Date: Mon, 10/01/2012 - 05:57
After doing so, mypaydayloan tried threatening me with 'their' laws and what not. I emailed them back, and sent the letter again standing my ground and now I am getting default collections notices in my email as well as an email that states I have been reported for writing bad checks? I didn't even write them a check....
Here is the email:

I really feel they are ignoring me, any advice?
Also, I sent the letters to the below companies:
Everest Cash Advance
BlueKing (I am no longer able to log into the site) They owe me a refund.
Galaxy Marketing (responded, however, they were threatening, I responded back being stern and no response back)
The VIP Loan Shop (I am thinking they are owned or backed by the same company as Everest)
Great Plains Lending (Says my bank account information is invalid on the website when I log in, however, they have not responded to my emails, one was the revocation and another for my refund)
Any ideas on any of these companies?
Thanks in advance for all advice and help offered :)

Did you send an ACH revocation to them?? If so, it is not a bad check, but a check they should not have processed. Ignore their crap.

yes I did send them an ACH.
Then they sent me an email about court cases and them being within their legal rights.
I live in VA, and online payday lenders are illegal unless licensed by the state. This company is NOT licensed. I let them know this and now they are threatening me.
I'm not scared of them, I know they can't take me to court or any of that, but I worry about the check writing because of my rent payment. Thats the only thing I even use hard checks for.

2 questions:
1. does this mean they are marking me PIF?
2. I sent a letter requesting my refund since I overpaid by 439.00, they have yet to acknowledge that, does this letter mean they are ignoring that? Should I just cut my losses and move on?

so Blueking finally responded:
Dear ,
We would like to thank you for writing into Blue King regarding your account.
It seems that you may have a misunderstanding with the terms and conditions of the loan that have been presented to you and we would like to help address the areas of concern that you have expressed.
We would first like to inform you that Blue King, Inc. is a tribal lending entity. By utilizing our services, you conducted your business with us, the Picayune Rancheria of the Chukchansi Indians, and bound yourself to the laws and jurisdiction of a sovereign nation. That being said, Blue King and Picayune Rancheria of the Chukchansi Indians are not subject to the laws of any state of the United States. These transactions are legal and compliant with all federal laws regardless of the state in which you may reside in.
As part of the terms and conditions that you agreed to, you had the option to make payment in full or rollover your loan. A payment in full was never made on the account, and as a result, the loan has been extended on several occasions.
To date, there is still an outstanding balance on your loan in the amount of $506.00. Because of our commitment to customer service, Blue King has temporarily placed a hold on the loan to stop additional debits from being processed and additional interest from accruing. In addition we would like to help with a resolution suitable for both parties.
As of today, you have paid a total of $454.00, not $560.00 as you have stated. Therefore, we will not be issuing you a refund as demanded. We will, however, apply the payments made to your outstanding balance and forgive the remaining balance of as a result of any misunderstanding or confusion that you may have had with the terms of the loan.
We apologize for any confusion that you had and would also like to thank you for utilizing us for your short term financial need.
Sincerely,
Blue King
So I responded right back, since they are wrong about the payments and are trying to add this the next payment into the balance to make it seem higher.
Heres my response:
I have records of my payments which I outlined to you below.
Tribal law does not apply to me, unless you are going to come and drag me kicking and screaming to your reservation. This loan is illegal and you damn well know it.
I am not challenging the principle of the loan which was 400.00, I am challenging my over payments.
I will believe me, I WILL go after you in all aspects of the law of MY STATE Virginia. You can speak your tribal BS all you wish, but it does NOT extend to me and you know this.
Again, the loan was for $400.00, I made payments in the amount of $560.00. $160.00 of that is owed back to me. You should have NEVER offered me a loan knowing you are an illegal lender in my state. That is not my mistake, that is yours.
I expect an email with validation that a check will be mailed to me in the amount of $160.00 which is over payment for the loan I took out. I have PROOF from my bank of these payments and they are standing behind me 100%.
You may want to take another look at your records and send out my check asap.Or get a new calculator. I even listed the dates the payments came out FOR YOU. Which my bank provided, so don't even try to argue them. I KNOW they are correct.
{I listed the payments from my bank here}
Now break out your dollar store calculator, and add those up, tell me what you come up with.
Govern yourself accordingly.

BRAVO !!!!!!! Take a bow, a lesson to everyone in this mess. Dont be afraid of their nonsense. Stay strong. Better days are ahead. I was there once, Thanks to this site that nnightmare is over. Yes, I still get some calls here and there. They dont even leave messages anymore. I wouldnt hold my breath about the refund par though. But, who knows, you might get lucky..........
Yea, I am not holding my breath on getting my money back, but I
Yea, I am not holding my breath on getting my money back, but I am also not going to let them think they can run all over me either.
Question about Cashnetusa....
I have figured that they are legal in VA as they are a CSO instead of a PDL.
I emailed them to see if I can get on an extended payment plan and all they did was email me back and stated the terms of the 'line of credit' I have with them.
Anybody have any luck of working with this company?
CashNet USA
They can stretch your payments over 5 to 6 periods. They are easier to deal with than most--probably because they are licensed.

That is the funny thing however.
According to the AG in VA, they are not licensed in my state and because they operate under the same name as a payday loan service, they said they are illegal in my state.
I posted this in another thread to make sure what I gathered from his emails were correct, nobody has responded yet but it really appears they are not legal in VA.

There are no online payday lenders legal in Virginia. Only storefront ones are legal and they have to be licensed. If you got a loan from Cashnetusa via the internet, they are like illegal. If you are still not sure call VaPerl (google it), and they are very resourceful. They will answer any questions you have. They let me know in no uncertain terms that any loans from Cash Call or Western Sky are not valid and are unenforceable in Virginia.

Thank you.
I have sent them an email asking about this company in particular.
Several have stated on here that they are a legal licensee. However the banking commission for VA stated they are most definitely NOT licensed in VA.
So I am very confused.
I was told they are 'easy' to work with, however, they are not working with me at all, just keep restating the terms of the LOC. I can no longer pay that amount and am just before revoking the ACH permission. I just want to know my legal rights before I do.
Hello. I just wanted to let you know of something. I had a pay
Hello.
I just wanted to let you know of something.
I had a payday loan with VIP and I sent them a copy of the letter in the "how to deal with illegal lenders" and I gt a response from them maybe 4 days later statin my loan was paid in full. They were super easy to deal with.
Have you heard from them yet?

So today, my HR person (whom I have notified about the issues I am having with these people) called me to say that someone call to do a 'verification of employment' on me and she remembered me telling her that they may call and to not answer anything so she told them she has no record of me and they would NOT say who they were calling for or on behalf of.
Luckily, I followed the steps here to let her know.
I have a feeling its 'MyPaydayLoan.com' that called bc they are being so hateful, not acknowledging any of my emails and still stating in the emails that they are going to take the full amount out of my account. Not worried about that, as they are on a stop with my bank but I don't know what else to do.
I have started just ignoring all the 'collections' emails they send since they never acknowledge when I reply.
What else can I do? Is ignoring them the best policy?

Just spoke with my bank and they said if any of the "slime bags" try to withdraw funds from my account to call and they will file a fraud charge against them for violation of Reg E.
I can't close the account yet, as I have checks still out and my husband payroll coming in this week but it seems they are going to work with me IF these people try something fishy with my money.

Have you heard anything back from Great Plains, I got the exact same email from them, when I responded I got some stupid email back like we can't verify your account, wanted some generic information which I knew they already had on file so I played along. That was yesterday... so we'll see - but to me having something stating: Your account has been closed from further collection activity, means the same thing as PIF...
Good luck with the rest of your progress... Keep up the good fight:)
Based on what Great Plains sent I am considering them PIF. Ho
Based on what Great Plains sent I am considering them PIF.
However I am owed a refund so I asked for that, never received a response. At this point I am just happy with a PIF since I have one that is being a pain in my arse.
I did send the one who is giving me a pain a reply yesterday and told them they best NOT think they can take money out of my account when they have been revoked since the 27th of september, then they sent an email telling me they are too far to accept mail, which is because they aren't in our country!! So I am holding to my guns on that and if they can't give me a US address they won't get a dime from me. I am done with it. :)

Tonya way to go... stick to your guns with "mypaydayloan" It took me a little while but they finally sent me a letter from their lawyer with a PIF letter. I never received an refund on the account but figured a PIF was good enough for me!
Could someone please tell me if this sounds correct to them? I
Could someone please tell me if this sounds correct to them?
I am not going to list the company because their reps like to 'spy' on this forum.
Your email questions the legality of "said company" being able to provide financial services to residents of Virginia. Please be advised that pursuant to Virginia law "said company" is able to provide financial services to residents of Virginia under our Kansas license, pursuant to Kansas Uniform Consumer Credit Code, Chapter 16A. Our Kansas License number is SL.0000293. Please be advised that we are compliant with all regulations associated with the Line of Credit Product.
The bolded part is the part I am not sure works, is this legal or are they blowing smoke up my you know what?
no it does not
it doesn't matter if they have a license in KS.they have none in VA,and if this is great plains,or plain green then the license number is bogus as both are tribal.who sent that email btw?just wondering.
