Confused by atty general in MA request
Date: Thu, 10/11/2012 - 17:47
I have been following this forum for a few weeks when I found it...Now following the steps listed for dealing with these illegal payday lenders, I am still confused by what is next.. I have currently have 4 payday loans. Which after talking to the AG office, and the MA division of banks. They want me to file complaints with the both of them, as well as the FTC and the FBI. And I will do this. The AG wants me to send paperwork. The lenders are:
JHS Marketing $250
Archway Holdings $350
Cutter Group $300
US Fastcash $450
I sent them my revocations letters on 9/30/2012 via email. I gave copies to the HR dept at work. I had to change my phone number at home due to health issues as the constant calls would affect my heart issues.
Now my first question that I didn't see on here yet is. If I did multiple loans with the same co. does the entire amounts paid on each loan including interest count toward the principal of the current one. And I know I over paid the others before paying them off? Because if it does I would be close to 0 balances. I did make 2 payments on these but when they put my checking account in the negative, my credit union. closed my account, and reversed the payments and got my money back then blocked these people from all access.
I have to pull all my acct info together to give accurate balances.
Second I have received 1 email from us fast cash demanding money. I am not sure what my next step is. In the letter I stated I would only be paying the principal.
And third why does the AG want me to file a complaint with the FBI online.
I am afraid I may lose my job over the harassing calls at work... my health can't handle much more..
Once I get my numbers together I will post
above listed is only currant principles.
Thank you for your help.

Follow the advice of the AG. You won't lose your job because of this. Just inform your boss and co-workers about this now only. Ask them to not receive such calls. Don't pay any money to US Fast Cash if you have paid off the principal amount.
painful question
Ok I guess I need to be painfully blunt on my question.. I find this very embarrassing but if I did multiples loans with the payday lenders, and previous loans were dragged out months then paid off. My question is would all those fees and interest be counted toward the new loan and be considered paid in full. I KNOW I should have been smart enough not to start another one but I did and I can't change that. But I would like to know if adding up all those months of paying previously would be counted toward the new one.. thank you for any input. it is much appreciated..
let me answer this
YES!!!!!!!!!!!!any overpayment on previous illegal loans with the same illegal lender gets applied to the current loans.much to their chagrine.
numbers on my pdls
I spoke to the AG office yesterday, and I will be sending them all info pertaining the pdls. I asked her if the huge amounts of money I paid on the previous loans under the same pdl name could be put towards current loans and she said she didn't think so.. but again she stated she is not a legal person. Anyway I don't want to pay these horrible people more... So being embarrassed about doing multi loans and in dire health at the time, I did....
JHS MARKETING loans total $650.00 total paid to them $1030.00 nothing paid on recent loan... my bank reversed the payment.. now closed
ARCHWAY HOLDINGS loans total $950.00 total paid to them $1552.50
$52.50 paid on recent loan.
CUTTER GROUP loans total $750.00 total paid to them $1140.00
nothing on current loan...my bank reversed the payment..now closed
US FAST CASH loans total $1450.00 total paid to them $1975.00
nothing on current loan..my bank reversed the payment. now closed
So again I am asking, can all the over payments from previous loans be put towards the current principle loans? Because if I can, I do not owe them anything..
And how do I state it to them that I am not paying them anymore. They have been more than paid back..
The harassment calls have started at work... and in emails...
I need to have the right format to send them that I am not giving them any more money if I don't have too and that all info is being turned over to the AG, FTC, BBB, MA Division of Banks, and the AG wants me to send a complaint to the FBI.
Any input would be most appreciated. My health is as at risk right now and the stress of this is making my heart condition worse..
Thank you...

Read the post before your post.
Legally you owe an illegal lender NOTHING. NADA. ZIPPO. ZERO
The contract is null and void and unenforceable. The lenders know damn well where they are legal and where they are not...it is all a numbers game to them. Morally you should pay back the principal but it sounds like you have done well more than that...so dont pay them another dime.
Let your work know that your bank account was compromised and to hang up on any callers, telling them specifically not to call. If a CA calls, immediately send them a cease and desist letter telling them to bug off.
Make sure your employer has a copy of your voluntary wage assignment revocation.
Sit back and take a deep breath....you will be fine!!!
How do I notify these pdl people I am not paying anymore to them
Thank you for your help. So now the question is how do I notify these pdls that I am not paying anymore, as they have been overpaid already.
Do I resend my revocation letter again with some type of statement on it. And that I have filed complaints with AG, FTC,BBB etc.. And do I demand an email that states paid in full.
I did give the hr dept the letter my revocation letters. and I told my coworkers about hanging up..
I am glad I have this website. The information has been a life saver...
