I read a article on here last week about a problem someone was having with Resurgent capital services, so i decided. to have some fun with Capital management services, which is owned by Sherman Acquisition Limited, which also owns LVNV Funding. Anyway the poster said he sent Resurgent a DV letter and all of a sudden the account was place with another of Serman's outfits for collection. So I went ahead and sent Capital my own DV letter, they received it on the 23rd, low and behold I got a letter from them dated on 24th. stating they no long had the account, This time I'm going to send LVNV funding the DV letter, cut the head off at the snake. When they don't respond I'm going after the credit reporting companies to remove the info from credit report, If they try to make me to court, thats ok too. The SOL 4 year mark was hit in May, Looking for that $1,000, violation. If they don't take me to court, then I will send them a sol letter and then a C&D letter after i'm done playing with them. Since they are are primary debit holder, they're only option be to sell it off. What ya think? Its call harass back.


They can play hot potato with your account all they like..they key is to go after the one reporting to the credit reporting agencies. If they have listed an account on your report, then they CAN'T shuffle off your account as a response to a DV unless they also remove the listing from the report. That is where you will find the violations.

I wouldn't mention anything about the SOL, that is best used if they tried to sue over it. Sure, you could send a C&D, but they would just shuffle that as well and you would keep getting contacted by whoever they shuffled it to who you did not C&D. That is why I suggest you attack the one listing in your credit reports, because they have to deal with you, or remove the entry.
