I am from Louisiana and I had a store front payday loan that i took out in May. However, in July i closed my bank account and open another account with a different bank that does not allow me to write checks. So I have tried to contact the payday loan company to set up payment arrangements and I have not been able to contact them. Well today I receive a letter in the mail from the Sheriff department Re: Outstanding
Arrest Warrant - Final Notice of Execution (This is the first letter I have received). Then it goes on to say the Sheriff's holds an outstanding arrest warrant for your arrest for the following charges:
- (1) Worthless Check: 1016
Final execution of this warrant of arrest will occur five (5) days after your receipt of this notice. It is recommended that you make full payment to the sheriff office. No additional notice will be sent prior to execution oof the warrant.

Restitution can be made by money order only.


Louisiana state laws concerning payday loans ....
Limits of Collection


  • Collection Fees Amount - 1 NSF fee amounting to actual bank charge (only if disclosed) + greater of 5% or $25 (only if disclosed) + costs of court + fees of a reasonable attorney
  • Criminal Action - Prohibited

I did not close my bank account the bank closed my account 3 months after I took the loan out. I have tried to make payments but the loan company could not be reached. The loan company never called me or tried to get in touch with me. The name of the payday loan company is Brusly Payday Loan.

Louisiana Payday Loan Laws

State Legal Status
Lending of payday loan is considered legal in the State of Louisiana.

Loan Specifications


  • Maximun Amount of Loan - $350
  • Term of Loan - 60 days
  • Maximum Rate of Finance and Fees - Documentation fee of $5 + $45 or 16.75% of check (whichever is greater); You have to pay 36% p.a if your default period is anything between 1 to 12 months or 18% p.a if default period is beyond 13 months)
  • Finance Charge on $100 loan for a 14 day period - $25
  • APR for $100 loan for a 14 day period - 650%

Debt Limits


  • Maximum Number of outstanding loans permitted at a time - Not Specified
  • Permissible number of Rollovers - None (Cannot rollover or renew. But the licensee can accept 25% of the total advanced amount to the debtor as partial payment along with the fees and then can enter into a new loan.)

First, thing I am registered. I forgot my password and requested that they send it to me and I never received it. Second, I am educated I have a MBA. Third, I did see what you posted and I will call them tomorrow. I did check out the letter and it is from the local sheriff office. I thought this site/forum was to help people not talk about whether or not someone is educated or not. Because educated or not we all have been or debt or have made some kind of mistake in life.

Last year when we were holding out in NY, my roomie received 'summons'. The thing was printed out on those 90gsm office printer papers where you can see the manufacturers watermark when you hold it against the light :D

A couple of law students+fake legal papers+collectors = EPIC :lol:

So this I believe is nothing more than such a pitiful attempt at scaring honest people into parting with their hard earned money. You need to take up arms against such a thing.

Waffles: A mail fraud case would be excellent! Whoever was stupid enough to pull such a trick is going for a nice long ride.
