They pulled this on me too----they said they haven't answered any of my letters over the past year due to me putting a cease and desist on the account. which, here we go again. I only asked for the phone calls to stop---but written correspondence was welcomed. Well, they turned that into a cease and desist. so they gave me a name and a number of someone for me to call and set up payments with. I should be happy, right? this should be a good thing, right? well, I just know when I get him on the phone, he is going to try to make me pay more than I can afford to pay at this time. I don't want to make things hard on me and my family with agreeing to payments that I know I will have trouble making.
Because also get this. TOday OXFORD called and left a REAL message on my answering machine. A woman told me to call asap and named FOUR reference numbers to Dell accounts. THe last time I heard from Oxford, they were only holding two of the four accounts--now she's giving me four reference numbers. They haven't validated---I sent out a third letter to them today-maybe they will write back. Should I get this woman on the phone from Oxford and start working on a payment plan on these four accounts?????? this is the first time any human called from oxford and now apparently they are holding all four accounts. Encore was holding two- I sent them a certified letter today along with oxford and wells fargo. ha! should have waited on the wells fargo, could have saved me four bucks.
I hate calling these people on the phone. I just hate it. especially oxford! should I wait to see if they validate or at least write me back from the certified letter I sent today? those are FOUR accounts--I know they will try making me pay alot--and so I can't promise wells fargo something to pay when I don't know whats about to happen with these oxford guys.
I need someone to give me advice here on this one. gez, I hate feeling like this. I would rather write letters and negotiate payments that way than over the phone. Oxford is going to want alot, I just know it. advice anyone!!?? shirley

Remember I said that transunion was showing that three of the four accounts were suddenly showing '0' balance and the status was updated to 'payment after charge off' and I believe that meant they were sold? now oxford calls with 'different' account numbers. Even on the two that they were already holding, they changed the numbers. The thought that comes to my mind is that these accounts have in fact been 'sold' to oxford. shirley

I will always want you to talk to them instead of keeping it aside. That's the way you have to handle them.
These are the companies that were earlier not responding to you. Now that they have started calling you over this issue, you have to take your stronger side and get it resolved. Think two steps ahead about your credit that will improve later after this issue.

I guess at this point I would suggest that you give them a call to straighten this out. You know that the law is on your side, and you are comfortable with the fdcpa by now that you will have responses to any threats the person on the other end of the phone might make. Or on a positive note, maybe they will be nice and work with you appropriately...you never know! But at this point they have demonstrated that they aren't going to cooperate as far as written correspondence is concerned, so I would go ahead and place the phone call. Just write down all of your questions and concerns, especially the different account/reference numbers so that you have something to reference when you are talking to the person. Okay, I am definitely going to call wells fargo, but you think I should talk to oxford too? wells fargo is good to go, I didn't even ask them to validate because I knew what was what, and yet they validated anyways. Oxford has been told NOT TO call and they call me every day. Now suddenly today they're saying they have FOUR accounts? first I knew of this. I haven't gotten anything in the mail. I sent them a letter today, third request to validate.
I'm thinking of going back through my old paper work and seeing what my monthly payments were to Dell on these accounts and offer that to Oxford on a monthly basis? maybe a starting point. These accounts probably total about 8,000 total. so whats a good place to start? Should I just give up on the validation thing, and face the music? just settle? I think you might as well call Oxford too and straighten things out from both ends. Get all your paperwork together and sit down with the phone. I wouldn't consider settling, you have worked so hard on your credit so far, if they report it as settled, that won't look good on your credit report. Hopefully they will accept the same payments that you were making before? Give it a shot!! Let us know :)

I didn't mean 'settle' as in making a settlement offer. shoot! I'm broke, I have no money--the only thing I can do is monthly payments. And thats if these people are really willing to work with me.

It sound like you got want you were looking for ( good or bad) with Wells Fargo. When you call them use as a bargaining chip that you have continued to pay other accounts with them, and tried to make arrangements , so you obviously have every intention to honor the debt. They may not be as bad as you think.
AS for encore, I don't really know what to tell you here, if they have changed the account numbers, then it sounds like they may have actually bought the debt from dell, and now own the accounts. Even so bear in mind this does not change their status under the law. Also, check the dates. if they changed the account numbers they may be trying to re-age the debts and start the SOL over. Are any of those accounts getting close to that time?? Make sure you know what the actual Date of Last Activity on those accounts are.
As an aside, in the Validation /Cease Phone Contact letter I send, I specifically indicate no Phone contact, and specify that contact via written correspondence is acceptable. There is none of this " you said cease all contact". If it goes to court, I will have in writing where they were advised they may contact in witting, they obviously made that choice.

Wells Fargo is an original Creditor, as such they are not bound by the fdcpa (though they may adopt it as principals of practice as many OC's do) They have more authority and remedies available under the law than a Collection Agency does.
Though they may have taken you to literally, Wells Fargo Apparently did honor your wishes (to not contact) and when they did finally respond to your letters, they had researched the situation, explained why, and provided you with the contacts and information to go forward.
Oxford on the other hand, has failed to comply with the law. They have continued to call even when ordered not to and falsified information. Why should they get a better deal from you than the people who are operating within the scope of the law? If you have the documentation to back your self up if Oxford goes to the next step, then stand your ground. Reward those who do work within the law (even if they are not bound by it), and make those who don't wait their turn. Maybe you can offer them a small "good Faith payment" until you can address their issue more fully.
Even if they do take you to court, you know now you must attend the hearing. Take all your documentation of what you have been doing with all your creditors (een though unrelated, it helps to establish your intent), and documentation of what you have tried to do with Oxford. The judge will look at everything, and he will see you have every intention of honoring your debts, and even if they get a judgment, it will probably more lenient.

I'm thinking of going forward with wells fargo---and putting Oxford on the back burner for now. Well only while waiting to see if they send me validation. In my opinion, I feel I need validation on these debts MORE now than ever!!!! Its been months since I've heard anything on these accounts AND they can't say I put a cease and desist on them because they call my house EVERY DAY!! so we're not going to play that game. So I really didn't know which agency had which account, which is why cerified letters went out JUST yesterday to the agencies I last heard from and also to DELL. But if Oxford has all four accounts and are giving me their own reference numbers---then I feel that maybe I should definitely have validation so I know which account is which and what they're now saying I owe. So I think I will 'exhale' a second on these and wait and see what they send me back paper wise. When that happens, or at some point, I will plan my next move as far as negotiations.
I've noticed on the last few of my husbands credit reports, Equifax and Experian had a special section for like attention and special notices. And both said to contact Dell. could be because those were the accounts I was disputing and they were telling me to talk to them. which is a laugh, dell tells me its out of their hands, they are no longer 'servicing' these accounts. So I shall wait and see what yesterdays letters stir up. thanks again Clay!

This really makes me suspect that dell has sold these accounts, and Oxford is trying to re-age them. Because they total a large amount, you can bet Oxford will try harder. you may need to be prepared to contact an attorney to handle that (those) particular debts. It think you dealing with some people even worse than the rest.
I can tell you partially based on your experiences, and a little on my own, I will never buy another dell product, specifically because of how DFS handles and services their accounts and treats their customers. Even when you are not in collections, they still treat you like garbage. And the fact that Dell is sending even more of their Customer Service / Tech Support and now Manufacturing jobs over seas makes me very upset as a consumer and an American. I will instead support companies which keep their jobs here. Eventually these companies will come to realize they can only chase lower cost until it begins to work against them.

I have never even heard of ARS much less FROM THEM!! how come I have never heard anything from them? I was going to email Dell back and say (AGAIN!!) tell me which collection agency has which accounts! Theres ONLY four accounts and from the messages from oxford yesterday, they're listing four reference numbers. so what the crap? this has gotten SO MESSED UP!!
So anyways, I was going to email dell back, but yesterday I sent them a letter certified return receipt about this VERY THING. So I will wait and see what they come back saying. I also sent Encore a certified return receipt letter (which three months ago they had two of the accounts but not now according to oxford), then I sent Oxford a certified return letter too, asking for validation again and info on which accounts they actually have. I also have an account that an agency was holding and dell is now saying ARS has it as well. GEZ!! these accounts don't sit still for long. This is how its been in the past year plus. Every time I ask for validation, they pass it on to someone else! I'm started to get really mad about this!
So with it passing through so many hands, I definitely need validation! I don't know who has what! and ARS has NEVER contacted me???!!!!!! I've never heard from them. so now what??? do I wait and hear back from dell from my certified letter to see where my accounts have scattered to now? should I write ARS? or wait to hear from them. thanks!! shirley

And most likely , none of them will be able to validate them either. By the way there is a website called Federal Capital, which I think is a collection Agency (weird site by the way ) offers a Registered Email service for free.. you may want to check it out...

Hey Shirley,here's a thought, Call Oxford, and play hard ball with them, ask them what they are talking about. Dell has given you some good information, and use it against Oxford. Tell them the original creditor (their alledged client) has informed you that they (oxford) is not authorized to collect on at least the affected accounts, and if they don't cease you will pursue legal action.
I bet if you look around you will find a lawyer willing to help on either a pro bono or contingency basis..
