cashcall problem (i live in CA)

I have an.outstanding loan with cash call. They have called and made fun of my sons disability (one of the reasons im having trouble paying). Theyre saying they.dont think his problem is a disability and theyre putting me down for trying to get out of a loan. Theyre.putting words into my mouth that i did not say. I offered a payment plan and they said.no, they will return any payment i send if its not the full amount. Im looking into chapter 13 as i filed for 7 about 5 years ago. Any help with dealing with this company? I.checked the court website for my county, they sue and they sue often. What can i do? Will they win if i get sued?
