Revoking ACH with BofA - CA
Date: Wed, 01/16/2013 - 15:16
I've been there.
Overpaying, I have a California BofA account. I now live in WA state but my account is still out of BofA, the only reason they could tell you that you can't close your account is if its overdrawn. You need to make sure its up to date. It is in their website that shows the rules that state that you have the right to place ACH revocations as long as they are done 3 days before the due date. You are just getting a lazy branch manager that doesn't want to deal with it. I have 3 of the same lenders that you do. If you need it, I have the mailing address to the main customer relations office in Florida for BofA. I actually faxed my letters in to the Norwalk, CA branch and then followed up with a call to make sure they got it. I will find it later this evening but its not just a BofA law, its also a federal law that you are allowed to cancel an ACH. The ACH will only cause your account to open if the account is in the 3 day closing process. I called BofA after about 4 days and asked specifically if my account would reopen if an ACH tried to go through and they said that it would just bounce back. I would suggest you just simply close your account, make sure you have at least 3 business days before the next ACH is going to go through and open an account in another bank. After the 3 days are up, call customer service confirm that it is closed and nothing will go through then walk right into the bank, give the revocations to the branch manager and tell him to make sure he puts it in the system. I will get you the page that shows the BofA policy and the Federal policy shortly.
Revoking ACH
Update #2. got a call from Cash Yes regarding my returned check. Asked me if I wanted to resubmit it over the phone - Uh No. told them that I emailed a ACH revocation notice & now they want to settle for $50 via credit card. Original loan was for $900.00. know I paid at least a grand in fees cause the balance is only round $700 & it's been months. So they probably owe me a refund....
Revoking ACH
Replied to AMT with a copy of the front page of the court doc. Haven't heard anything back yet.. Still more to go....
You're best off calling the
You're best off calling the bank's 1800 number and asking to speak to a supervisor or something. Better yet try to find your bank's executive response line.
Closed my B of A
I had B of A for about 11 years before I got into this payday loan mess. When I tried revoking the ACH transactions they said I couldn't do that and whatever whatever. What I did was I went straight to my Payroll department and switched my baning infor just in time before my direct deposit would go through. I called the bank and told them to close the account, it was still with in that 3 day window that the loans would try to withdraw. When the lenders attempted to withdraw the funds they were denied for insufficient funds. I was never charged any overdraft fees from the bank because the bank didn't push the withdrawl through.
I hope you've had better luck with them than I did.
Revoking ACH
Loan from Advance Me Today was for $500. to date I've paid $1,185. You would think they would be more than satisfied and move along to the next sucker.
Advance me today is a pain
One of my lenders is AMT, they are the only ones really giving me a hard time. The problem is that all their emails are the same, its just an auto response. Keep ignoring them and make sure you check your account daily. Send them the Cease and Desist letter. You will get an auto response but at least they will see that you are top of things. Keep it up, I almost had a heart attack when BofA let 3 payments through, called and was told they wold drop off. They did and all is good for now.
Revoking ACH
Update: So on Fri, all the debits bypassed the stop payments and cleared my acct putting in in the negative. On Tues the bank reversed all the payments & now the notices are starting to come in from the lenders. I sent them revocation emails and am now re-sending them. So far only Advance me Today has responded saying they don't have to have a license in CA so I am going to send a copy of the Desist and Refrain order with their co name on it.
Agree
I agree with HelpinAZ, they have no right to say you can't close it. I had been wanting to close my BofA account for years and this finally I did. Make sure you are not negative and walk into a branch and closed it. No explanation needed, after you close it wait the 3 days to make sure its closed for sure and then present them with the ACH revocation letters.
Banks should be on the side of the consumber
I had trouble with my bank too. I had to go to two branches to get it closed. I will lett someone else tell you what to do, but you have every right to close your account and you need to do it before your next withdraw date. If those charges come through the bank will have to reverse them. Email the letters to your lenders. After I did I got three emails from lender saying they did nothing wrong, but they considered my account as PIF. More advice will be along soon!!

Went to my bank(Huntington) with the FDIC 907 to stop an ACH for Friday..the branch manager told me the language in the law applies not to them, but to the lending institution(PDLs)..anyone else encounter that..Im goin down the tubes.
The debit hold should help if
The debit hold should help if the account is on deposit only - that is considered a hard block and should keep them out of the account. but, you also can't debit the account for paying normal bills. .. If the account is not in the negative - who are they to tell you where you keep your money... or how to pay your bills? Did they charge you for the stop payments, and how are they going to stop them if they run under a different name or amount? Oh and to add another reason I don't bank at BofA any longer..
You bank manager is an IDIOT.
You bank manager is an IDIOT. The law does apply to the PDL....but it is also the banks responsiblity to reject any ach that gets thru.
