Hi,

I was reading the advice given about how to find out if your PDL are illegal. Payless called me today and I signed up with them and they are scheduled to take their payment on 5/8/13. I see where it says that this is something I could do myself. Well I called Bank of America and they said they can do a stop payment for the specific amount -but that I could not issue a revocation of an ACH authorization-only the company can do that. With that said-here is the information requested.

I am in the state of New York.

I have multiple lenders:

Mobiloans - $1,250.00 - I've made a lot of payments-but then takes the cash back out until my balance is still $1,250.00

Great Plains -$800.00 paid $255.74

SilverCloudFinancial DBA USAMoneyShop - originally I borrowed $600.00 and had paid $750.00 when I was offered $1,000 to pay off the balance of the first $600.00 which they determined was $546.42. Since I've had the $1,000.00 I have paid $175.00

White Hills Cash -$400.00 paid $662

Can you tell me if these lenders are even legal and if they are illegal how should I proceed? Also I found all of these online. I am planning to open a new account tomorrow at a new bank-I've been wanting to go with a new bank anyway.

If you have not spent the loan from Payless return as unauthorized.

Mobiloans - Tribal - You borrowed $1250.00 how much paid to date in total?

Great Plains - Tribal - You owe - $544.26 - tell them in your terms how you will repay.

Silver Cloud - Tribal - Borrowed total of $1600 - paid $925 - owe $675.00 tell them in your terms how you will repay

White Hills - Tribal - they owe you a refund of $262.00

You still need to the revocations of ACH authorization and the sooner you can shut down the BofA account the better.. They are completely wrong - you have every right to revoke ACH authorization it is a federal regulation in the banking industry that they have to follow.. Don't talk to a teller - talk to a manager!

Thank you so much for getting back to me. I'm just going to close the account. Payless didn't over me a loan they offered to find out if they were legal or not and are charging me $198.00 for that. But I suspect they knew along that its illegal in my state.

My husband has a loan with OneClickCash-I actually have to look up the amounts in my statements so that you can tell me if we overpaid. I suspect he did. However we already repaid the complete first loan and now this is his second OneClickCash-what are the chances of getting a refund on the first loan?

One Click Cash - also tribal Treat the same way as the others. You still want to revoke the ACH authorizations.. with all of them - and keep copies - I would still give to the bank also.. Tell us how much borrowed on both and the total paid back on each - we can figure out how to address from there! Will more than likely apply what overpaid on the first to the current bal - and then see what if any is still owed.. and you will ask for refunds - I would not hold my breath there - but getting the PIF's is what it is all about...

They charged you $198 to do what?? How did you pay them? I would dispute that...

Let us know if you need any help.. When you close down the account and you open a new one make sure linked in no way to the old one... and like I said I would still do the ACH revoke and wage assignment cancellation letters. To protect you!! They can be emailed straight to them from their own websites.

No problem, the lenders and then you give a copy to the bank - that way if after you have done the bank allows one to go through - they are liable, You still want to close the account and open a new one not linked in any way to the old.. The ACH Revocation and Wage assignment cancellation is to alert the lenders that you know they are illegal - not licensed to lend in NY where all Payday loans are prohibited.. not to mention I am sure the are in violation of the interest rate cap on small loans of 25% per annum.

Let me just say that you are AMAZING!!!! I have to say my situation wasn't as bad as some of the others I was reading, but it was almost there until you helped me. It wasn't until I went to gather the information you requested that I realized how much we (my husband and I) were paying. Oh my goodness-I cannot thank you enough.

Mobiloans: I received altogether $1,737.82 and I have paid altogether $1,606.60.

OneClickCash: Altogether we received $650.00 and have paid $775.00

Also I have a confession-before I found out this website-which was literally this afternoon-we had another loan with Cash Taxi for $195.00 to get us through because we were broke from the paycheck that just passed because we paid everybody off. So they want $239.82 for that but I will pay them the $195.00.

So I guess I can figure out that OneClickCash owes us and we have a small balance with Mobiloans. I will definitely register with the forum. Thank you so much for you help.

Cash Taxi - Definitely illegal - offshore they are in Malta... So yes treat them the same way...

Weird amount from Mobiloans - did they charge you some kind of fee upfront? if not then you owe them like $131.22 - You are in control of how you repay and only via mail via money order - never give them your account info again.
Looks like one click owes you $125 refund - push for the PIF!
