Refinanced with Ace and they withdrew ENTIRE balance!

ARGH. Unfortunately, I had to take a loan from Ace (and another smaller one from what I now know to be a completely illegal source). On Friday, I completed the online electronic documents to refinance the loan and pay only the fee until the next cycle when I can pay the balance. Lo and behold, the jerks went ahead and took the entire sum out of my account anyway. They claim I missed something on the paperwork (really? How then was I able to complete the transaction?) and that they called and left a message (bullhockey. No call. No message).

I am LIVID. I'm not trying to get out of paying the loan. I took it and I fully intend to pay it back. That said, I now have $100 left to get me through the next 2 weeks and I have a phone bill to pay. I consider this criminal. Wire fraud at worst, negligence at best. I filled out the documents and they debited my account anyway and refuse to do anything about it. The charming supervisors I spoke to suggested I could simply take out another loan----of COURSE they did, that's another $150 in fees in their pocket. I am considering working with my bank to dispute the charge, but they cannot do anything until the debit comes off of pending.

Am I totally screwed here? Do I have a leg to stand on if I try to revoke the charge? I really do not want to close this account, but I'm so angry I may have to.

Thanks for any help, even if it's just agreeing that I'm probably SOL. Ugh. Bottomfeeders.


You need to file a dispute with your bank after the funds have posted.

Most banks won't do the dispute when it is still in the pending stage, as the company could decide not to put through or reverse it.

After you see it has posted, call the bank, I find dealing with the fraud team works the best. Tell them exactly what happened, that the amount debited was not authorized. They will reverse the charges and open a case. Most likely send you an affidavit to sign. This should allow you to get your money back.

You also need to send the lender a letter stating you reovke any and all ACH authorizations and wage assignments.

Thank you, Tonya! I'm just not sure how to handle it past this point....I DO want to pay the amount I had agreed to pay, just not the entire balance until my next paycheck. I'm wondering if Ace will allow me to do so if I dispute the charge---I'm nervous that they will just try to force the payment through in total once they figure out I've disputed it. The whole thing is utterly ridiculous, and they know it. I could kick myself for even engaging in this process, but I, like many others, had no other choice.

Don't be ashamed or embarassed, it has happened to most of us on here and we are still in process of dealing with the fall out.
Ask your bank what their dispute policy is. My bank won't let me close out until the dispute process has been finalized but are watching to make sure the companies I have disputed with do NOT put through anything else. I bank with Bank of America if that helps you.
Is this lender online or storefront? What state are you in?

It was online, and when I took the loan I was in TX, but moved to California this week (to further complicate things!).

I bank with Chase, and I suspect they will be helpful. I just wish there was a way to get someone at Ace that I could trust has a clue what they are doing. There is a place on Ace's website to "resolve your account", and I wonder if perhaps I could make a payment there after I get the ACH reversed. I have a feeling I'm going to have to close my account to deal with the other loan once I've paid the principal, but with direct deposit from work set up I'd like to avoid having to do that yet.

I simply cannot understand why they don't admit their mistake and assist me with this. It's not like they won't be charging extra fees to refi anyway! It's maddening.

Will I? I've already paid the 500 back plus a 151 dollar fee---if I re-loan won't I just get hit with another 151 fee? If I'm figuring this wrong, PLEASE set me straight! I'm all for easier at this point. I've already spent far too much time stressing about this. But the way I'm looking at it, I'll basically be paying 300 in fees for the same 500 loan.

Fascinating. Amusingly, when I filled out the docs to refi, after the $151 (which was the amount of finance charge on the $500), the balance was stated as $500. No clear indication that I would have ANOTHER 151$ due again on top of the principal balance. No wonder folks get so in trouble with these loans---that is absurd!

I had my bank reverse a charge and closed my account the same day. We also opened a new one. I sent out the ACH letters etc the next day. I'd highly recommend you doing the same. We also have 2 direct deposits to do. The first one we got a paper check. I wouldn't be surprised if this next one is direct deposited though. The other is a monthly check and it is scheduled right on time for the new account.
