Payday Loans/Collections
Date: Thu, 06/20/2013 - 10:05
I moved to Columbus, Ohio about three years ago to attempt to start a new life. Everything was going well until I lost my job, and in a matter of 3 months, everything I knew began to unravel.
Because of the hardships I was experiencing, I made the dumb choice of seeking the "help" of payday loans to get me through times I could not afford otherwise. I knew how they operated and that the fees could be excruciating, but I was stuck in a corner and have no one else to turn to. My family does not have much money to spare, and so I cannot turn to others for help.
To make a long story short, over the last year I ended up opening several loans through these terrible companies just to try and keep myself afloat, and now I am paying for it.
I have six loans out, most of them for right around $300 - $500 dollars, with I believe one that was $800. I don't have all of the figures in front of me, as I am at work. I am writing this at work because I just received a voice mail from a collections company called Admin Recovery LLC. I have not had the opportunity to call them back, but I will do so as soon as I can tonight.
I am worried because A) I cannot afford to pay high lump sums of money to anyone at this point in my life, let alone several companies at once. B) They (not just Admin Recovery, but the payday centers as well) call my place of employment constantly and leave me messages. I know for a fact that they have left messages on the wrong extensions and that at least one other person in my office has heard partial information, because they forwarded the message to my line's voicemail.
I know that what I did was stupid and obviously not the correct way to go about it, but I do not have very good credit and my whole point in moving here was to rebuild my life, including my credit, in the hopes that I could begin to move forward. Now I find myself in an even worse predicament, and I fear that they may begin to pursue other means of collections, and I most certainly cannot afford to be sued or I will end up homeless and jobless if this continues.
What can I do to help myself in this situation? When this all began, I set up arrangements with a third party payday consolidation company, and of all of the information I gave them, only one company (Ace Cash) ever responded and accepted the payment agreement that was offered. I was originally told that it would take approximately 60 days for the calls and harrassment to stop and by then they would have structured payment plans for all of my debts that I provided to them, but this never happened. The calls continued, the letters to my home continued, and it seemed that nothing was going to be done, regardless of what I was being told.
I've lost a lot over the last three years, including my job, my car that I was forced to sell, and my relationship with my significant other. I am at my wits end here and some days I wake up and just do not want to go on anymore.
If anyone can provide help or assistance to me, whether it be in terms of giving me phone numbers, companies, anything.. I would appreciate it. I realize my mistakes and I want to pay these people back, as I know they deserve the money I borrowed, but with little help from anyone, I don't know what else to do.
Please help me, before it is too late.
Thank you
Thank you for such a prompt response. It's great to know that there are still genuinely good people that are willing to help others. I really appreciate this.
1. I have the following listed on my forms that I sent to the payday loan consolidation company that was going to be working with me.
National Check Cashers (Storefront) - Balance was $240.70 when I filed the paperwork in early February. I re-loaned here a few times before finally not being able to make the full payment.
Ace Cash Express (Storefront) - I owed $328.49. As I had stated, this was the only company that immediately setup a payment agreement with my consolidation company. As of March 4th, they had agreed to settle for $279.00, spread out over 4 payments. I do not know if any payments have gone through yet, but I will be speaking with the consolidation company this evening to end my account and attempt to take care of these on my own.
Advance America (Storefront) - I owe $322.58 on this loan. They did not respond to anything from the consolidation company, and continued to call me directly. I spoke with one of their store representatives not long ago and told her I was trying to make the payments but I needed some extended time and that I had this company working with me, and she said she would call back in a week after she checked to see if they received any documentation about the consolidation. Never heard anything back. This was another store that I had to re-loan on before not being able to pay it in full and close it out.
Cash in a Wink (Online) - Borrowed $400, and have not sent in a direct payment to them. I believe they were the last lender I applied with before realizing I was not going to be able to crawl out of this hole, and put a stop to borrowing. They also did not respond to the consolidation letters, including the cease and desist documentation, and continued to call my office sometimes two or three times a day.
Seaside Dollar (Online) - Borrowed $500, and made a one time payment on my own of $150 before seeking the consolidation help. They did not respond to the letters sent to them, and continued to call. I actually spoke with one of their representatives and he told me that they did not work with third parties and that he would not be willing to work with me, they wanted it paid in full, which was not a viable option. I attempted to give him the contact information of the consolidation company, and he out right refused it. This was approximately a month ago.
Also, please note - As I stated earlier, I received a call from the Admin Recovery LLC company at work. I took a short break so that I could call them because the things I was reading online about them did not sound good, and I wanted to know who had sold my account over to them. I spoke with a gentleman named Greg, and he was very helpful in explaining everything, but there were limited options to work with. I was able to find out that it was Seaside that sold my information to them, and that they were asking for a payout of $1220, but that Admin Recovery could work it out for $793 and some change.
He also informed me that if I could not set up an arrangement by the end of the month (this is the first time I have ever spoken to them, so asking me to come up with either the $793 or $1220 in 10 days was just not something that I could do) that my account would be sent elsewhere and they would continue to tack on high interest to the loan.
He asked me to set up a two month split plan where I would pay a set amount this month and a set amount next month, and that would end the account with Seaside. But from what I understand from things I found out after being stupid and opening a loan with them, is that most of these online loan companies aren't able to operate legally in Ohio. I don't know how true all of this is, as I never wanted or expected myself to be in this deep. I just don't know what to do.
My main concerns are getting as much of this taken care of as possible, and getting all of these companies to stop calling my place of work. I work in the medical field and can't have people calling in to our phone operators and disclosing information about me to whomever they see fit, and in some instances, doing it several times a day from different numbers.
I WANT to be able to pay back debts, but when they continue to add on ridiculous interest rates and give me little to no options, I can't do anything except continue to let this spiral out of control. I know that doing this was a mistake, but my back was against the wall and I had nowhere to turn to, so I had to make due with any means necessary to keep myself in a house and keep my utilities on. I struggled with paying back several times over the course of this all happening as you can see, and in two instances, I did have a few of my utilities cut off because I could either pay some money to get these people to stop harassing me constantly, or I could let my gas be shut off for a few days and then in turn spend even more money having them come back out to turn it back on.
I just want to be able to rebuild my life. I've put myself through some schooling, I want to be able to finish my degree and get on with things, but I just feel like I'm constantly drowning.
I really do appreciate your prompt response. I'm glad you responded before I went and started paying money to this Admin Recovery company before finding out more information.
OKAY
the top three storefronts you should communicate and explain your situation.they should be able to help.now seaside, and cash in a wink are both illegal, and you only owe the principle.so you owe cash in a wink 400.00.seaside you owe 350.00 and should either ignore,or hang up on admin recovery when they call.they are a bottomfeeding pile of slime.do not talk to them at all.they can do nothing but call and harass.btw if you haven't done so drop this 3rd party.they are doing nothing but taking your money.
Yes, please answer the
Yes, please answer the questions. You may seem overwhelmed at this point in time, but believe me, it will get better. Just hang in there as we are all here to help!!!
Question
In terms of dealing with this Seaside/Admin Recovery situation, what is the best way to go about taking care of the money owed?
When I spoke with the people at Recovery they were urgent to set up a payment, as I knew they would be, especially when the story and deadlines changed 4 times as he explained to me what could be done.
Should I contact Seaside myself, and try to set up a payment plan for the remaining balance, or should I look for other options to help me?
I can make small payments to take care of these, but I can't afford to pay a full $350 or $400 to either Seaside or Cash in A Wink. I want these debts paid and over with, but I want to make sure I go about this the right way.
Also - Concerning the store fronts. What is the best way to go about talking to them to setup a payment arrangement? Should I go into the store, call customer service, etc...?
Thank you again for your help. I'm glad I posted today before I went ahead and sent a payment through to this Admin Recovery place.
Sent my letter
I went ahead and sent a letter to Seaside Dollar, and a letter to Admin Recovery concerning the status of this account. Now that I have stood up for myself against these two, it already feels better. I know I have a ways to go, especially dealing with the three store front lenders, but this is a big step for me.
Here is the letter I sent to Admin Recovery, which includes the letter I also sent to Seaside (The Seaside letter is the section in quotation marks).
I have contacted Seaside Dollar concerning this matter. Please find the e-mail to them below concerning the status of this account. This is a loan from an offshore lender that is not licensed in my residential state of Ohio, therefore making their lending practices illegal. I placed a call in to Greg in your office, and left him a message concerning this matter. Please cancel the payment arrangement that was made with your company earlier today, and cease and desist contacting my place of employment and any other parties that you have listed as associated with me. If this does not stop, it will be deemed as harassment as I have attempted to settle this with Seaside Dollar and they have refused to accept any terms over the phone. I will not hesitate to send this information to the FTC and the State Attorney General should Seaside Dollar or your company, Admin Recovery LLC, continue to violate the terms of the Fair Debt Collection Practices Act. If you are unsure of the stipulations of this act, please visit this link: http://www.ftc.gov/os/statutes/fdcpa/fdcpact.shtm
Below is my letter to Seaside Dollar, attempting to settle the debt. This letter was sent today, 06/20/2013:
"My name is ******** ***********. I took out an online loan with your company in January of 2013. It has come to my attention that payday lenders must be licensed by the state of Ohio in order to offer loans to its residents. Since your company has no license in my state, the loan contract I have with you is not valid. Although I am not legally required to do so, I am willing to repay the principal balance of this loan. To date, I received a one time deposit of $500 , and have had one payment of $150 withdrawn from my account on 02/01/2013. This account has since been closed.
At this time I am attempting to settle the rest of the debt with your company, and your company alone. I have placed calls in to your offices, and each time I am told that you cannot work with me because you sold my account to a third party collections agency. I am making a written attempt to take care of this debt. I am writing this because your illegal offshore company does not provide proper contact information in terms of actual mailing addresses, and your customer service department refuses to settle this debt with me. This document will be saved in my records as an attempt to settle this debt.
I am also revoking any authorization for ACH withdrawals and any wage assignment I may have signed. I have given a copy of these revocations to both my bank and my employer. Any future attempts to collect funds in this manner will be blocked.
Please respond to this email with acknowledgment that you have received this letter and that you accept the terms of repayment. If you do not respond, I will assume that this situation has been settled and will no longer make attempts to contact you. If you do not wish to agree to these terms after several attempts to settle this debt, I will make no further payments to you.
If you continue to call my place of employment or attempt to contact friends and relatives concerning this situation, or send my information to the credit bureaus regarding this illegal lending matter, I will be forced to report you to the FTC and the State Attorney General for violating the terms of the Fair Debt Collection Practices Act.
If you accept these terms, please respond to this e-mail. If there is no response, again, I will assume this matter to be settled and will not make further attempts to contact you"
Again, I will not be making a $200 payment to you tomorrow. This is an attempt to settle the debt in question with SEASIDE DOLLAR, the illegal offshore lender mentioned. If your company provides my information to another party in terms of collections, I will move forward with reporting this situation. Please, do not call my employer, and remove their phone number from your system. If I receive another call at work or you contact my friends and/or relatives, I will contact the agencies listed immediately.
This is an attempt to settle a debt owed to Seaside Dollar ONLY. I am providing you the information I sent to them for your records. If you wish to communicate with me further, you may do so via this e-mail. Do not call my employer, do not call my phone, do not call any other people you have attached to my account. If Seaside Dollar refuses to accept these terms, I will make no further attempts to contact them, and will consider this matter settled. If my information is given to the credit bureaus, you will also be in violation of lending laws, as this is NOT a legal lender, nor are they licensed to provide loans to anyone in the state of Ohio, therefore making the entire contract invalid. This is my final attempt to settle this matter.

That was the letter to both parties. Should I also do this with Cash in a Wink, before I receive third party collections calls to wherever they may sell my information to?
Thank you all for your help.. you've already made my week a lot more bearable, and I look forward to continuing to work these kinks out with your help and assistance. You are all truly great people.
Well, for starters, today I
Well, for starters, today I've received 3 phone calls on my cell phone from 3 different states, all that appear to be tied to this Admin Recovery company. And again, they called my work FOUR times in a row. I work near our phone operators and can see the phone calls that come through, so I picked it up and hung up on him three times, and he must have called while I was away the fourth time, because I got back to my desk to find a voicemail.
He says he understands where I am coming from, and just wanted to explain why Seaside can't work with me to settle this debt, and that Admin Recovery is now the only company that can settle it.
Because it's Friday and I actually feel good today, I'm going to return his call, listen to his explanation, and then politely inform him one more time that I understand the debt, I also understand my rights and the law, and that in this situation, according to United States law, what has been done has been through illegal means and therefore the contract that was presented is not valid, nor will it ever be, nor will it hold up in any court of law. At that point, I will once again inform him of the e-mail that has been sent to his company, and that if they call ANYONE in relation to me one more time, the FTC will be contacted without hesitation. I will give no more warnings. I can't deal with this shit at work. I informed our phone operators of the situation, and they know to tell him that we are a place of business and that we cannot accept his call, and that it will be logged and given to me.
I swear, if I could reach through my phone and punch someone in the face, this is the type of person I would most certainly do it to. I don't care that he portrays himself as a nice guy, his constant harassment has got to go, and I'm going to make damn sure he knows that this is the last straw.
okay
i would look for an an actual address.i will look as well, but the time has come to lay the groundwork to sue admin recovery.meaning get a C&D letter to them, and sue when they violate it.it is pathetic what depths bottomfeeders stoop to,but you never work with trash like this.meaning you pay them nothing, and when you do sue them they pay you.get the process started asap.
Paulmergal, thank you for
Paulmergal, thank you for your help in every aspect of this situation.
I called Admin Recovery back as I said I would and told them that a C&D letter had been sent last night to their "Administrative Assistant" Shannell Schmitt. The guy that I had been dealing with since yesterday was still polite, and I hold no grudges against him (the way he spoke made it sound like he at least knew I was informed of my rights, because he said all he could do was transfer me to their general manager). So, I was transferred to this Adam Brown, who is an obvious piece of garbage, as he was very rude to me and said several times that he didn't care what I thought I knew, and that he would gladly do a conference call with a lawyer, the Attorney General, or the FTC if he had to, and that he would tell them that THEY were wrong in knowing their laws. He then told me he could care less if I didn't pay because it didn't matter to him, and that they would still proceed with legal actions if necessary. I told him we would leave it at that, and hung up and immediately called the Ohio State Attorney General.
I filed a complaint via phone, received information from a representative on adding myself to the Do Not Call List, and she told me, as did you all, that I was to verify absolutely nothing from here on out. As soon as I had explained to her that this was from an online loan outside of Ohio, I could tell she had dealt with this many times as she got very serious about what to do.
I have a confirmation number for my phone call/this potential case. It seems apparent that the letter I sent yesterday was not given to the proper people at their office, so I am going to attempt to find this Adam Brown's e-mail, and send him a new e-mail with the cease and desist information and to inform him that an official complaint has been logged with the Attorney General as of 11:36 this morning.
From what I understand, the AG suggested that I log onto this credit report site that they gave me, pull my information, and see if they are reporting to the agencies about this, and if so, to file a dispute and get the wheels going to push this forward. So I will be doing that at some point today.
Does anyone happen to know this Adam Brown's e-mail address to Admin Recovery, or know where I can find it? The only e-mail I have is for this Shannell person, but I highly doubt she cares about the info I presented and can almost guarantee that he won't see it, so I need to send this directly to him.
What a good feeling to start fixing this process. I've been so overwhelmed for many, many months, and finally I'm starting to feel like things are looking positive. Thank you all.
here
here is the address for this bottomfeeding pile of shit.
admin recovery llc
5930 main street
williamsville,ny 14221
get the c&d letter out by usps cmrrr.word it like this.
i demand that you cease any and all communication to me,or anybody else.period.
send it right away, and then you have their address to sue their ass.do it today if possible.
I will do that immediately
I will do that immediately after getting off work today. I also sent, or at least hope it sent, a letter to abrown@adminrecovery.com, as I suspect this should be his e-mail address. I laid out exactly what I needed to say, and I think I did a damn good job at it. But I definitely want to send a certified C&D letter, so that it is fully on record. But anyways, here is my e-mail to him. I also put a few links in it related to local and federal laws, for others that may run into these assholes. This Adam Brown is a huge sack of shit, and I can say that with confidence.
_____________________
Adam Brown,
I have made an attempt to settle a dispute with your company and that of the company that you purchased an account from containing information about me, known as Seaside Dollar and Trust, Bayside Dollar, Fireside Dollar, and various other names. A letter was sent yesterday, 06/20/2013, to your administrative assistant concerning this matter, and a voice mail was left with your employee, Greg, concerning this matter. I have records of this letter saved, and you can request a copy of these from your assistant, Shanell Schmitt, whom the letter was sent to yesterday.
Per on conversation this morning at 11:21, I informed you that I would not provide further information about myself, as I am aware of my rights and the laws concerning this matter, wherein your rebuttal was that you did not care about this matter and I could act as I saw fit. If your phone calls are recorded as you assure that they are, this will be proven should this matter progress further. I also have further documentation saved that I have attempted to correct this situation, and you refuse to cooperate.
As is written in law, online payday lenders MUST BE LICENSED in the state of Ohio, my residential state, to operate legally. Seaside Trust does not have a license to operate in this state, as well as many others, regardless of how you may perceive the situation. This information can easily be validated with simple Google searches, and information can be found concerning the lending laws and practices in Ohio, of which the company you associate with, Seaside Dollar, is not operating under the legal terms set forth by the state of Ohio. I would think that you of all people would understand and abide by these laws, especially as an operating General Manager. I am not debating anything more, I am simply stating facts that can be publicly found via the internet and local financial and law offices. If you still want to try to explain to me that I am wrong, I will simply provide this link to you for you to educate yourself further on these matters. This is from your state of New York, written and posted on their Better Business Bureau website: http://www.newyork.bbb.org/article/bbb-warns-against-online-payday-lenders-that-claim-the-laws-dont-apply-to-them-17955
"Many complainants were surprised to learn that the online lender was not licensed by the state and charged interest rates well over what was allowed by their state usury laws. When confronted, the lender typically responds that they don’t have to follow state or federal laws — often claiming that they are based in another country or on Native American reservations and are sovereign nations."
Does some of this information sound familiar? It does to me, because this is essentially the same thing you said to me on the phone. That you do not have to follow these state and federal laws. You, Adam Brown, are wrong, and there are laws to protect people from being preyed upon by companies such as yours, and those related to Seaside Trust.
Furthermore, I will also provide you with this link, posted directly from the Ohio State Attorney General, completely debunking your argument that you are operating legally in this matter. See page 13 of this file for information. http://www.lsc.state.oh.us/membersonly/130paydaylending.pdf
I have contacted the Ohio State Attorney General as of 11:30 on today's date, 06/21/2013, and informed them of the situation. Your information has been given to them as a filed complaint, and they provided me with a reference number concerning this situation. If you wish to pursue this further, the Attorney General's office has asked that I request you send me written proof via United States mail concerning the matter at hand. If you do not provide proof, I will assume that this matter has finally been settled and that no other problems will arise. Again, a complaint has been filed against your company today, and is readily on file with the Attorney General's office.
I am hereby reiterating that this is an order to cease and desist any and all contact with me and any/all parties you have associated with me, outside of sending proof of the situation through United States Mail. The Attorney General is aware that your office has made phone calls to my personal phone as well as my work phone, even after my request to stop. This will be my FINAL attempt to end this situation with you and your company. If you report this information to the credit bureaus, I will contact the Attorney General again to inform them, and I will also contact the FTC about the issue at hand. Again, this is my final attempt. Do not call me, my employer, or ANY person or business that you have on file as associated with me. As per the Fair Debt Collection Practices Act, set in law in the United States, you continue to violate the terms of the act by harassing me at work. Cease and desist ALL contact with me immediately.
If you have questions concerning the law, you may research the FDCPA by visiting the following link: http://www.ftc.gov/os/statutes/fdcpa/fdcpact.shtm
Again, this is my final attempt at resolving this issue. Please, do not contact me or anyone associated with me concerning this. Your company has already violated several sections of the FDCPA, even after written attempts to correct the problem.
My reference number from the Ohio State Attorney General is on file with their office and I have it saved in my records. I will not provide it to you, nor anyone in your company, nor will I provide any other information about me. I have attempted to correct this problem as civilly as I can, and you refuse to cooperate. If I do not receive proof via certified mail, I will assume that this situation has been settled. I will be following my credit situation closely, and if I see that you report me to any of the agencies, I will be forced to move forward with this matter. This is my final attempt to settle this.
_________
I hope he feels like an ass when he reads that.
maybe
creatures like that are so evil i think they actually enjoy their ill-gotten $$$$ and harrassing peope under the guise of anonymity as that is an alias he is using, and not his real name at all.anyway get the letter out as you will have the green receipt proving they received it.email only goes so far.
I was in the same situation.
I was in the same situation. I found this forum back in December, thank god and the people and info on here have been amazing. I had no idea the payday loans I took out were prohibited in my state and I had no clue what my rights were until I found this site and saved myself alot of money and relieved so much stress. I work in the medical field as well and was getting a call from Vip Loan Shops collection agency. I just told people at work it was a scam and informed my local police of the harrasing phone calls. The police even helped me out and called the collection agency who I was informed by this site probably bought the debt for pennies on the dollar. The collection agency skipped traced my info and they were making threatning calls to family members. Long story short once the police called them and told them they had to send me a debt validation they shut up quickly. They told the police no problem we will send one and surprise surprise they never did because they knew they couldnt collect on an illegal loan. They will say pretty much say or try to do anything to scare you into sending the money. But stand firm and give it right back to them. Let the illegal companies know that this is all I owe you them meaning just the remaining principle and they can take or leave it or they wont get a dime from you.
Holy cow... just look at how
Holy cow... just look at how many timese these guys have been taken to court in just the past year alone. Absolutely ridiculous. What a bunch of worthless humans. It's no wonder our world has gotten worse and worse.

seaside
@diggingtunes. You write one heck of a letter! Hopefully these guys will let you alone. I had a loan with Seaside and left owing 27.00 on the principal, my bad they agreed to settle for principal only, and they sold my loan to the same place. They were relentless in calling. One lady even told me to make coffee because she would call me every morning at 8am! When I told her that my caller id picked up the number she was calling from she hung up. I called her back and let her know that I would report her to the police and never heard back from them. BTW the 27.00 had grown into 400.00. They will call so you have to get your bluff in on them. C&D fine but I don't think they will care about that but let them know you will report them to the police or the FTC and hopefully that will keep them at bay. Be prepared that you may get calls from another company about the same loan as I did. Try to stay off the phone with them if at all possible or call them and turn the tables!
