Missouri Confusion

Are payday loans, Rapid cash loans, short term cash loans, and short term lines of credit all the same thing? I'm trying to determine if Military Financial aka International Cash Advance is acting/loaning illegally not only in my state but to military members. We recently obtained a "loan" from them that will come out of our account in 4 withdrawals at almost 600%!! We are active military. We live in the state of Missouri and I have looked in e every avenue I know possible and they are not licensed in Missouri which is required. They are offshore based. From what I've read Missouri I think would consider them consumer installment lender making them required to be licensed by the state of Missouri to lend.
Could you check on them for me and any help possible would be so much appreciated!! Please....need help desperately....


That is an illegal loan. Anything offshore or on a tribal reservation is ILLEGAL. You owe principal only, no interest or fees.

I am going to wager it is most likely all of your laons are illegal as you are a servicemember. If you are in the service a licensed lender will NEVER lend to you, only offshores and some tribals.

As the guy up top said, they're illegal!

Also, legally you are not liable to pay them anything back including principal if you decided you can't do it or don't want to. They can threaten you and harass you but morally, you may feel compelled to pay back principal if in the past you haven't had any loans with a place before. If you're already overpaid more than you were supposed to (assuming they were legal to begin with) then don't worry about anything either. Bottom line, if they're illegal then they can't touch you and if collection agencies got your info later on, then more than likely they're illegal too. Hope this helps.

Thanks guys. I'll try email and faxing a cease and desist letter. I already closed the account it was drawn on. Should I go ahead and file complaints with the FTC and Attorney General? This is my first loan with anything like this....just got in a bind. This will definitely be my last!! Any other suggestions?

Sure, you can do that. The more complaints about these rogue illegal operators, the better. The more in numbers, the better we can take the trash out so to speak. I myself just discovered this website recently and have been educating myself immensely on this topic and sub-topics.

Received an email from them today. They of course are still claiming not to be a PDL...I guess I should email them with a payment arrangement and be done with them huh. Question. They are on our credit report....are they going to ding us now?
Here is their response:
Dear Sergeant,
We are in receipt of your email dated October 2, 2012 and it was forwarded to the lender. This response is offered on behalf of the lender, ICA. International Cash Advance, Inc. (ICA), doing business as Military Financial, is a British Virgin Islands (BVI) corporation. No solicitation or advertisement was offered in Missouri by ICA. Customers must seek out ICA on the internet and apply on "their" web site. The choice of law governing your loan, The BVI, was clearly displayed on the web site and in the loan agreement you executed. Our company does not provide Payday Loans to the military since they are illegal. The account that you opened is an open-ended line of credit which is permitted by The Military Lending Act and Servicemembers Civil Relief Act.
The contract that you signed electronically states, ???We are a BVI licensed company. All applications, transactions, and credit decisions will be deemed to have taken place in the BVI, regardless of where you may be viewing or accessing this site. Borrower is responsible for complying with any local statutory obligations that may exist in their state or area with respect to any transactions with ICA dba Military Financial. If we approve your application, the order to disperse funds will be in accordance with the software credit approval process established in the BVI. The laws of the BVI governing consumer line of credit agreements may differ from the laws of the state where you reside. If you do not want to enter into a consumer line of credit agreement subject to the laws of the BVI, you should apply for a loan at a provider located in the state where you live. This transaction shall be governed in accordance with the laws of the BVI without regard to its conflicts of law principles, regardless of the order in which the parties agree. Your acceptance of our service confirms your prior acceptance of this Agreement and to jurisdiction located within the BVI.???
Regardless, the lender has no desire expending effort servicing a customer who does not appreciate the value of their open-ended line of credit product that is designed to meet a cash flow crisis on a moment's notice. The Director of Operations for ICA has agreed to consider your line of credit from August 14, 2012 as paid in full once the remaining principle ($1082.00) is returned. Your account will remain in collections status until you return the funds you received. No further telephone contact will be attempted from this point forward. If no response to this email is received by October 10, 2012 with arrangements to return the funds you received, your account will be forwarded to the lender's collection agency for the full balance due.
