I emailed White Hills Cash explaining that payday loans are illegal in AZ. This was the supervisor's response:

As clearly indicated in its website disclaimers and the loan documents executed by you, White Hills Cash is a tribal limited liability company established by and for the Ft. Belknap Indian Community pursuant to tribal law. Both our website and your loan documents explain this fact clearly. As a sovereign enterprise, White Hills Cash is not subject to state regulation.

By signing your Loan Agreement, you agreed to the application of Ft. Belknap Indian Community law. You agreed to comply with all of the terms and conditions of the Loan Agreement upon execution. White Hills Cash relied upon your representations in good faith and approved your loan based upon such representations.

Has anybody loaned from them before? Do state laws supersede tribal laws? Or is there no way around the tribal laws. This supervisor keeps telling I have to pay the balance in full with the fees.

State and federal laws do supersede tribal laws, unless of course you live on a reservation. Have you done all the necessary stuff like revoking ACH and voluntary wage assignment? If yes and there is no way they can get at your money, reply to the mail and simply say that "You are more than welcome to collect on this alleged debt in court."

That should take care of things.

Yes I had the same with White Hills.. As soon as they got my email, they gave me that 'we are legal and tribal' jargon and then ended the email with we now have you listed as PIF... Win!

Send a certified letter , return receipt requested by u.s. mail to both your employer and the lender revoking any authorizations you provided to them in the past.
Keep a copy of each letter and your post office receipt, and the certified return receipt card you get back in the mail from the certified letter sent with return receipt requested.
MAKE SURE YOU TELL THE POST OFFICE CLERK YOU WANT RETURN RECEIPT REQUESTED ! There is an extra small fee for this but you need this.
When I use this method I staple the receipt to each of my letters along with the return receipt card that comes back when they sign for the letters.

p.s. pay for each certified letter separately ! to have a separate receipt for each letter.

White Hills was easy. I sent the letter revoking authorization and wage assignment and advising I knew they were illegal. They resonded back with the Tribal jargon but They gave me two weeks to pay the principle amount which I did and it was shown PIF.

There are examples of the letters along with all the steps you should follow on how to deal with in this link - http://www.debtconsolidationcare.com/paydayloan/dealingwith-illegallenders.html

What state are you in? Who borrowed from? How much originally borrowed? How much paid to date?
