Hello all,

I am in TX - here we go:

ideal gelt - original loan $500, paid $620, balance $450
Ashland - $300, paid $360
Hydrafund ii - $250, paid $75
Spotloan, $600, paid $330.78 - installment loan
Northcash $400, paid $120
Anasazi Group, $200, paid $180
Sandpoint, $300, paid $180
Twinbluffs, $300, paid $180
Whitehills $400, paid $240
castle payday $200, paid $50
Goldline, $150, paid $60, balance is $135 in principal
Westriver$200, paid $60
greatPlains - Balance is $424.01, 6 payments remaining on $500 loan
Checkngo $850, no payments yet, online not in store
Ace Cash Express - they just rolled over my online loan to installment loan, have to find balance
Advance America - $850 , store front


I look at this and can't believe I am in this mess. So, I have already hard blocked my account, which is in the negative $700. opened new account on Friday. I have 30 days to pay the overdraft on the old before they touch the new. I have to go in every 7 days to keep the block on it as it is only good for 7days per the new bank regulations. We have to keep open as our income tax is being DD to the old Account, so they are allowing deposits only. And I already called the IRS and they claim they can't change the account. The overdraft is priority as my bank has been awesome to work with. I know most of these are illegal, but I still owe principal. That being said, they cannot garnish wages in TX as TX is a non garnishment state except for child support and IRS. What is my next step? next payments come out on 1st of May.....


Well you sound like you have not read the illegal pdl primer...it is in my signature line. You dont have to do a hard block....you do an ACH revocation. You signed a wage assignment, which you can revoke as it is voluntary. Read the instructions and follow them.

And no...the IRS cannot change an account number once the taxes are filed.

Well actually, my bank said the only way to guarantee they can't touch our account was to put a block on it. This will keep us from being charged overdraft fees if they run them back through. Our banker said that most of the PDLs will ignore the ACHrevocation and run them through under different names. When I went in she didn't even want the ACH revocations, they are blocking it and opened us a new one.

Also I know most are illegal and what to do on those, but are any legal outside of Advance America?

That is what my bank said also - the best way to keep them out of the account is to close the account and open a new one not linked in any way to the old. which is explained in the link SOAPLADY is telling you to read - in her signature line above and in mine below..

From a quick look at your list - Check n Go & Ace Cash Express are legal lenders as well as Advance America - later I will look at more to see if any others... but I don't believe so... Online lenders have to be licensed to lend in Texas to do loans you can look up here.. Texas Office of Consumer Credit Commissioner - http://www.occc.state.tx.us/

Okay, help first response back from Whitehills. How do I respond now? I owe them $160 in principal, they are wanting the full $520.

Blah blah is what they are saying - remind them that you live in TX not on their Indian reservation and the state of TX states that in order for them to lend to one of their residents they have to be licensed to lend in TX... You are willing to pay the remaining $160 that is owed on principal only and when you want to pay and that you will pay money order only via US mail... When and only when they agree to you send them anything - if they don't agree to what you are telling them they get nothing...


I did find it entertaining that White Hills Cash. Island Finance, LLC is a Native American owned business created by and for the Ft. Belknap Indian community, a Sovereign American Indian tribe. Our business is operated on the Ft. Belknap Reservation located in Montana - but they have a mailing address in FL....LOL

Probably a mail drop, A lot of these online PDL's have them. When I was paying Cash Today, which is in London, I had to send my money orders to a Reno address, so it's probably the same thing.

Hell, I am surprised they agreed to the ACH revocation, even though I really don't even need it, since the bank is working with me on the block. One down, many to go :) I responded, we'll see what I get back. I am sure my phone/email will be blowing up tomorrow. The only ones I am worried about are the legal ones as I need more than a month to pay those off....we will see when I call tomorrow what they say...

Just remember to stay off the phone with them the illegal ones.. block numbers when can..

I would guess the legal ones may be easier than you think.. they may have to have you go into collection to work out a payment plan - or they may just offer an extended payment plan.. some times those are kind of tough to do due to the amounts. Good Luck - will look for update soon! :)

Dear Tribal Lender

Please cut the Tribal Law crap. You know as well as I do that the only laws I am subject to are the laws of MY state of Texas. I do not live on your reservation and as such the contract I signed is null and void. Legally I owe you nothing. Morally I will finish repaying the principal balance I owe. You are within your legal right to send me to collection. However I will us my legal rights to cease and desist any collection agency collecting on this debt. Should they choose to violate federal law, I will be happy to pursue them for statutory damages.
Govern yourself accordingly.

We respect a consumer who researches the services he/she uses. With that being
said when you applied for and agreed to the terms of the loan, it would have
behooved you to read the complete contract you were agreeing to with The Anasazi
Group. You may be a citizen of TX, however the contract was not made in TX but
via the world wide web, the governing law (clearly outlined in your contract)
which you agreed to by entering your electronic signature and when you spoke
with Myesha on 3/5/2012 are the laws of the jurisdiction in which the lender is
located.

That said, after reviewing your account and without having to do so the lender
has agreed to accept the principal balance minus the fees that have been
collected to date, that leaves an unpaid balance of $20. Please note that
settling the account in this way has set you to a denied status for any future
lending. I have copied the instructions below to allow you to send in the
payment via Money order.

We are set to do 1 money orders/cashier check @ $20. Please make it payable to
Anasazi Group LLC. After it has been filled out and signed, please make a photo
copy of the money order with your full name and customer number 156178.

Then fax the photo-copy by the end of the day on 5/3/2013. Please fax the copy
to 1-888-519-2164. A call to confirm that it was received would be appreciated.
Once you know the copy has been received, Please mail the money order the same
day to

Dear Anazi group...

Cut the crap. You know as well as I do that the only laws applicable to me are the laws of MY state so you will have to abide by MY state laws. I will send the $20 at MY convienience, not yours. And there is absolutely nothing you can do about it. And I am hereby revoking any and all ACH priveleges. A copy of this revocation will be given to my bank so debiting my account will only cost YOU money.

I know right? :) And to Soaplady, actually they were agreeing to my terms. I told them in my original email I would send the $20 money order on 5/3, so we are good there. Twinbluffs just responded that they want their $120 in one payment on 5/15 or they are going to ACH the account instead of what i setup as a payment plan. About to respond to that cause um no, I will pay you what I can when.....

Other note, I did get a EPP with Check n go. They are legal and although it is going to be tight, I think we can handle it to get than one gone. Unfortunately they will not take a money order, they want a prepaid card if we don't have a bank account. I can do this if necessary, but has anyone had any luck with a legal lender accepting money orders? I just want it done and gone.

Ok, question for the experts. I setup an EPP with Check n Go, I still have Advance America left. However, i realized if I do an EPP with them, there is no way I can pay both EPP's every paycheck. What is my best option here? Oh and note, I called ACE and since it isn't a "payday" loan it is an installment loan, I have to let it default first, then they will setup payment arrangements..... Help?

Call Advance America first see what they offer - it may be better to let all go to collection - if you call them and tell them that you need to have them go to collection and what you can do when and work it out, it is better than just defaulting.. And Ace is OK to work with they will work with you, it just has to be in collection to set up a payment arrangement..

Have you been dealing with store level or corp.. I would suggest corp.. have a plan you can do on all three and call them and say this is what I need to do - I want to pay but can only do this and see what they say - both may have to compromise a little but I bet you get it worked out to something you can live with..

ACE is online. Advance America is a storefront and is the only Store Front. I haven't called yet. I know they are going to offer the EPP, but in TX it is 4 payments only and since I did the one with Check n Go, I can't do both.

Like I said they may need to force to collection to offer a more favorable payment plan,. and Ace is online but they have a corp number -- Here is the link to their contact page - https://www.acecashexpress.com/contact-us - you can always start with contacting them directly and telling them that you need to work out a payment arrangement.. I dealt with ACE myself.. they don't bite it will be OK! And it is 4 payment everywhere for EPP's from what I have seen.. I worked out with Ace and Cash one with no problem, what would work for me.. You won't know til you try. Just tell them you want to pay but the EPP is too tight to do. they don't have to know you have other loans - but you do have bills to pay that are more important..

UPDATE - Hydrafund sent to united collections and I settled for $167 (I owed $175) on principal.

CWB Services which handles Ashland, Sandpoint, and Twinbluffs has sent to National Credit Adjusters. The idiots just got through to me at work and I got the call not realizing. Long Story short, they are threatening to sue and saying that I broke the law by signing an illegal contract. The won't settle for principal owed after payments, they want full payment. I gave up arguing and hung upon them.

Send NCA a cease and desist letter pointing out that they are knowingly trying to collect on illegal payday loans. They have been sued in several states over this same thing. Unfortunately our lovely state of Texas does not protect us consumers so not in Texas. They are bluffing and you can bluff them right back. Make sure to fax the letter with confirmation and send via CMRRR so that it is binding. Then keep a log of any calls you receive from them -- if you can catch them breaking the C&D you can pop them for a FDCPA violation, which they are known to do. The only ones you need to worry about are the legal ones as they will turn them over to collection agencies and they will find their way onto your credit report. There is only one illegal lender that I know of (and you don't have a loan through them) that reports on credit reports. Good luck!

here's the thing, NCA hasn't sent me anything to respond to. All I got were emails from Ashland and Twinbluffs that they sent it to NCA, they wouldn't respond to my settlement emails. I didn't even get their number since it was accidentally transferred to me at work. Will be interesting if they continue. since I do have their address, thinking of sending a C&D leered to them anyway....

tell everyone especially your boss that this is a scam outfit calling.th sooner you hang up once you know it's them the sooner they will get the hint.bottomline do not engage them on the phone.you overpaid your loan and if all they want do is harrass and argue over the phone they can piss off.
