I'm thrilled to find this site and hope you can help. I have the following loans in TX:

Cash Central (legal in TX)
Speedy Cash (legal in TX)
Check n Go (legal in TX)

Not sure if these are legal:
Boulevard Cash
Target Cash
Golden Valley
Cash Web

I have made payment arrangements with Check n Go and will pay that one off next pay period. The others I have not yet contacted. It was my experience in working with Check n Go that they did not set up an arrangement until my payment was declined. Then, they were very nice about setting it up and allowed me to set the amount. I had to change the amount one pay period and they were also very nice about that. So, they were very good to work with.

For the illegal ones, I'm considering closing the account. The bank account from which funds are drawn is in Kansas. Does this change anything for closing the account?

For 2 of the lenders above, I've only made one payment. For the others I've paid the loan principal many times over...

Golden Valley - Could not find a website, pretty sure they are illegal as well

Speedy Cash and Cash Central are both CFSA member lenders. You can call them and ask for the EPP. If the local office gives you the runaround, contact their corporate office. Once you are approved for the EPP, the interest accrual on your loan balance is going to be frozen and the remaining balance of the loan is going to be spread over 2-5 pay periods. That might ease your situation.

Thanks for the replies. I'll follow the instructions and check back to let you know.

I spoke with Speedy Cash last night. Very helpful and nice. So far, the 'legal' ones have been very amenable and easy to work out payment arrangements. I'm guessing that the illegal ones may not be so pleasant...

If I revoke ACH transactions, am I revoking a specific dollar amount or can I revoke all ACH txns from a specific company?

I just heard back from them today and they said I will receive a refund check within 10 days. I had overpaid the principal by a few hundred. I'll believe it when I see it but they were pretty easy to deal with.

Great news - remember when you get the refund check do not cash at your bank or deposit directly into your account. Take it some where like a check cashing place and cash it..

I made a payment arrangement with them to pay the balance, as they are a legal lender in Texas. They reported me for a bad check to the Check Cashing database (Synergy?). I was told it would remain an outstanding bad check until the loan was paid in full and then would be removed.

I don't know if this is normal practice in Texas, but this is what occurred with Check n Go.

I sent letters to my illegal creditors, one of which is Target Cash Now. They responded that they were an Indian Nation and under federal, not state laws. Is this true?

They offered to have me pay the full principal. I've paid $180 in interest, which they did not deduct. Should I push back and get them to accept the offer of principal minus interest?

Not sure on the bad check thing - it may be their policy.. make sure they remove - did you give them a check? If not, I would maybe argue a little with them to remove now.

On Target Cash Now - not they still need to follow state laws, but they will try to get to however they can. I would push to have the money you have already paid removed from what you originally borrowed? If they don't agree they don't get anything until they do would be my response.

I did not write them a check. It was all ACH debits from my account. Today I got a letter that they were sending to an outside collections agency for the $250 I still owe. I had already set up a pay arrangement for this to be completed in 2 payments. They got VERY agressive, very quick!

Here's what I got from them. They say I'm incorrect (and note South Carolina judgements - but I'm in Texas) and then say they will mark my account paid in full. They actually owe me money, but I'll be happy to call it even:

Courts in the State of South Carolina recognize and enforce choice of law provisions such as the one that is included in your loan agreement with us. Thus, your statement concerning "permissibility" of this loan in your state are simply incorrect.
As a courtesy, and with no obligation to do so, we will mark your loan paid in full and as final settlement of your dispute with us. However, you will not be able to access Boulevard Cash's services in the future.

Just for the record - Chase was very good to work with and handled everything just as requested. Commerce Bank was prickly at first, but then did come around and they too handled all well and denied all ACH debits from my account and it is now locked/closed.

It took several phone calls and some persistence on Commerce (a smaller bank than Chase). But, the advice here was correct and when I stuck with it, they did comply.

Thanks for all the great help. Just waiting to hear from a couple more of the illegal lenders. After my push back to Target Cash, they did not respond further. I still owe them a couple of hundred dollars but will not pay unless they agree to deduct what I have already paid, per your suggestion.

Will work out pay arrangement with Cash Central and Speedy Pay. Already spoke with Speedy Pay, just have Cash Central left to call. It's so great to have a way out of this! Never again!

But, it was really funny that I was so 'incorrect' and yet they were willing to mark my account as paid in full.

This lender is not licensed in Texas. I sent the letter, per directions here, as I did to all my other illegal lenders. It has been over 2 weeks and they have not responded.

Is this common? Do I just leave it alone?

I have a payday loan with Bestchoice123 and have sent them the letter to stop ACH and that I am willing to pay the balance to cover the principal loan. They shot back that they are willing to work with me but that their loans are not governed by any state or federal laws as they are off shore.....is this accurate? I suspect not and want some help here! Thanks!
