First of all I would like to thank anybody and everybody who has ever posted on these forums in regard to helping others fight payday loan companies. Unfortunatly, I myself have also fell carelessly into this situation. Although I kick myself for getting into this mess, the bottom line is that Payday Loan lenders are working illegaly all across the country. These companies (who are probably well aware of state laws) continue to ignore our state laws and grant us loans with ridiculous rates. I take responsibility for what Ive gotten myself into, but these laws were put in effect to keep individuals like myself from falling so far into payday loan dept. And they were completly disregarded by these companies.

I have spent countless hours over the past weekend reading stories of people who are standing up for themselves and taking on payday lenders. Today I am making a choice to do the same. I am from New Mexico and although payday lending is legal in my state, I was still taken advantage of. First by even being given a loan, second by the ridiculous rates, and third by the crazy phone calls.. Ive done research and i feel like im ready to do this.. what I am asking from everybody is some advice, knowledge, and info you might have that could help me against these lenders. (whether they are legal in my state, who they are, etc..)

Sorry, I am just so upset. Im going to relax and try not to stress anymore. can anyone help me out with a cease and desist order that captures the severity of the moment? all these templates just seem a little to forgiving for what thousands of us have been through.

You letter looks good, try to relax it will get easier... :)

It sounds like you have your bank account secure - make sure you give copies of the ACH revocation letters to your bank and the wage assignment cancellations to your payroll..

Thank you for responding, you dont know how much i appreciate it. As soon as sent it to usfastcash they decided to call me.. almost like they were sending a message.. I hope i made the right choice by taking them on myself.

What is some advice on dealing with the tribal lender? I know they are going to throw all kinds of legal tricks at me. what do i need to say that will show them that I am taking this very serious?
I have every intention to pay back these principls, i really do. But after all the countless hours of research and studying I realize tha theset lenders have really put a strain on my life. they hounded and hounded my work, theyve hounded my family, they made me feel terrible for not being able to pay them, they were not understanding of my situation, I had to take leave from work to change my new account, im waking up at 4am just to check my account because im so paranoid that they have my account number...
the last couple weeks have been rough.. my state law states that a company or any type of entity who issues loans in this state without a license is guilty of a crime, and that all contracts will be void and the lender has no right to obtain any principle, interest or charges whatsoever..

After finding all this information out i have become even more angry with these companies. yes, i messed up, but i didnt hide the truth from thousands of people who had no idea they were being taken advantage of, these laws are in place to protect us. im goingt file as many complaints possible and im not going to pay them.

Your letter looks good. Remember that none of these lenders can actually come after you. Stick to your guns and you will make it through this just fine.

Hello. Thank you for your response. I respect your answer. Can you provide proper documentation to prove that? To prove that you are "not required to have a license in your state, nor are we subject to the laws of your state regarding payday loans." and you also go on to say "State license requirements and other state laws are for payday lenders within the United States who are governed by U.S. state laws."
Bestchoice123 is exempt and above all States Laws? and only in compliance with the United States Law?

The United States of America is built on a “checks and balance” system. There is a possibility, but highly doubtful, that the three branches which make up my government would all agree that a single entity or group like you, would be granted exemption from the laws and statues of each and every states payday loan laws? And if it did somehow go through them, there is no way that it would make it through every single state. Your claim is distasteful and shows absolutly no regard for the United States and its judicial system.



Well FOR THE RECORD… I would like to see proper documentation which states that you, BESTCHOICE123, and/or any offshore associates, are not bound to all states and there payday loan laws. I would especially like to see the State of New Mexicos's involvment.

At this time I am revoking ACH authorization from UsFastCash or any of its affiliates. UsFastCash and and/or any entity affiliated with this company are no longer authorized to withdraw payments from my checking account. I am also revoking any wage assignment I may have signed. I have given a copy of these revocations to both my bank and my employer. Any future attempts to collect funds in this manner will be blocked. I am also revoking any contact with my employer, my contacts provided, and my personal cell phone number. All contact with me will be through email only. Any contact that happens to come through will be logged and recorded, and everything will in violation of Fair Debt Collections Practices Act.

It has come to my knowledge that UsFastCash is not licensed in the state which I reside. My residency is in the State of New Mexico. I do not feel the need to “copy” and “paste” any of my state laws. I am sure you are well aware of my state laws but at your request I will provide them. I was led to believe that UsFastCash was is compliance with §58-15-1 through §58-15-39 of the New Mexico Small Loan Act. You are not licensed in my state and did not give me rates and terms in accordance to my state. The contract is and should be void according to the state I reside. I will report to any company, organization, or media outlet that I have to, to make people aware of this situation.

If you provide documentation of your license in this state, I will fulfill my principle on the loan in accordance to my state law. Any Email you send me will be documented. Tribal “affiliation” will not “intimidate” me out of my rights as a citizen of the United States and under the protection of the State Laws and regulations of New Mexico. I am requesting a detailed response and legal documents in which any evidence might be used against me. I also request the forms and license in which your company operates. If I am not provided any documentation I will turn things over to the proper state department.

It really doesnt matter how they respond....they have no legal power to do anything in the US. It is all a war of words them trying to scare you. They cannot do squat and if you owe them money, you pay on YOUR schedule via money order only. If they dont like it, tough. Legally you owe them nothing!!!!!!!!!!!!!!
