Hi everyone,

I've been searching this website for the past year and have collected valuable information so I first want to start by thanking everyone that has made letters and templates and answered questions about how to handle these loans. You've all helped me more than you'll know! My stress level is finally returning to normal. THANK YOU!

I've gotten PIF letters from Plain Green, Great Plains and Fast Efunds. I had paid the principal so they where all very easy, just took one email for all 3. I also had a $2000 loan thru My Cash Now/Credit Protection Depot, defaulted and used the template for cease and desist and revoke all my ACH withdrawals. They at first were a pain to deal switch but they eventually agreed to let me pay the principal back with my terms and I make small monthly payments. They were not as bad as some off the horror stories I've heard.

This week , I sent out the ACH/ C&D letters to Magnum Cash Advance, Cash-installment and 123 Cash Depot. I heard back from Magnum and they gave no fight and agreed to let me pay the principal in 2 monthly installments which I suggested. I've sent 4 emails and faxed over my letters to 123 Cash Depot and Cash-Installment and neither one has responded and nothing has changed on my account. I live in Michigan and I've done through research and none of these loans are legal. I've overpaid 123 Cash Depot and owe roughly $115 to cash-installment which I to,d them I would pay on April 25th. Since its been a week and both are due to debit next Thursday, should I call them and ask the status? Every other company has gotten back to me with emails. Also, neither loan is in default. If I can settle these last 2 I only have 2 store front loans which are legal and the dreaded Western Sky/Cash Call which I've already overpaid by $1000.

Has anyone had any luck with Western Sky/Cash Call? I mean luck with getting a PIF if you've really overpaid!

Thanks again for any advice!

I will read right now, Thanks!! About the other 2 companies that haven't contacted me, do you think I should call and discuss my account with them?

No - best to stay off the phone with them - email or mail only - you want things in writing..Some just take longer to respond than others - And the ones you are concerned about you revoked their ACH authorizations and made sure the bank has copies correct.. Did you close your old bank account and open a new one?

I gave the companies ACH revocation but not my bank. I guess I should go give it to them. I can not close my bank account right now because I am going on vacation and my work needs a month to change my direct deposit and I don't have enough time but I will when I get back. Do you think letting my bank know will be enough? I know I should've done this earlier, but I really am stuck right now with my bank account.

yes you must provide copies to your bank.. and the only way to secure your money is to close your account.. Your work can't issue you a paper check?

They can issue a paper check but I will not be in town when they do and I need the money for my vacation. It's my own fault I should've closed the account earlier. I'll speak with my bank and see what they say. I'm just mad at myself for not taking care of this earlier.

See if possibly they can put on deposit only - go ahead and open new - move as much to it as can before go on vacation..and then the person that is helping you with all can transfer the direct deposit when it comes into the old one.. that is what they did for me.. that way the lenders can't get to your account if they try.. and you will be able to enjoy your vacation..

One last question to see what you think. I have an old checking account that I never use and have no problem closing that account, what if I called those last 2 loan companies and changed my banking info and then closed that account. Do you think that would work?

So I finally heard back from 123 Cash Depot. This is the lender i have paid the principal back on plus an extra $44. Here is what the wrote:

Thank you for contacting us regarding your account. Unfortunately there isn't much more that we can do for your account since you have revoked authorization to debit your account, however I would like to let you know that we are in fact able to lend to residents in Michigan and because there is still a remaining balance of $364.00 on your account and we are unable to collect on this loan we will be reporting your account and remaining balance to our 3rd Party Collections Agency, Capture Financial. You can reach them at 866-201-3014 or by email at service@capturefinancial.com. If there is anything else you need from us or would like to settle this account with us please get in touch with me directly at 302-525-0101 or feel free to email me here.

I called my states payday loan license office. 123 Cash Depot does not have a valid license. I sent them this illegal loan company an email back telling them to give me proof they hold a valid license and also asked since the stated they were able to loan in Michigan why are the not charging the right fees. I also made complaints with the FTC, my AG and the BBB and told them if they provide me with a valid license I will be filling another complaint with the state of Michigan for violating those laws. Just can't wait to see what lies they come up with!!!

Here is their reply back to my email:

Thank you again for contacting us again. As mentioned in the last email your account will not be debited anymore and is closed on our end however it is not paid off and will be out of our hands.

Thank you,
Gregory Delva

Any suggestions on what to do next?

I'm really torn if I should wait or not. I think I'll be proactive and email and fax all my C&D and validation letters. This is the first company to give me trouble!!
