found out to be legal.

I am getting ready to go thru the same thing and am nervous as can be because I really cant afford to have these companies calling me at work or my payroll department. So when you sent these emails to all these companies - did they call you several times a day or did they follow your emails and as long as you left the lines of communication open, did they not call?

@Hops44 - I can say that I did take a few moments before I sent out the emails to contact the "lenders" prior to this to say update my contact information for work and home and cell numbers to numbers unreachable - I used my old house number - my disconnected cell number and some old number that is shut down for a work number, You want your payroll to be aware that there is fraud being done to you so that they don't allow some wage assignment to come through. I made sure that my payroll guy was completely aware of the situation when I called to change my direct deposit.. SO that he can help to protect me.. So I have not received any phone calls. I sent all my letters out on the 2nd of Oct. but make sure you put in the letters about email only and not phone contact to you, your work or any references that you may have used. My new numbers are all unlisted.. and my employer has also been made aware of the fraud situation.

I know that Plain Green and Great Plains both are Tribal and Illegal - how much did you borrow and how much have you already paid back?
The one with Cash Call, did it originate with them or with Western Sky? Western Sky is Tribal and Illegal

To answer why I settled. My loan originated with Think Cash and was funded by First Bank of Delaware and was transfered to Plain Green. When I submitted a inquiry regarding the legality of the loan to the Banking commission in Delaware I was told that it was a legal and binding contract.

It has recently come to my attention that in the State of Arizona, Western Sky Financial is not licensed to offer loan products to its residents, thereby making it illegal to do so. Also, for being in violation due to the Small Loan Rate Cap of 36% per year in place in Arizona. I have been unknowingly participating in illegal loan activity and no longer wish to do so. Therefore, I no longer wish to conduct business with Western Sky Financial, nor WS Funding, LLC, and Cash Call, who purchased and or is servicing illegal loans.
I have sent several emails to your company trying to get this matter resolved. I am willing to repay the principal balance of the loan, the balance I show is $1398.47, I will only entertain mailing payments to you via money order, so please supply me with an address to mail payments to. The condition of me repaying the balance is that you must delete your trade-line from my credit report upon paying off the account. I am willing to make small payments over the next several months to get this balance paid.
If you do not want to accept the principal balance only and my terms, that's fine. I will just fight the bureaus to delete you from my report. I would like to get this matter resolved, so please let me know that we can discuss the payment arrangement or charge me off to a third party.
Again I will remind you that any and all contact be made through US postal mail or email only, I prohibit you or your affiliates from contacting me via telephone at my place of employment, my home or my cell phone. On the CC/WS loan -- file a complaint against Western Sky with the South Dakota AG (they are a South Dakota chartered LLC). You can do this online. I got a response from them within a week and they actually investigate and request a response from WS. What they replied with was very very interesting and helps your fight against CC. It seems to get WS's attention since they don't want to lose their charter considering SD is the only place they are actually licensed to do business in - lol. (PM me and I will give you name of investigator who is working on my complaint). Personally, I think the more people that complain to their AG (I'm in another state), the more pressure it puts on them.
Also file a complaint with the California AG (they have all kinds of actions against CC) pointing out they are not responding to your letters but merely treating it as a validation, etc., etc. Also, if they are considering this a "validation", then ask them for a copy of the contract that gives them the right to collect on this debt.....here's a hint, what they send you is going to differ from what WS is going to say.....Also, CC is most likely going to send you a "Modification Agreement" trying to get you to sign something with them saying that you are indebted to them, etc. Send it back with the word REJECTED - I DO NOT HAVE AN ACCOUNT WITH CASH CALL on it in big bold writing across the whole thing. They are trying to trick you because they don't have anything in their files saying you owe them a dime.
Also file complaints with the credit reporting agencies letting them know that CC is trying to collect on a debt they have no legal right to collect on.
Keep fighting. Obviously, they don't want their principal back or they would be addressing your letter. We have all got to keep fighting them. As many people are defaulting on these illegal loans, it's got to be eating into their bottom line at some point....

I know that I don't owe Plain Green anything because of the combined loans having an over payment. I know that I still owe CC/WS principle bal minus payments I have already make. I know that they will not sue me because they have to comet to Arizona to do..
But other that filing complaints and sending them the periodic email reminding them both that I am waiting on a response, weather it be to get a PIF or a settlement agreement..
What else if anything do I need to do? Is it time to basically sit back and wait it out?

I found two interesting article about CC/WS - I started a new tread, but I believe due to cut and paste issues - It is being held for moderator approval. If It is better for me to post a different way let me know..
What to do next?
Do I just keep sending the letters to CC/WS and Plain Green Weekly - and see if they ever respond? Do I need to change my letters any? Do I only send the letter to CC or to WS also, even though I do believe they are one in the same?
The only response from CC was the email from Ellisa asking me where I go her email from on 10/4 and then the letter in the mail on 10/16 validating debt,"Please be advised that it is our position that we have complied with all aspects of the law in relation to the validation of the above-referenced debt and consider this matter closed." I have sent them emails - 10/16 and 10/23 - nothing...
Plain Green - the last I heard from them 10/15 saying that their offer of $537 still stands. But I know with both loans I had with them that I overpaid principal by $1002. I have sent them emails - 10/15, 10/18 and 10/23 since - nothing.
I'm not worried, I know they can't get into my bank account.. I know that my payroll is watching for anything funny to come in. The only thing they could maybe do is sue and I know that you all will be here to help if that happens. Any suggestions on where to go next or if I need to do anything else?

I added in Plain Greens this morning that I would be forwarding all information on to the BBB and the Montana Attorney General's Office.
And in Cash Call's email added that I would be also sending on to the BBB and the South Dakota's Attorney General's Office, since that it were Western Sky is originated out of.
