Hi and welcome,
Hi and welcome,
The first thing you need to do is GO TO COURT. However, you are due to have a child in about two weeks, which might make things rough. I would contact the courts and/or the creditor, explain the situation and offer to provide documentation if you need to. It would be in your best interests to see if this date (depending on when it is), can be moved back.
If you don't go and don't contact the courts, your creditor will win by default.
In your letter to the creditor, I would propose a payment plan that you can live with. They might settle out of court, who knows?
Good luck and keep us posted.....
The impression I got from
The impression I got from reading your first post was that you did owe the money? (Correct me if I'm wrong). I would check that you did owe the whole amount, and attach your proposed payment plan to the document. Send this document either registered mail (Signature required) or FedEx/UPS. This way, you have proof of delivery. I would also include your letter stating that you are about ready to give birth SOON, so an immediate court date is not feasible for you. Include a note from your doctor or other documentation backing this up.
And to answer your last question, a non-court judgement would always be better.
One last thing: I would call the courts to confirm this was received, as you do not want them thinking you blew this off, as the creditor will win by default at that point.
