Illegal Loans in CA
Date: Thu, 04/25/2013 - 14:38
CastlePayday- $975 borrowed - 0 paid
Great Plains - $1,000 borrowed - $535 paid
Plain Green - $1,000 borrowed - $1,500 paid in full
Plain Green - $1,400 borrowed - 0 paid
I only took out the CastlePayday to pay off the first Plain Green hoping to then borrow enough again to pay off all loans and only have one at a lower monthly rate. It didn't work out that way and only got me deeper in trouble.
I am unable to close my account right now because it is negative and I have deposits coming in and a few legitimate payments that will need to come out once I have the deposists in. I bank with Chase.
I sent the ACH revocation to CastlePayday. They have not responded. I sent it to my bank as well and told them I was revoking the ACH per Reg E and Federal Law. They said I needed to handle things their way and that was through a stopped payment. I need to email them back and say that is not acceptable, further ACH's are not authorized, and I will report them if they do not follow the federal law. I do not want to go into a branch because my account is so negative.
I am not sure if I should do the same with Great Plains and Plain Green right now. It is really hard to lose that money but honestly this may sound stupid but what if there is an emergency and one of them is my only option again? I can afford the $125 - $145 every paycheck to borrow the money if I really had to in an emergency and hopefully pay it off early because the total payback amount is rediculous.
My credit score is bad and my current 2 credit cards are maxed out. I have no savings. This all happened because I am still trying to get back on my feet from being laid off and out of work a year and a half ago and then finally getting a lower paying job.
I also have 3 legitimate payday loans that are legal and I have been put on an EPP for all 3.
I really need some advice on what I should do going forward with all of my concerns.
CastlePayday- $975 borrowed -
I would send the letter to all of them including Great Plains and Plain Green. You need to get them all out of your account. I would talk to the bank and tell them the account needs to be put on hard block for deposit only -that way these can not continue to make things worse while you are getting out of the hole you are already in.
CastlePayday- $975 borrowed - 0 paid - You owe prinicpal only - set up on your own terms
Great Plains - $1,000 borrowed - $535 paid You owe $465 - set up on your own terms
Plain Green - $1,000 borrowed - $1,500 paid in full
Plain Green - $1,400 borrowed - 0 paid I would apply what paid before to this and you owe $900 - set up on your own terms
All of these are tribal illegal loans - follow this link on how to deal with - http://www.debtconsolidationcare.com/paydayloan/dealingwith-illegallenders.html
You cannot send your bank
You cannot send your bank anything...you need to go in with the copies of the ACH revocation. No, you do not need to pay for stop payments...it is your legal right to revoke ACH's.
Do you know if Chase allows
Do you know if Chase allows hard blocks? Would I still be able to withdawal money and make payments that I need to? What exactly would be blocked?
Chase does allow hard blocks
Chase does allow hard blocks for deposit only - I did one back in Oct when I got started with this - I explained that my account was compromised and I was revoking all ACH authorizations and that I needed my account blocked so we could get the new one open and get Direct Deposits rerouted etc... .. I would recommend opening a new account not linked in any way to the old one. get the old one out of the hole and transfer all other funds to the new account - the manager at the bank will be able to help you.
That sounds good while it was
That sounds good while it was blocked and I was opening the new account would checks still be honored? Would I be able to pull money out or use my debit card? Does it only block electronic transfers? Sorry for all the questions but this site has been so helpful. Before this site I didn't even know I could de an EPP for the legitimate loans. That has helped so much.
The only checks that they
The only checks that they would allow through when I did mine was ones that I had told them were already out.. All else blocked basically you are freezing the account for time to get the other open and all moved over- that is why I would open the new one to use for all other things. I would recommend you using the online bill pay where can so that you are not providing your bank info to anyone. How negative is the current one if you don't mind?
Right now it is $900 negative
Right now it is $900 negative due to all of this. But I have some money coming in tomorrow, probably $4-500, and my paycheck directly deposited next Tuesday. Also my second job will be doing a direct deposit on May 10th.
I need to write a check for daycare tomorrow that will clear next Tuesday. I also have my life insurance and car insurance which usually comes out through ACH between around the 7th and 12th of each month.
I will need to make my car payment and cell phone payment on Tuesday when I get paid (hopefully keeping my whole check) and those need to be paid online through their websites.
2 of the legal payday lenders I am on an EPP with are suppose to debit the payments straight from my account. The third I control the payment.
The other things I have that come out directly are a payments for a website I run and Netflix. That is all I can think of right now.
I have had this account for 10 years, since it was with Washington Mutual, it is linked to a joint checking account with my wife which has 90 cents in it right now.
I would settle up the $900
I would settle up the $900 and move all other to a new account right away... With the hard block your DD will come in and can be moved over to the new acct. Your DD on the 10th should be able to reroute to the new acct with no problem, that is like 2 weeks away...
You could pay cash for the Daycare - I sure they would understand if you told them that you were a victim of fraud..
I am sure you can pay the life insurance and car insurance another way than ACH or have them ACH the new acct.. they do not have to be set up on direct debit..
Car Payment and Cell phone can be done from the new acct.
Legal lenders are going to be open - they will not only allow ACH you can pay other ways..
and you can move all others to other acct.. it really is just a matter of doing it... ! Realy it is about locking these people out of your money and controlling what you are doing how!
And when you open the new acct make sure not tied to the old or your wife acct.. Matter of a fact I would shut down hers also and open her a new one if it was tied to your old acct..
This morning I sent emails to
This morning I sent emails to all of the lenders revoking their rights. I was able to get my account positive and I then went into the bank and explained everything. They opened a new account for me and put a freeze on my old account for fraud. They said it will be frozen for 10 days and them automatically close allowing me to set up all of my direct deposits. I am a little worried that somehow the lenders would still be able to overdraw my old account, but hopefully I will have enough to then file a claim with the bank and have the money refunded. Any suggestions on how I can further protect my bank?
It is strange but it feels like a huge weight has been lifted to do this. This forum has been a huge help.
Trust me if Chase froze the
Trust me if Chase froze the old account for 10 days only -- nothing will get through.. I had no problems, make sure you have all ACH authorizations sent out and I would provide copies to the bank - if they do allow any to hit - the bank becomes liable to refund you the money.. they will not allow that to happen.. :)
I no longer give my account info out to anyone - if you have to use auto debit do it with your debit card easier to shut down and reverse.. and I so most of all of my bills through Chase Bill pay now, because when a check is issued out of your account - if doesn't show your account info at all.
I am so glad we could help you!! keep us posted. And if you have not done so register with the forums - you can earn money just for making post and helping others.
