DEALING WITH UNREGISTERED CSO OR CAB IN TEXAS

Your forum is very helpful to people who are stressed with loans like me.
I'm so scared because I have closed my account and will now have to face harrassment from my online payday loan lenders, though I'm willing to negotiate. My main question is: can I stand a chance vs lenders who act as CSOs but are not registered with the texas secretary of state? Also, are these companies legal in TX (I know cashnetusa & payday one are):
PayDay One
Cash Net USA
Fox Enterprises
GTI Holdings
National PayDay Loan
Seaside Dollar
Multiloan (AALM)
Ideal Gelt
Ameriloan
United Cash Loan
Loan Shop Online
EZ Money
CWB Bassetere
Thank you, truly appreciate your insights and advice.
As you already know, only
As you already know, only Cash Net USA and PayDay One are the only legal lenders on the list. You must be facing trouble with EZ Money.
If a lender is not licensed with the Texas DoC, they are not legal, contrary to whatever they might say.
As for the rest of the lenders on the list, they are all illegal.

All of your lenders are
All of your lenders are illegal except Payday One and Cash Net USA. You owe nothing more than the principal. No interest, no fees. Close down your old bank account and open a new one to stop unauthorized withdrawal.

Thank you for your replies. I'm ready to send the letters to these companies. Do you think they will attack my credit score this way?
I'm so ready to put my life back on track. Family emergencies make you so vulnerable and they prey on that. I got a $2K bonus and even got a raise this year, but never got the chance to enjoy the fruits of my hard labor. They are like vultures having a field day every payday -- devouring each and every dollar from your bank account. This is the first year ever that I had incurred NSF fees....and almost $800 at that! I'm even so guilty to have a $25 haircut or even treat my family to dinner.
This forum is essential to my empowerment. These payday lenders should be investigated and cracked down big time for making so many people miserable. Please wish me all the best as I take the crucial steps towards freedom. With the knowledge I obtained from this website I'm ready to regain my sanity and sense of self-worth. I'll keep you posted. Thank you.

I already paid $900 on a $500 loan from Multitloan, same with United Cash Loans. Tried talking to them to work out a settlement showing paid in full, but they refused, wishing me good luck and hire an attorney since my loan will be on deault and forwarded to collection agencies, What should I do now? I have no problems with Loan Shop Online, EZ Money, cash Net USA and Payday One. The others are loan sharks/vultures who refuse to settle. What should I do now? Appreciate your insight as my migraines are becoming a daily thing due to stress.
You do not need to "work out"
You do not need to "work out" a settlement with illegal lenders....you TELL them that you are paid in full and will not pay another dime. Legally they cannot do squat.
Dear Payday Lender
Cut the crap. You know as well as I do that you hold no license in my state of Texas as required by Texas state law and that legally the contract I signed is null and void. I will not pay you another cent so do yourself a favor and mark my account as paid in full. By all means, send me to collections. I will simply cease and desist any collection agency that contacts me informing them of the illegality of paper you are assigning to them. If they choose to violate my cease and desist, I will be more than happy to collect damages from them under the FDCPA.
In other words, I do not expect to hear from you again.
Govern yourself accordingly.
The illegal lenders will
The illegal lenders will threaten you in the hopes you will continue to pay. Revoke the ACHs and secure your bank account. You only need to worry about the legal ones who by Texas law have to work with you. There is only one illegal lender that I know of that reports on your credit report, but I don't see that you have a loan with them. Once you shut off their access to your bank account you most likely won't hear from them again because their jig is up so to speak. If you do happen to get a PIF letter from any of them make sure to print and keep in a safe place. And if you start getting harassing calls make sure to reiterate the C&D and that you will report any violations and as Soap Lady says, "Govern yourself accordingly."

Thank you, Soap Lady and momofthree27, your posts are so uplifting in this time of stress. Yep, they did call my co-worker asking him to have me call them. Should I call them back?
Now this is disturbing. I called the Texas Office of Consumer Credit. I asked them about these unlicensed internet payday loan lenders who are operating in Texas. I told them I already paid more than my principal amount yet they still hound me, The person I spoke to said that unfortunately, I will have to pay them according to the contract (which means paying interest as well). It will be treated as if I signed the paperwork where they are located (e.g. Costa Rica, Miami, etc.). This didn't help me at all. It's hard to deal with these loan sharks when I couldn't get the legal backing of my own state. Any insights on this?
okay
you don't file complaints with anyone but your AG(attorney general).pdls are not regular credit that is why there are seperate laws for them.the texas office of consumer credit is wrong and you should not take what they said as truth.file an AG complaint against your lenders.
From one Texan to another,
From one Texan to another, let me say that Texas OCCC is the worst agency on the planet (under Gregg Abbott) when it comes to protecting consumers. This is what I want you to do so that you can get attention to this matter......(1) go ahead and file formal complaints with both the Texas AG's office and the OCCC. You will most likely get a letter back from the OCCC stating just what you were told...."there's nothing we can do, you agreed to their laws, blah, blah, blah." The AG's office will just send you a confirmation that they received your complaint; (2) once you get the blanket response from the OCCC stating they can't do anything, I want you to write a very heartfelt letter explaining the situation and how you reached out for help from the OCCC's office and they won't do anything to help (enclosing a copy of the crap letter they reply with) to the Honorable Wendy Davis (you can PM me and I can walk you through this). You need to send it to both of her offices (Austin and Ft Worth). Make sure you cc the AG's office and the OCCC's office. Senator Davis is a big proponent of banning PDL company's in Texas. HOWEVER, under Gregg Abbott and Rick Perry (who receive thousands of campaignn dollars from the PDL lobbyists), this is a no win battle; and (3) Make sure you send a copy of the letter to Senator Davis to both the AG's office and the OCCC. This is the only way I got them to respond to my complaint about an illegal lender operating in Texas.
On another note -- these illegal lenders know they are illegal and know that the only way they can get payment is through harassment. Once you shut down their money supply (your bank account), you may get some harassing phone calls, emails and letters but as long as you let them know you are not paying them a dime over what was borrowed and that you have filed complaints with the AG's office (give them the file number once you get it), they will go away eventually. They may threaten the crap out of you with third party collectors and lawsuits but there is little they can actually do but harass you because they are ILLEGAL. Once they realize you are not budging on your stance, they will eventually go away. I know it's tough at first because you are so scared, but once you shut down their access to your bank account and draw a line in the sand, there isn't much they can do. Hang in there.

Sorry I had to repost my previous question as I didn't see the response earlier.
Thanks, so much...and to my fellow Texan momofthree27, you rock!
I will follow your advice...Im so glad to learn that I'm not alone in hearing that crap from the OCCC...ugh...that made me feel so bad about myself, like I was the crook for being unable to pay and not them for devouring my paycheck.
I will keep in touch. More power to this website! You deserve a Nobel Peace Prize for giving us financially challenged citizens the peace of mind we need in this time when our sense of self-worth is being stepped on by these loan sharks.
Thanks, GINGY. It means alot
