Thanks for all of the information on this forum. You all have given me the courage to end the payday loan nightmare. I live in NJ and have 7 payday loans, and I've overpaid all but 2 of them.they are
Cash call ( originated with western sky) i owe 375.00 toward principal
Cash cure
Cash yes
Golden valley
Castle payday ( i owe 41.00 toward principal)
Plain green
Cash web usa

I have closed my bank account, sent revocations of ACH and wage assignment. I've asked for refunds and paid in full letters for the ones I overpaid. So far I have only heard from Plain green, asking me to call them. That's not going to happen.

I'm also having an issue with eastside lenders. I never applied with them, but they called me about a month ago saying my loan had been funded. I called them and said I hadn't applied and didnt want the loan. I was told that the money had already been sent to my account, but they would debit it the next day and not charge any fees. About a week ago they started calling and sending me emails saying the ACH had been returned for insufficient funds. I called and told them i had never received any funds and didn't have a loan with them. They emailed me the contract. The bank account that they claim to have deposited the funds in is at the Armed Forces Bank in Missouri. I told them that isn't my bank account, they screwed up, and it isn't my problem. They continued to harass me so I filed complaints with the BBB, FTC and the attorney general in both NJ and DE. After that I havent heard anymore from them but I'm not sure this is going away for good. Has anyone had something like this happen?

So far, 4 of my lenders sent me Paid in full emails! Those lenders are Cash cure, cashwebusa, golden valley and cash yes. Golden valley agreed to send me a refund check. Plain green and castle pay day have ignored my emails, but both did try to hit my bank account. Plain green started calling today, but I 'm not answering. Cash call/ western sky sent me the usual tribal law BS response. And east side lenders, who I never had a loan with, is also calling incessantly. I hope they give up soon. I sent a complaint against cash call to the NJ AG. I hope they will do something.

Cash webusa sent me this reply - do you think their argument is valid?

CashWebUSA is licensed to operate in Costa Rica, and does not operate or advertise within the physical boundaries of your state. Further, CashWebUSA does not carry on any business, have any facilities, or employ staff anywhere in your state of residence, and your loan agreement makes it clear that Costa Rica law applies to the terms of our agreement. Additionally, the US Federal Courts are rejecting attempts by states to regulate conduct that occurs outside of their respective borders, including efforts to regulate activity based upon the operation of a website alone. For example, in Quik Payday, Inc v. Stork, 549 F.3d 1302 (10th Cir. 2008), the Tenth Circuit noted "merely maintaining a website accessible in [a State] that advertised payday loans is not solicitation in [such State]." Additionally, the US Court of Appeals for the Seventh Circuit in Midwest Title Loans, Inc. v Mills, 593 F.3d 660 (7th Cr. 2010) invalidated a state's attempt to apply it's laws to loans obtained by resident consumers from lenders operating in a different state. The court reasoned, " the Commerce Clause protects against inconsistent legislation arising from the projection of one state regulatory regime into the jurisdiction of another State." Thus, applying your state's laws and regulations to this transaction is not a valid position.
Despite this fact and in order to maintain customer satisfaction - our most important goal here at CashWebUSA.com - I had our Account Review team review your account with us as well as your email. The following is their response:

Loan # XXXXXXX
Principal Due = $700.00

After examination of her account and taking into consideration her willingness to cooperate with us on this matter, we will agree to settle her account as paid in full. Our primary reason for making this goodwill adjustment - and please convey this to Ms. B - is that we feel that taking a cooperative stance will show her that we have valued her as a customer of CashWebUSA.

Please let us know once Ms. B has received this information and has responded and accepted our offer to settle the account.

their assertion is wrong and they know it.are you due a refund?if so it is up to you how to proceed, but if you are satisfied then keep that PIF as this and every other offshore pdl is not to be trusted at all.
