Illegal in TN
Date: Thu, 05/30/2013 - 10:18
I (like many others) have gotten into the payday loan trap and am trying to work my way out. After researching the payday loan regulations in my state (Tennessee) I realized that most of my cash advances are likely illegal as they are either not registered in the state of TN, they loaned me more than TN law allows, the interest rate is above the legal limit the state of TN has in place, or they are rolling over my loan (which is illegal in the state of TN). Most are doing all of the above.
I've been reading on how to stop the ACH payments, close my account and send letters to the payday loan companies. In doing this, I want to make sure I am doing my letters correctly. Does anyone know which of the payday loan companies list below is illegal?:
Zip19
Ashland Funding
United Cash Loans
Speedy Cash (I'm pretty sure SpeedyCash is legal in TN)
Any help would be much appreciated…it is an uphill battle!!!
Thanks! Would you recommend
Thanks! Would you recommend I pay Speedy via money order or prepaid debit so I can still close my checking?
With Speedy you may still be
With Speedy you may still be able to get them to agree to an EPP - Extended Payment Plan - you will want to check with their corp office more than likely - storefronts don't have as much authority. If you need contact information let me know.. and when I revoked ACH authorizations I did illegal as well as legal and no one had an issue with it at all..
OK, so Ashland Funding has
OK, so Ashland Funding has sent the response below to my letter...what should I do?:
"You contacted us to borrow these funds which we were more than happy to deposit into your account based on your word that you would honor the contractual agreement. At no time during the application process did you ask us if we were based or licensed in your state. If you feel you were misled at the time you took out this loan, we are happy to help resolve the matter to the best of our ability. Please contact our recovery department as soon as possible in order to come to a resolution. As it states in your loan documents you signed and agreed to ,(We are an online loan company and, WE ARE NOT GOVERNED BY YOUR STATE LAWS.) you left your state when you went on line we are located in the West Indes."
This is typical BS response..
This is typical BS response....they are illegal and they know it. Just keep sending your letter...if you are due a refund keep pressing for it.
respond this way
respond this wayJ:
cut the crap.i am not a resident of the west indies so yes my state law prevails.so i will not engage in stupid arguments over the phone.the only resolution is outlined in my original letter.btw it doesn't matter how i found out the point is that you are not legal, and unless you extradite me to the west indies you can't do spit.i trust my position is clear.
respond just like that.
So I sent them a message back
So I sent them a message back as Paul mentioned above and here is their response:
"COLLECTION NOTICE
This letter is to inform you of your outstanding account balance of $510.00 that you have with ASHLAND FUNDING. Your account has been assigned to our in-house collections department due to non-payment. We are trying to reach you in every effort to get this account resolved and to avoid having your account reflecting as Refusal To Pay!
Once that is taken care of, they will acknowledge this balance as Paid In Full. If you ever get into a financial bind in the future you may need our services again!
It is extremely important to keep your payday loan in good standing with us to prevent any negative marks from appearing on your Payday credit record. A negative mark may prohibit you from receiving a new loan from any other Payday lenders indefinitely. Remember you may reach us by email at gerri@pwollc.com ."
it makes me want to cry that
it makes me want to cry that you won't be able to borrow from them again....boo hoo.... keep sending your letter will agree to your terms only.....and keep up the good work
speedycash
Speedycash is legal. I actually just dealt with them. Instead of opting for the epp I secured my checking account and cancelled my debit card with them before I sent them an ach revocation. I had 2 loans and let them default and go to collections. I was contacted 2 days after the due date and they set me up with 4 payments. That was better then the epp since it is only 3. All interest is stopped. They were very easy to work with.
ah yes
teletrack.it really means nothing as far as regular credit goes.as they stated it will effect your ability to get a pdl,or a place like rent a center.other than that they can't effect anything regarding regular credit.as bingonut stated waaah.
actually send this:
you idiots just don't get it do you.i have better thing to do than argue with illegal humanoids who want to lie through their false teeth.
send that and as bingonut stated you are doing great.
