PDL's & Garnishments

I found out my mother has 4 to 5 Online PDL's outstanding. We have closed the bank account. I am now in the process of writing emails to these lenders. I also wanted to ask: Can they do a garnishment from her paycheck check without any legal action? I've seen this passed around on here and wonder if I need to speak with my payroll department.

Many lenders have you sign voluntary wage assignments. They are revoked when you follow the proper letter template in my signature and state that you revoke wage assignments. It is included in each sample letter. You need to give a copy to HR so they do not honor it.

yeah, I saw that very useful information. Thank you very much for the resorces. Typically it is recommended to send a certified letter but this does provide a communications trail via email. This will be my next step. Do you or anyone else have any further suggestions or causions to be awair of? I want to ensure I have everything covered before "sh*t hits the fan" so to speak! :twisted:

In my experience helping people with this, I have never heard of a lender actually trying to assign wages after being revoked via email. As long as it is in writing that is fine. I woul;dn't waste the money on a certified letter, but that's just me. As long as your mom gives a copy of the revocation to her HR people that is fine. Be advised depending on what type of company she works for, the HR people may be totally clueless as to what a wage assignment vs garnishment is. If it is a big corporation they will usually know but make sure your mom is clear this is revoking an ASSIGNMENT not a garnishment.
