I got myself in trouble but am working my way out. BOA has been great. I have researched and tried to find if any of these companies are legal in SC:
Ameriloans
Cash Yes
Advance Me Today
White Hills Cash
Golden Valley
Nanakan LLC
Canyon Creek

From what I have read in SC I only owe what I borrowed plus $15 for each hundred. Needless to say I have payed more than that back already and they say I haven't touched my principle. BOA was wonderful in stopping these drafts and told me to come first thing in the morning to close one account and to open another. They are even returning all fees I paid.

Just need to know if any of these are illegal in SC
Thanks. I have gotten so much advice the last few days off your site.

you are right rose.any lender must be licensed in SC to be legal.btw nankan, and canyon creek sound tribal, but i could be wrong.

I sent the Form letter to Advance Me Today and this was the reply I received.

"Please note that, we are not required to obtain state licenses and individual state laws do not apply since the federal laws adopting the treaty between St Vincent and the United States, supersede any state's laws on the subject."

Hang in there - these illegal lenders cannot do anything other than harrass you in hopes you will cave in and pay. Hold strong. Just tell your employer that your information was hacked/scammed and that you have reported them.

Borrowed $500 paid $450. Told them I was more than willing to repay the remaining $50, but was told I owed $650. About fell off my chair.

Well an update. All have responded with my account paid in full except for Advance Me Today. They are now sending rude emails with different wording as above. They do not have to comply by state or federal laws, ......
Any new verbage to suggest emailing them?

I am still dealing with them. Thanks so much for your help. You are a life saver.

Great news on the PIF's!! I would wait it out a little with Advance me - they know they are illegal, they figure if they harass you then you will pay.. I would just ignore for now.. how much did you originally borrow from them and how much have you already paid them to date?

They are stubborn I will say. I made the mistake of actually taking one of their calls and you could hear all kinds of things in the backgrounds, like people talking about calls they had made and threats they had made. Really just ticked me off. They are leaving messages on the answering machine at work. Really embarrassing, saying they will take further actions if I don't call John Lawrence and pay them off. Up to $850 on top of what I have paid them. Told them I would be more than willing to pay them the last $50 I when they send me a mailing address.
Will they ever go away? This is exhausting.

If they want their $50.00 they will tell you. If not, it is their loss. Glad you did not fall of your chair I am sure you would have hurt yourself:)

Sorry, I search for hours, but did not see these answers. A little over whelmed.
Thanks for your help.
I do believe, may be wrong, that they need to be liscened in SC to be legal also.

You obviously have not read SC laws properly.
State Legal Status
Lending of payday loan is considered legal in the State of South Carolina.

Loan Specifications

Maximun Amount of Loan - $300
Term of Loan - Maximum 31 days
Maximum Rate of Finance and Fees- 15%
Finance Charge on $100 loan for a 14 day period - $15
APR for $100 loan for a 14 day period - 390%
The $15 is for a 14 day period.

You need to do an ACH revocation first....without it BOA could legally reopen your account and charge you with the debits. Follow the link in my signature line for full information on how to deal with them.

You could have searched the forum to get this information...

Ameriloans illegal tribal
Cash Yes offshore Belize illegal
Advance Me Today illegal offshore St Vincent
White Hills Cash illegal tribal
Golden Valley not finding website
Nanakan LLC not finding this one
Canyon Creek not finding good website
