I have gotten into payday loan hell and need help to get out...I am in Mississippi...I have 12...some are payday loans and some are classified as short term installment loans.  Most of the consolidation companies I have talked to for assistance will still leave me in a bind.  I am not in a position to file bankruptcy.  I have talked to Oak View Law Group and they are reasonable but I can't figure out whether or not they are legitimate.  I have also closed my account and opened a new one.  I am not behind on any of these but will be on Friday when they try to debit my account and it is closed.  Some of these are not even based in the states.  I don't want them harrassing me, my references or my employer.  I can't afford to lose my job as a single parent.

What do I need to do?  Any help would be greatly appreciated!

 



Having problems logging in, so this is from ny phone...c&d means they can't call, wait and see how they react...I'll check on you tomorrow, hopefully they can get my problem fixed and I can log in from my computer..don't go round and round with them, tell them and then wait and see...

They will get that fixed, I have sent an email asking if there is anything you can do .. Also, I found River Bend Cash now - they are tribal also illegal - and strangely enough owned by the same as Green Valley Cash...

You do not need to use a consolidation company, you can do this your self... You can not guarantee that they will not call, tell your employer and your friends you were a victim of fraud and they may receive some calls.

How do I find out which ones are illegal? I've searched their sites and can't find the information any where. Would it be better to use Oak View Law Group to handle this? And, once I follow the link, will it keep them from calling my references and my employer?

Great Idea on the DD... He should get back soon, if not let me know... They won't call right away if they do at all, be ready to block numbers on your phone, just don't answer -- turn off your ringer..etc.... My phone service allows call acceptance, so the only ones that ring through are the ones I allow.. and breathe and relax.... :)

When I try to log in, it tells me that my email already exists...when I try to request a new password with that email address it tells me it doesn't exist...

Try this and see if it will work,

How to reset password in drupal
Once you click on Sign in

1)In the Log in section you will find a Request new password button.
2)Click on Request new password button.
3)After clicking you will be asked to enter your email address.
4) After entering your email address click on Email new password button.
5)After you click on the Email new password button you will get a notification (request to reset the password) in your email address.
6) Just copy the link and paste the link in your browser (you will find the link under : You may now log in by clicking this link or copying and pasting it to your browser:
7)After you paste the link in a browser you will be taken to your Edit profile page.
8)Give a new password and start posting.

Let me know if this works!

I have 12 so we will see what happens once I start emailing and faxing. I am glad I didn't pay someone either...I was on the verge too...had contract in hand. I am preparing for the worst but hoping for the best! I have prayed a lot for an answer for this mess and I feel like you were my answer! Again, I really can't tell you how much I appreciate your guidance today! Hopefully we are both on the road to recovery now!

I hope this goes through. The other one I sen this morning did not. Made some progress today. Worked out a settlement with one, went round and round and with another. Received a C&D email stating that they received my request to C&D communication with me about my account but that was all it said. How do I respond to that?

I had gotten a few calls from Cash Call on my Western Sky loan - but I reminded them that they had emailed me and told me that my account status was in cease and desist and that if they needed me to I could call the FTC and report.. no more calls since.. I get only email and mail.. As for Great Plains, I had over paid so got a PIF right away, Plain Green well we are still not done there I am sure, I had paid one off and retook out, So I had over paid they said they were not willing to combine - I last sent them an email on 12/4 -
"Dear Plain Green, Do yourself a favor and mark my account paid in full. I am not paying you another cent - you owe me a refund of $1002.89, that I have paid on my loans with you. If you charge me off to collections I will not hesitate to not only cease and desist them, but make them aware that I informed you I am aware of the illegality of the debt and the fact that I will not be paying any remaining balance and that you in fact owe me a refund again for $1002.89. Cut the crap and save yourself the time. You lost this one, I know that you are illegal to loan in the state I live in.
Love, Your past customer"
Haven't heard a thing from them since..LOL

I have opened the new account and am closing the old account this morning. I had one last item that needed to clear last night. I have already been talking to the bank. I am working on what I owe and what I have paid so far right now. Some are brand new, some take it all at once and allow you to reloan, and some are short term installment loans. The balance is 10,000 with interest...it's a huge mess I have made and am scared of losing my job and my family and friends getting drug into this.

@ help - thanks for the compliment! Just here to help others, I only had three illegal ones, I had more in- store legal -- they are different to deal with - I picked my two larger ones and defaulted and came up with a plan for them and then paying off the little ones faster - just had one pay off last week another next week hopefully 3 more in Feb.. and then I will take the extra money and apply to the others to wipe them out.. Don't ever feel alone and ignore the weird totally unregistered sparatic postings - they will eventually get that all fixed..In a way you were also my answer I lost my mom a year ago today and you were my way of keeping my mind off of it.. so THANK YOU!!! I am off work today and tomorrow... So I will be here to help quickly, when I go back to work - I usually answer in early am and after work!

Most of your lenders are illegal. You owe principal only. Don’t pay them any interest or fees. You have done the right thing by closing down your bank account. Ask them for a refund if you have overpaid them. Visit this link and follow every step:

As soon as account locked down, you can start to send out letters, I sent most of them via their own Customer Service website link.. that way I knew they received them... put in your letter like the sample shows that you will only communicate via email - that they are not allowed to call you, your job or your references..

I did send him an email directly. I am waiting to hear back from HR...wanting to double check and make sure they have my direct deposit going to the new acct before I send these letters. Ready to get these out so I can quit worrying about what is going to happen when the letters hit.

You can get started with the link - the other two post were sent for review for some reason before they will show - up some time later?? -- I would consider all of your lenders as illegal - If you need more specifics I will try to help... I didn't copy and paste my post -- If I need to look all up again I can for you -- Start with getting you bank account secure, if you can close and open a new one un-linked in any way to the other.. You then can start on revoking ACH, once account is secure.. They will try to hit the account... How much did you borrow from all and how much have you paid already?

I am going to send all of the letters today. I read several things that said they need to be notified 3 days before the money is drafted so that will be today. I will send them late this afternoon. I really wish there was some way to truly outlaw these illegal lenders. Good people have bad things happen and this just compounds the problem.

You will be OK... I understand.. We have all been there --- You will be OK... I have not had any calls to my work, that I know of since I started this process in Oct, doesn't mean you won't, but you need to just tell them you were a victim of fraud and that you may receive calls, when you do the letters you will be revoking ACH auth and all any voluntary wage assignment you may have signed.. You will want to provide copies of all letters to your bank if they need and also to your payroll department.. so that they are aware.. My payroll department didn't need the letters, when I notified them that I had been a victim of fraud and to be on the look out for anything hoaky coming in, they were OK with it.. Tell your family and friends the same I am sure they will be OK...If not maybe not real friends - just saying..

It has come to my attention that this loan is illegal in my state, due the Small Loan Rate Cap of 36% per year in place in Arizona and not being licensed to do business in Arizona. Therefore, the loan contract that I have with you, according to my states laws, is not enforceable. I have contacted the Arizona Office of Financial Institutions and the Arizona State Attorney General?s Office regarding your internet loans and was informed they are indeed illegal in Arizona and was advised to pay what is due according to principle amount only of the loan. Although I am not legally required to do so, I am willing to repay the principal balance of this loan. To date, I received a deposit of $2525.00 on 5/7/20 012, and have had 4 monthly withdrawals, 1 for $243.75 and 3 additional withdrawals for $294.26. Leaving a balance of $1398.47, I am willing to pay this balance left on the principle only. Please contact me via email only, to discuss a payment arrangement that we can agree on, I will only entertain a payment arrangement, with the condition that this is removed from my credit report.

I am also revoking authorization for ACH withdrawals and any wage assignment I may have signed. I have given a copy of these revocations to both my bank and my employer. Any future attempts to collect funds in this manner will be blocked.
I demand that any contact be made through US Postal mail or email only. I will need everything in writing to keep accurate records of all communication as per instruction from my state Attorney General's Office.

I prohibit you or your affiliates to contact me via telephone at my place of employment, my home or cell telephone number. I also prohibit you from calling my references listed on my loan.

Glad I can help - This is what I sent out to Great Plains - They are illegal, so they are not really going to follow any laws.. Thank you for all of your help today. You have been a blessing! What does that mean as far as what tactics they can use to come after me since they are illegal? Are they bound by the laws here? Will they be able to threaten and harrass me, my employer and my references? I have written all of the letters and will email or fax in the morning. I have told all of them that I would be willing to pay the principal back, should I offer that since they are not legal companies?

Just reconfirmed that the DD company has been given my new info. Now I just have to have faith that it doesn't get screwed up. Will send letters later this afternoon around 4. I am hopeful after reading a lot of the posts on here that at least half of it will be PIF with no problems. I have no issue with paying back the principal, I just have to do it on my terms and not theirs.

I am sorry about your Mom. I dread the anniversary of my Dad's death every year. I just got home from the bank. The old account is officially closed. I think I will begin sending the letters on Thursday just to be safe. Bank thought so too. She actually said to soften the letter a bit because even though they were illegal, I went to them seeking assistance. She also said they could pass it off to a collection agency that is licensed to do business here. Have any of your illegal, unlicensed lenders reported you to the credit bureaus? I'm still freaking out about all of this.

Copy and paste one of your letters in if you would like me to look at before you send.. They can pass off to collection, that is why from here out you want to stay off the phone with them and have everything via mail or email.. documentation.. The bank made sure that the new account is in no way linked to the old account, and nothing will force it back open, I deal with Chase and had no problem what so ever with the account issue.. I have only had problems with one reporting, I will deal with that when I have my credit cleaned up more... you can easily dispute.. Stop freaking out, relax, breathe and it will all be OK, I can tell you it took me a few weeks to relax... the people on this site were all a tremendous help.. I will be here for you every step, if I don't know something we will find a way to get some help for you from someone else...

I wish the site would let me register!

My accounts aren't linked and the only thing that can force it back open is a check or debit card transaction...all of which have cleared and my debit card has been shut down. My girl at the bank is watching for anything weird. She kept telling me to relax. Easier said than done. I am trying to keep this off my credit because I have been working on repairing it and am making progress believe it or not. I don't want to go backwards if I can help it.

Here is my letter...each is tweaked a bit for the situation...let me know what you think...will start sending these on Thursday.

Dear....

It has come to my attention that payday lenders must be licensed by the Mississippi Department of Banking and Consumer Finance, which you are not and loans may not exceed $500. Therefore, the loan contract that I have with you, according to my state laws, is not enforceable. Although I am not required to do so, I am willing to repay the principal balance of the loan. To date, I have received $700 and have paid you $336 to date. The result of which is a balance due of $364. I am willing to repay the $364 balance. Please contact me via email only, to discuss a payment arrangement that we both can agree on. I am willing to pay the principle amount of the loan only, however, this is only if you provide me with a physical address where I can send payments.

At this time I am revoking any and all ACH authorizations with your company from debiting any of my personal accounts. I have closed my account with the bank to protect my interest in this matter, per instructions from The Mississippi Department of Banking and Consumer Finance. I also revoke any and all wage assignments I may have signed with your company, I no longer authorize you, your company, or your affiliates to attach any part of my wages or contact my employer for your collection purposes. I have notified my employer about this matter so any attempts to do so on your part will be rejected. You are no longer authorized to withdraw payments from my checking account. I have given a copy of these revocations to both my bank and my employer. Any future attempts to collect funds in this manner will be blocked.

I ask that any contact be made through US Postal mail or email only. I will need everything in writing to keep accurate records of all communication as per instruction from my Attorney General's Office.

I prohibit you or your affiliates to contact me via telephone at my place of employment, my home telephone number or my cell phone number. I also prohibit you from calling my references listed on my loan.

I must also inform you that I will be filing complaints with the Better Business Bureau, the Federal Trade Commission, and the Mississippi Attorney General's Office.

I expect a response from your company no later than 5 days from the above date regarding this matter. This response may only come via US Postal mail or email. No telephone contact is permitted.

Please contact me via US Postal mail or email to confirm that you received this letter and are in agreement with terms specified.
