As before the two companies are ameriloan and starcashprocessing and they both are calling saying there is a civil judgement and criminal for fraud, so I wanna know what is the worst that could happen and will I go to jail, cause I don't wanna go to jail and am really worried and is causing me so much stress that I dont need could you please respond


Both of your loans are illegal tribal loans and thus unenforceable. The ones calling you threatening judgments and jail time are also an illegal collection company. Find out who the company is and send a C&D letter or you can just ignore the calls.

Since they threatened criminal charges they are definitely operating outside of legal statutes. You can not be arrested for debt, they are civil and not criminal. You can also keep an air horn by the phone and when they call next, set off the horn in the mouth peace.

If you are still worried about any civil or criminal charges you can contact your local law enforcement and verify if there are any criminal charges against you. Contact your local court to verify if there are any civil judgments as well. If you have not be properly served any debt you are being sued for is invalid.

OK the one company called today and said if I don't contact them by noon tomorrow that are gonna call my payroll department and garnish my wages, now if I call them and set up arrangements I can tell them I wanna pay fifty dollars a week until its paid and I have that right according to the fair debt act right? What if they don't accept my amount what do I do, please respond ASAP, thank you

You don't have to pay them anything. This is what you do - send them an email and never speak to them again

Dear Lender

I will be paying you 50 dollars a week. If you don't want my money that's fine. Charge me off to a CA, I don't care.


That's it. They can't just garnish your wages by calling payroll... stop believing their BS.

From personal experience, a payday lender did send "fake" garnishment wages to my payroll dept. Payroll thought they were legitimate. I was not aware of it until my paycheck was different then it normally was. I immediately contacted payroll, informed them they were illegal. Got my state's financial institution involved and the money was returned to me. I am telling this as you may also want to tell your payroll department of this illegal lender so the same thing does not happen to you......just to be on the safe side.

You can not be arrested for a debt. Debts are civil not criminal. The collection agency is using illegal scare tactics. File a complaint with the FTC right now. You can do so online. Send a C&D letter to the collection agency as well. Ignore their calls. Tell your employer you have been the victim of fraud if you have not already. This way your employer will not take any calls seriously.

I contacted the ftc they have a complaint, contacted the attorney generals office ansmd they said its a scam and I won't be arrested and I also was told to contact the FBI's something division as well
