Help with QXL Online
Date: Tue, 04/30/2013 - 11:01
I contacted QXL Online about my account, using the suggested lender letter. Here is their response:
-Please refer to your copy of the Loan Agreement - the loan was not funded from, nor are we located in, the State of Maryland. Under the terms of the Agreement you agreed to make payments by ACH until the loan balance was satisfied in full, in accordance with that contract. If necessary, we will make all reasonable attempts to make contact with you to organize and obtain payment of all amounts due and payable to enable the loan agreement to be satisfied, as per the original terms. Thanks, Customer Service
I told them that while they are not located in MD, I am. Here is their response:
-If you have breached your State laws by requesting and taking a loan from us - we did not solicit your business - that is out of our control and as such falls on you. We meet all relevant Laws and Financial Regulations that apply to Us and the loans we provide. Customer Service
I replied that while they did not solicit me, they did provide a loan, which is not prohibited in my state. I also requested their mailing address. This is their response:
-As per the loan contract and we do not and will not provide a mailing address - nor are we required to. We are fully compliant with the relevant local laws that govern the loan and the loan contract. Customer Service
Please help me with how to proceed.
Dear QXL..
Dear QXL..
Cut the crap....you are the ones in violation of my state laws, not me. You are well aware that you do not hold a Maryland license and that payday loans are prohibited in my state, thus rendering the contract null and void. Legally I owe you nothing...morally I will repay the principal only ON MY TERMS. You will provide a mailing address and I will mail money orders at my convenience. No mailing address, no money.
Govern yourself accordingly
Guess they didn't like that....
Well I sent them the message and now I am locked out of my account and can't access the website.
What now??
WELL
how much was borrowed and how much was debited prior to you closng your account?btw it is up to them to comply with your state law in which in MD pdl's are prohibited.contact your DFI(dept of financial institutions.from what i understand they take this seriously and will fight for you.as for you being locked out.that is what illegals do when someone gets wise.don't sweat it.
Did you close your bank account?
When you sent out the ACH revoke letter you didn't secure your bank account? You should have given copies of the ACH revoke to the bank - did you?
Also are you sure loan is with QXL Online - as posted in another thread that you posted in here is my reply from there - I would check your bank statement and make sure that they are the ones taking payments out of your account.
They are a loan broker, you apply with them and they mass send all of you personal and banking information out to every PDL in the world... They don't loan directly from what I see on their website.. "QXL Online does not solicit customers directly nor does this website take direct applications. All applicants are received through affiliates, reviewed and offered a loan subject to contract and final underwriting approval. This offer does not guarantee final approval." " This is not a lender, This site show the best fast loan lender reviews for payday loan If you finding for payday loan and want to get fast loan from payday loan you come to the good place! Search results of payday loan you can find $1000 lenders from this site."
Reading through past post here on the forums states they are out of Pakistan - I am trying to locate an address for them now. I have found that the address reported in 2010 is a dead address..
I borrowed $250 and the
I borrowed $250 and the finance fee was $95. I just paid the $95 on 4/30 and they just processed $250 today.
Bank records show QXL Online
Bank records show ACH from QXL Online. Not sure who the loan is through, but this is what shows up on my statements.
I did notify my bank, through
I did notify my bank, through online message and have not had a chance to go there in person. I had planned to go today. I didn't think they would deduct the remaining balance this quickly.
OK, still when you sent out
OK, still when you sent out the letter to revoke ACH did you give copies to the bank, this will help you if the bank allowed the charge to go through. And did you secure your account. did you followed all the steps in how to deal with unlicensed lenders - http://www.debtconsolidationcare.com/paydayloan/dealingwith-illegallenders.html - close your old account as compromised and open a new one not linked in any way to the old is the only sure way to keep them out of your money!
sorry we are posting at same
sorry we are posting at same time-- yes that is why we give you the steps to follow, as soon as they think they are not allowed in your account they will do all they can to take what they can.. And an online message to the bank -- that will do nothing.. I would go to bank to day show copies of your ACH revoke - dispute the charge for $250 and get the account hard blocked on deposit only right away.. and open a new one not linked in any way to the old..
I have the letters to give to
I have the letters to give to the bank. The only problem is that QXL uses online messages and not e-mail and since my account is locked I can't access the messages.
Just take the letter! did you
Just take the letter! did you keep a copy of what you sent to them or is it in the message reply you received from them?
I sent the same letter to all
I sent the same letter to all of the lenders (4 total), but changed the monetary information. I haven't heard back from the other companies yet and no additional withdrawals.
OK, doesn't mean they won't
OK, doesn't mean they won't try though - As I stated you need to give copies to your bank and the only way to truly protect your money is to close down the old one and open a new account not linked to the new in any way - up to you, just making a suggestion.. They already took $250.00...
Thanks...
Thanks for the advice. I am going to the bank today. I have copies of my e-mails and the letter I sent QXL Online. I actually have another account at another bank (was used for a business I had) so I won't need to set up another one.
I am concerned that I will receive calls at my work or my friends and relatives will receive calls.
Just let people know you were
Just let people know you were a victim of fraud... and you are dealing with it..
Make sure the account is not linked in any way to the other one.
Thanks again....
Update on my situation. Went to BOA and explained my situation. Branch manager told me I have to call the companies to do ACH revocation. After going over everything (very embarrassing by the way) I opened a new account (not linked to this one, she ensured me). I can't close old one until the $250 posts, then I have to call to dispute it.
I haven't heard from other companies, but Action Payday won't let me access my account online. Says I have to call customer service.
OK, BofA is wrong - you can't
OK, BofA is wrong - you can't call in an ACH revocation - they had to be in writing.. You could have simply told them you had a loan and it was paid in full and they are still taking money - end of story - nothing to be embarrassed about.. You didn't know they were not licensed to lend in your state until now.. It will be OK...They should have put the old account at least on deposit only status.. so that no one else can take anything or cause and Over Draft to happen..
The plan is to close my
The plan is to close my account as soon as the transactions post. Luckily the bank is near my work. I haven't heard from the other companies (Action Payday, Castle Payday and One Click Cash), but I'm sure I will when May 15th rolls around and my account is closed.
Any experience with these other companies?
Had loan with One Click Cash.
Had loan with One Click Cash. They were relentless in calling me. When I got my state financial regulation department involved, the calls stopped. Am due a refund, not sure if I will ever get one. It would be nice. Good luck!
Already contacted state regulation department
Thanks for the advice. I emailed the state regulation department and will be filing a claim.
