FTC vs Tribal lenders - 3/1/2012

Wow...

There is A LOT of pdl's listed in there.

And I had NO idea cnu is operating under a tribe.

Interesting to see how this case plays out in the long run.

What I found interesting was under point 69 --

69. Section 5(m)(1)(A) of the FTC Act, 15 U.S.C. ?? 45(m)(1)(A), as
modified by Section 4 of the Federal Civil Penalties Inflation Adjustment Act of , 1990, 28 U.S.C. ?? 2461, as amended, and as implemented by 16 C.F.R. ?? 1.98(d), authorizes this Court to award monetary civil penalties of not more than $11,000 for each violation of the Credit Practices Rule prior to February 10, 2009, and $16,000 for each violation of the Credit Practices Rule on or after February 10, 2009. The Defendants' violations of the Credit Practices Rule were committed with actual knowledge or knowledge fairly implied on the basis of objective circumstances, as set forth in Section 5(m)(1)(A) of the FTC Act, 15 U.S.C. ?? 45 (m)(l)(A).

So does that mean if we file a complaint with this guy, we can get civil money back? That's kinda what I am reading....each violation is 11k...think about all the people on here who have been violated, that's A LOT of money. They'd just disappear over night and nobody would see a dime, but they would be gone.

VA has a sort of thing set up as far as fining as well, but I don't know if they ever go forth with it. I was told its hard because Tribal places plead 'sovereign immunity' while the others are offshore and we can't prosecute them.

Does anyone know if the lawsuit was settled? I got a check for $300.00 yesterday from USFASTCASH with Customer refund in the memo and on the check stub. I took a loan out quite a few years ago and paid it back. Is this legit or just more scamming?

If you do cash the check, cash it somewhere other than your bank.......
