wage assignment

According to Illinois state
According to Illinois state law, a wage assignment must be signed in person "with written instrument"....well all of these internet payday loans would not have my signature, only typed name...so my employer can't accept without my signature right?? (Since they are fighting me...I'm trying to find loop holes to show them in the law! ) so frustrating!!

This would be a whole lot smoother and less stressful on me if my payroll department was more helpful and knowledgeable about the law!!!
Wage assignment is voluntary
Wage assignment is voluntary - you can cancel at any time - who the hell do you work for that doesn't know that in payroll. Your payroll is only allowed to garnish your pay with out your authorization if The lender goes to court and gets a judgement against you.. You can't stop a garnishment with out an attorney..
I know...I'm so very stressed
I know...I'm so very stressed out about thus! I even printed out the law and gave it to them, but again was told to get a lawyer because they can't tell if I'm "lying" or not....I work for a hospital...she said she gets 100s of wage assignments monthly and sends them all through because she can't tell if they shouldn't be..."there's too many to investigate all of them" I'm so sick and not sleeping over this...just wish I can do something!!!!!
If they allow a wage
If they allow a wage assignment to go through that you have cancelled in writing and provided them with proof that you have cancelled it - they are making themselves liable. You can sue them.. The supervisor has to report to someone, I would ask to talk to that person - you are not talking about a wage garnishment! I seriously doubt that she gets 100's of wage assignments monthly - it seems she is confused by the terminology or just doesn't know what she is talking about at all.. You do not need a lawyer to cancel a wage assignment at all - you merely have to put it in writing that you are cancelling and provide to the party in question - which you have done..

That is correct, plus you have presented them with your cancellations.. Like I said I would ask to speak to the supervisors supervisor.. It will be Okay, stop stressing so much... I am pretty sure that she is talking about garnishments and is just confused on the terminology - but she should be educated on the difference.. that is why I suggest taking it up the chain. :)
And to her comment about their being too many to check them - that is their freaking job.. they should never allow one to go through that is not valid..
And since you have been checking out the laws on wage assignment you have to be notified and you have time to dispute. so again stop stressing.

You can do CMRRR or you could try faxing them first.. if it will make you feel better - a fax will show delivery right away.. This would be cheaper if not free... this way you will get a confirmation back right away that they received the fax... This may help you feel better... :)

Since I haven't heard from castle payday, payday max, bottom dollar payday or cash taxi yet should I send certified letters to them with signature request? That way I know they got it. I just sent emails twice. Or should I let it be?
