Online Advance/Law Office of Presley Smith?

So, I live in Indiana and had a payday loan with Online Advance. It was for $1250 and I paid $3750, so far. I have closed my account and sent my letter (which was my contact with them), requesting a PIF and a refund and here is the email and phone call that I received today.

I am contacting you today regarding your collections balance in the amount of $1965.00 . THIS ACCOUNT IS 55 DAYS PAST DUE.THIS WAS RETURNED TO US AS ACCOUNT CLOSED THROUGH YOUR BANK WITHOUT REPAYMENT OF THIS DEBT. WE HAVE HAD NO CONTACT FROM YOU IN REGARDS TO ANY REPAYMENT ARRANGEMENTS ON THIS ACCOUNT. THIS ACCOUNT IS IN LEGAL DANGER AND DOES NEED YOUR IMMEDIATE ATTENTION. We accept payment via Money Gram OR Credit / Debit card Payment by phone.Please call me today so we can set solid arrangements in place.

I WILL BE TURNING YOUR FILE OVER TO THE LEGAL DEPARTMENT OF ATTORNEY PRESLEY SMITH FOR IMMEDIATE ACTION IN COLLECTION OF THIS DEBT SHOULD I NOT HEAR FROM YOU TO RESOLVE THIS ISSUE OR RECEIVE PAYMENT IN FULL BY YOUR NEXT PAY DATE 866 -643-2273

Sooo, Should I be concerned about this? Or should I just re-send my letter directly to this person and mention that I will be filing complaints with the AG and FTC.

Online lenders must be licensed in California. You can check here to see if they are - California Department of Corporations - their website is - http://www.corp.ca.gov/

Thank you for the link HelpinAZ. Do you know if Online Advance is calling it an installment loan instead of a PDL, is that a different can of worms??

I don't believe so, they still have to be licensed to lend in CA to CA residents.. and since I see they are out of Delaware - I doubt they are, but you will still want to check!

Thank you!!! I have checked and the search comes up with "no records found" which tells me they are not licensed in CA. I will be sending them my letter today. :)

The law office tried to send me an official looking letter, and the loan documents when I asked for a dunning letter. I filed complaints, send them a C&D letter, and haven't heard from them since. This is since July of last year!
