Online Payday Loan Questions - Indiana

Hi,

I first wanted to thank you for being here. This forum has been very helpful and inspiring.

My mother has 3 payday loans; one in which is local, but the other two are online. One is with WhiteHills and the other is with United Cash Loans. I have a few questions to help me understand the situation.
1.) Where can I go to find out what companies are licensed in my state? (Indiana)
2.) If an online payday loan company is NOT licensed in my state, what options do I have?
3.) I keep hearing about Tribal online payday loans; what are the regulations with them? Are they illegal? And if they are, why?
4.) Multiple loans have been made with United Cash Loans in the past and have been paid off, if they are not licensed and for there are illegal, can I collect the interest paid on previous loans?
Thanks again for being here, any additional advice and resources will be very helpful and I will continue to read up on this matter.

They all illegal lenders...you really think they are going to admit wrong and pay YOU interest??? If she owes anything right now, I will tell them to go screw themselves...she would have already overpaid.

Both of the companies are illegal. You can check out the official website of Indiana Department of Financial Institutions to verify if these companies are illegal.

You need to take the following steps:

You'll have to pay principal amount to the illegal payday loan companies
You'll have to ask for a refund if you have paid more than principal amount.
You have to revoke voluntary wage assignment and ACH authorization

UPDATE....

OK, I've closed the bank account. I am now in the process of writing emails to these lenders. I also wanted to ask can they do a garnishment from my check without any legal action? I've seen this passed around on here and wonder if I need to speak with my payroll department.
