ok. back in 12-12 i applied to a payday loan website that sends my info out to other payday loans sites and i was supposed to be contacted by any co to agree to a loan. i was not. however, on 12-28 there was $200.00 in my checkin account from hydrafund 3. i also recieved a weird email stating the terms and agreements from hydrafund that went to my junkmail folder and they had the nerve to print my name at the bottom of the typed up 'contract' and state i electronically signed it. wow.
so i closed my checking account and took out the 200.00 to give via a certified money order to hydrafund, and learned that they are a illegal offshore lender to start with. they were rude when i called them (no surprise) and refused to take the money back, stating they sent it to a outside collection agency. ok.
i got three emails stating my account was going to national credit adjusters in kansas. i never contacted them due to what i read about them as well on forums, and legal websites. i changed my cell number, as i did not want to be harrassed. i was waiting and waiting for a letter validating my debt in the mail to send the 200, although of course by now i am sure it's more then that due to interest. i also live in md and payday loans are not legal in this state, which i did not know anyway.
never recieved a letter from nca, i contacted the police locally and filed a report and filed a report with the baltimore attorney general but did nto get a response.
yesterday my dad recieved a call on his cell (how they got that number i do not know) from a thomas moyer at rja captial, in ny. my dad, although was instructed not to, gave this dude my new #. he left a message with the last four of my social and asked that i please call immediatly or have my legal aid call to make a statement about a claim filed against me at his office and he would tell me my legal rights. REALLY?
i tried to call back but it was after hours and no one picked up but his voicemail. (read that happens with rja, too). obviously by doing some digging online i found out what a bunch of losers these people also are. and i still have NOT recieved any letters in the mail from rja capital or nca.
i am not sure if they have tried to call my work, i work overnights and have not been told such, but i did inform my hr about this two months back after reading their illegal collection practices.
i have been planning on filing for bankruptcy anyway at some point, due to other large debts i cannot pay off. i barely make ends meet now.
- i plan on ignoring rja and wait to see if i get a letter in the mail validating my debt, or be sued, which of course, it's a small amount owed but i still don't want that. i have NO issue paying the 200 back, but i sure as heck am not sending it to a fly by night person who will likely threaten me and call and call and call. i will disable my voicemail too, cannot deal with the stress.
is this a good idea? what would anyone reccommend? i doubt i'll be sued, it would come out in court that hydrafund is illegal anyway and that any pdl's are illegal in md.

You may also want to contact the Maryland Commission of Financial Regulation, 500 North Calvert Street, Room 402, Baltimore, MD, 21202, 410-230-6100, finreg@dllr.state.md.us
They along with this site will help you with your illegal lender.

You're absolutely right. Hydra Fund is an illegal tribal payday loan lender. They can't sue you. You only owe $200. Nothing more. Let RJA validate the debt first. Even if the debt is validated, pay back only $200 via money order.
