Western Sky/Cash Call...getting different info PA Clarification

Hello!
Here's my loan info:
1. I live in PA
2. Western Sky - being serviced by Cash Call
3. $5,075 (recieved $5,000 after $75 origination fee)
4. $1,372 with $1,000 being an extra payment supposed to go towards principle.
First off, I have found so much valuable information on this website and I want to thank you!! Also, I know the Western Sky/Cash Call topic is brought up a million times a day on this website but I have some really straight forward questions that I have not been able to find the information to.
First, after talking to the PA Department of Banking I found out that (of course) the loan is illegal in PA AND the guy I spoke to referred it as a payday loan. Of course Western Sky/Cash Call says it is an installment loan. From my understanding (and correct me if I'm wrong) if it is an installment loan then they need to be licensed in the state of PA AND has to abide by usary rates...right? And if it is a payday loan then it is outright illegal. Either way, the loan is illegal in PA.
I have already sent the first letter explaining this to them (from a letter I found on this website) and they sent m a letter back telling me the regular mumbo jumbo indian reservation blah bah blah info that they send everyone who disputes the loan. But I haven't found a single person here that has gotten this removed from their credit report. There's tons of information on HOW to do it but no one has said that it works. I am curious if going through everything will actually get it taken off? I want to pay the rest of the principle but I also want the $1,000 principle payment I made apply as well. It has not been applied and is almost at the same amount I borrowed at. I refuse to pay them another cent if they are not correctly applying my payments. I have closed my bank account and sent them the first letter. I need help finding the laws regarding this in PA. If I send them something saying it is a payday lender they will just send me back something that says they are not. IT's all hoops to jump through and I am willing to do it but want to make sure I know what I am talking about.

@ Acole0226 - they are going to try to tell you lots of things.. ignore them, the loan originated with a tribal lender - illegal in all states... not to mention the over usury laws..

See if you can post the links for what you found, many of us can use this information... sometimes difficult to copy info - but you can usually share the link to the information. I have just been ignoring them basically since Oct... but anything will help in case they decide to send to Collection... or by some wild crazy chance in hell court... which from what I have read on this forum has never happened...

I too live in PA and took out a loan with WS/CC for $5075. I have paid back so far about $2400. I just sent out the email and revoked my ACH authorization. Got the same response about the legality of the loan, blah,blah,blah, along with a statement. Apparently only $2 have been applied to the principal!
I have offered a 10 month payment plan to pay the remaining $2600, but they just keep sending the same email about the original loan contract. Should I go ahead and send them payments according to my payment plan until I have paid the $5075 principal? Or should I just stop and wait what happens?

Thank you guys! I am wondering how to deal with the fact that they say they are an installment loan, not a payday loan. So if they consider themselves an installment loan then they would have to abide by the state usury laws and interest rates, is that correct? The banking department referred to them as a payday loan but I was confused how they would be a payday loan if they're set up more like an installment loan.
Also, I am getting ready to write my 2nd letter to them. Is there a thread that helps with writing the response letter? I will insert the laws in it. Just wasn't sure if there's anything else I should include other than the usual stuff regarding having them agree to settlement of the principle.

@Acole0226 I have a loan with them to and they are going to spew alot of crap to make you feel you are in the wrong and they are in the right. They keep sending me letters trying to negiotiate to "help" me. But until they agree to apply what you have paid to the principle and agree on you only paying back the principle dont give in to them.

I spent about 3 hours today doing research on this and found some really awesome information on Western Sky. They actually aren't tribal at all and if I can upload documents, I will be uploading a Certificate of Organization Limited Liability Company for Western Sky I also found cases/judgements, treaties, and laws that completely make this company and their lending practices illegal.

You're right. The loan is illegal in your state. They won't correctly apply your payments. You're morally obligated to pay back the borrowed amount only. That's it.

I haven't sent them a payment since Oct, I am not going to send them any thing until they agree that I only owe them $1398.47, the last mail I got from them was for an offer to settle for $2074.74 - they are getting closer.. I ignore all from them, when they get where I want I will see if we can then agree on how I will pay it.. until then oh well.
