I have looked through many forum post about Western Sky and Cash Call and not found one where a settlement with these companies (or I should say company) was reached.

Has anyone ever been able to settle with Western Sky/Cash Call on their illegal loans? Paying only the monthly payments until the principal was paid? Thanks!

Hi:

I am also trying to settle with Cash Call/Western Sky. I have been trying since December 2012 and as momofthree27 pointed out, have not received a "firm" offer. They have been sending me my note, agreement, and letter of no wrongdoing. I filed a complaint with the Indiana Attorney General and the FTC. This Elissa Chavez (sp?) sent me the reply she made to the Attorney General!!! LOL

I am not trying to get out of the debt, but I am certainly not willing to pay a 296% interest rate if I do not have to. If they would only agree to settle with me then they would get what they let me borrow. I have settled with others and actually got refunds from Cash King Advance and Silver Dollar Payday. I am waiting for mediation to be completed with Ameriloan and UCL. Needless to say, I got myself in a mess and am happy I found this website.

The payday lenders know about this site as well! This site was referenced in my replies from AML and UCL.

I have not checked my credit report, but I do receive alerts and no deliquencies have been reported. I will wait and see what the AG has to say.

Im in the same boat. Ive been going back and forth with them since December 2012. Ive received numerous offers from them but none that even come close to what I really owe. So until they agreen they get nothing. I know they are on my credit report but I will deal with that after I hopefully get them to agree on the remaining $684 I owe them.

I know that Waffles has, I am still working on it with them - But they have already offered to deduct over $10,000 from what they say I owe..so they are getting closer...

I have been working on this very issue since August of 2012. I am in a different situation in that I have overpaid the princpal by $1,100 so I am just trying to get them to agree to a PIF. They have not budged on their stance it is a legal loan and that I still owe them the principal balance of $2,554 on a $2,600 loan of which I only received $2,525. Their latest settlement offer of 1/25/2013 was for 70% of what they say the principal balance is. The very next day I received a letter stating they would be charging off the account and sending to outside collection as of 1/31. Because this is really killing my credit score and is the last badie I have to resolve, I did counter with an offer of 30% of what they claim the principal balance is, WHILE at the same time saying I still dispute the legality of the loan, etc., etc. but in an effort of good faith would be willing to resolve the issue if they agreed to delete in its entirety from my CR. As I expected and is their MO, I have received no response. When pulling my credit reports for review I do see where Delbert Services pulled a soft pull on 1/25 -- the same day the letter saying they would accept 70% and the letter saying they would be sending to outside collections was dated. They haven't officially showed up on my CR, but I expect that to happen any day now. I did a quick debt collector search to see if Delbert is licensed in my state. They are but the interesting thing is they have the same address as Cash Call. Really not that outside of a collection agency are they? I have a collection attorney on stand by if it comes to that. I am going to give it until the 15th and if I still haven't received a response I am going to officially revoke the settlement offer and hire the attorney to handle. I hate to spend the money on the retainer, but at this point I just want to stick it to this company.

On another note, I saw were another state, Oklahoma, has issued a consumer alert against Western Sky. Keep complaining to your AGs and the FTC, keep fighting these people and hopefully they will eventually get broken down. They were when they used the "rent a bank" scheme which is why they had to switch over to the "rent a tribe" scheme. I think it hurts their case when the head of the tribe releases a statement saying that they are not a tribal entity and they are not owned or operated by the tribe in any way. I'm guessing the tribe is tired of being contacted by the various agencies. We can only hope, right? Hang in there and keep fighting.
