So I just received an email from Plain Green wanting monthly payments of $175 for 4 months to pay off current $700 loan. I have had 3 loans with them for a total of $1900, and have paid $1792, so I technically only owe a principal balance of $118. How do I word an email to them telling them that they will only get the $118, and not a penny more?


word it like this:

since i now realize the fact of your illegality i owe 118.00,and i'm not paying a penny more take it or leave it.

respond just like that.

As stated in my previous email, your lending practices are illegal in my state. I am only morally obligated to repay the principal on these illegal loans, of which I have already paid your company $1791.58 of the $1900 borrowed. I will only agree to pay $108.41 remaining on principal in full on or before 6/30/13. This is my only offer. You can either accept my terms, or not, but if you choose to reject my offer, you will not get another dime from me.

...to both Plain Green and Great Plains. Awaiting response. The other two I have not heard a peep from, however I know they received my emails because my accounts are flagged. I'll send emails off again tomorrow and just keep nagging at them. Not much they can do at this point. Account is closed with hard restrictions and I refuse to pay any more than principals. I'm sure they'll try the 'finance charges from previous loans cannot be credited to current loan' but I know that's just BS! I'm sticking to my guns and will only give them what I morally owe!

I received a response from them earlier today after I sent a 2nd ACH letter. I responded the same as I did for PG. Also just received email from Mobiloans with an agreement to pay principal in one lump sum by 5/24/13, emailed them back that I would make this payment, but not before 6/15/13. Logged onto that account and it shows that settlement offer was made and only principal is due. I will be calling them with a prepaid cc to make this payment and then demand a PIF letter. Still nothing from Iggy Loans, but since they owe me $$, I'm sure they'll drag their feet. I'll keep y'all posted on progress.

I things Great Plains is going to be a handful. They keep sending the same email, to which I respond with my email. Thankfully I closed my bank account and they can't get at it. I have no problem playing email tag with them...I hope eventually they will relent and give in. Until then, they won't get anything from me.

This is what I sent to Plain Green in Dec - same scenario- and haven't heard a word back from them since:
"Dear Plain Green,

Do yourself a favor and mark my account paid in full. I am not paying you another cent - you owe me a refund of $1002.89, that I have paid on my loans with you. If you charge me off to collections I will not hesitate to not only cease and desist them, but make them aware that I informed you I am aware of the illegality of the debt and the fact that I will not be paying any remaining balance and that you in fact owe me a refund again for $1002.89. Cut the crap and save yourself the time.
You lost this one, I know that you are illegal to loan in the state I live in.

Your past customer"

...hasn't sent me any communication since the first one sent yesterday that I responded to. It's Great Plains that is being a pain. I'll let it play out a couple more days and then I'll just tell them to C&D if they want what I morally owe. Mobiloans hasn't responded to my counteroffer of paying off small balance two weeks after they want, but I'm going to assume that they'll take it if they want their money. Iggy loans hasn't made a peep, but since they owe me close to $500, I doubt I'll hear from them.

I meant that my issue with Plain Green is similar to your with Great Plains.. thought it would help.. from reading your post.. I thought that Great Plains owed you a refund.. I can tell you that original lenders will not comply with a C&D, that is used for collections agencies usually.

Im going through the SAME thing with Great Plains. I overpaid on a previous loan with them, which combined with what I owe on my current loan, actually ends up being that they owe ME roughly $27.00 but all they do is keep sending emails to contact them to catch my account up to date.
