I recently asked how to remove CashCall/Western Sky from my credit report.  I disputed it and sent them the reasons as to why they shouldn't be on there, but it came back verified.  Today, I faxed EQ and EX again, however, I included everything from NYS Banking Law, the emails I have sent CashCall, their loan agreement (western Sky) and the certificate that the State of South Dakota issued Western Sky, not the "tribal" land they claim.  Has anyone been sucessful at removing them?  If so, is there anything else I should be doing?  I have contacted CC well over a dozen times trying to settle the account with no response other than the first of the tribal thing they send everyone.  I have filed complaints with the AG, FTC and Consumer Protection.  I filed a complaint with the FTC about the bureaus not complying with NYS law.

I've been dealing, for 8 months, with Western Sky and Cash Call too (several posts in the forum here and letters to everyone imaginable) - it's just unbelievable to me that these people are allowed to exist and operate this way. There MUST be a way to get these sleaze bags off of our credit reports - they are ILLEGAL. If the stupid CRA's won't do it - how can the issue be forced?

Usually negative item remain on your credit report for 7 years from the date of your first default. But Cash Call/ Western Sky is an illegal lender. They can’t report to the credit bureaus. As they have done it, so your only option is to inform it with the credit bureaus and request them to remove this item from your credit report.

This has been a persistent problem and Cash Call has recently started effectively reporting to the bureaus. When you dispute it, nothing happens. The best approach would be to file complaints with the NYS DFI and the CFPB/FTC.

Everyone keeps saying it is an illegal loan and that they cannot report to the CRAs, HOWEVER, they are reporting to the CRAs and no amount of disputing with the CRAs, no matter what proof you send them that they are illegal, etc. works. They remain on your credit report and you are then put in the "frivolous dispute" database so that they refuse to investigate (NOT THAT THEY EVER DID) any dispute. How do we fight this? They do seem to have the upperhand. I've been fighting this fight since August 2012 and have gotten nowhere except a credit score that has tanked over 100 points due to the continued negative reporting. Complaints have been filed with my state AG, South Dakota AG, California AG, the FTC, the CFPB and absolutely nothing has helped.
