Central Check Processing threatening to prosecute

I have received three voice mails from Walter White with Central Check Processing stating that I am going to be prosecuted for check fraud and that they are required to by the company I supposedly owe this money to. One voice mail was left on my mothers home phone, my cell phone and my work phone. He did not state that this was an attempt to collect a debt and even left my drivers licence number on my work phone. When I called the contact number left on the voice mails and was finally able to speak with Walter, he stated that the debt was owed to Cash Net USA aka Advance America. He also refused to send any debt validation and stated that the one payment being taken out is proof that their is a valid debt. I am going to call again and request a dunning letter be sent to me as I have received nothing from Central Check Processing

While I did take a payday loan with Advance America, I had thought it was paid off. This company is legal in my state of Washington. I had to change my bank account back in November due to fraudulent charges and identity theft. I thought I had updated my new account information with all of my valid debtors. When I logged into my account with Advance America it does show I still owe money but have not received any bills, notices or calls from them regarding any past due debts. I also have not changed my cell number, place of work or work number or my home address. I have received fliers to take out new pay day loans from Advance America so I know they have my address.

I have some questions. My first is can they prosecute me for check fraud when there was no intent to defraud the loan company? My second question is about what debt collectors can state in a voice mail. Is it legal to leave information like a drivers licence on a voice mail especially if this is the first contact received? Can they threaten legal action if no previous contact has been made? Third, would this fall under payday loan collections in state laws or check fraud?


They are scammers. They are just trying to scare you. Don’t worry, they can’t do anything. You should file a complaint against them to the SAG or FTC immediately.

Should I contact Advance America and pay them back directly? I do believe I owe them after checking my bank records. I also would verify if they placed the debt with Central Check Processing.

you can try,but chances are advance america sold the debt as alot of these supposed legal lenders are doing that.btw criminal action is prohibited,and unless they own the debt they can't sue.only the oc,or the current owner of the debt can sue.so try to contact advance america,or cashnetusa and find out.this piece of garbage who called broke the law hand over fist,and if the debt wasn't sold(but i suspect it was)then advance america needs to know their CA is a lawbreaking bottomfeeder.

I did call Advance America and Paulmergel was correct. it was sold. They sold it to a company called Debt Management Partners which after I called them i found out they do not collect on any bad debt themselves, they just re-sell the debt. I found that they sold my debt to a company called Flowing Stream Financial. I have not called this company as I found nothing online about them at all. I only find items about calculating cash flow. Karen at Debt Management Partners told me that Flowing Stream Financial usually uses Federal Processing to collect the debt but she has heard of Central Processing using the same thing. I am sure Federal Processing is illegal as this suggests that the company is with the Federal Government

I also did call my state's Attorney General department of Consumer Protection and was relieved that Central Processing cannot bring in check fraud in this issue. I know that logically but was still worried. I filed a complaint explaining everything and the fact that I have the voicemails that hint and vaguely threaten criminal charges of check fraud. I also stated that Central Processing refused to send any kind of bill or debt validation to me. I am going to be sending a certified DV letter to this company at the only address I was able to find which is in NY Saturday. This is the only day I can go and do it as the post offices are closed by the time I get to my car.

I was also told by my Attorney Generals office that ANY debt collection agency MUST be licenced in Washington State to collect any debt from a Washington State resident. None of the company names I have found associated with this are licenced in Washington.

I do have one more question. If this debt is labeled invalid and uncollectible, can Central Processing sell this debt to a licenced company in Washington state to gain some money from it?

he debit is illegal and invalid.if by chance a legit entity gets it just send a C&D letter stating the debt is invalid and wouldn't hold up.however legit entities almost never touch pdl's as this for that very reason.
