I had a loan with Peppercash.com and received a deposit of $800 on 12/31/2011, and had 4 bi-weekly withdrawals of $200 and 1 bi-weekly withdrawal of $50 debited from my account. This resulted in an overpayment of $50. I live in Arizona and in April 2012 I sent Peppercash an ACH revocation letter and closed my bank account. They responded with their "tribal law" exemption and tried to work out a settlement agreement, but they never were able to get me a validation of debt and they eventually stopped calling me.

I received a call today from their "internal recovery division" and the guy starts telling me this was a last attempt to peacefully work out a settlement or he would have to turn the account over for wage garnishment, bank levies and/or charge me with check fraud. I told him he needed to send me a validation of debt to my address he had on file, but he wanted to email or fax it to me and I said no. He said he's sent one for the past 3 months that have gone unanswered, but I know that's a lie because I've received the validations I've requested from my legitimate debts. I finally hung up on him because he kept talking over me and kept repeating the levy/garnishment scare tactic.

My question is, what can I do to get them to stop? I live in Arizona and all payday loans are illegal. Are they just trying to scare me into paying something??



They are in fact just trying to rattle you - He has to send you a validation of debt.. they would not have sent on their own for the last 3 month.. also it is not check fraud, they have to go to court and serve you to sue you for the debt in order to get a wage garnishment or a bank levy. They are probably not going to cough up their physical mailing address in which case just ignore the calls and be on your way. Its highly unlikely they will do anything more than harass you over the phone.

You'll get more calls from them. I'm 100% sure. They will say more things to you. Be prepared for that. Just listen to what they're saying and then forget them. If they harass you too much, then file a complaint with FTC, SAG or CFPB.
