Hello:

In a previous thread I explained how a loan company called Hydra Fund 1 illegally deposited 300 dollars in my account after I applied for an online loan (not with them and I did try to reach them out on the next day to pay their money back, but I could not find any "accurate" information about them online to call -either not in service or sending me to an answering machine". My bank account is still under investigation and frozen for fraud, probably related to this company, the thing is that all transactions are paralyzed. Someone from the forum told me not to worry about HF because it is an illegal lender.

Today I got a call from a guy called Dean Jordan from United Collection Agency, I confirmed the phone number and extension he gave by calling back. He said he was trying to "solve" an illegal situation related to a returned item from my bank account and wanted to see if I was willing to deal with it outside the court. I have a call recorder application on my Iphone and told him I was going to record the call, at the beginning he did not wanted me to do that "he said, it is not necessary" and I insisted, so everything we talked about I have it recorded in my cell phone.

To make the story short he said that (this was a real issue, that he had the proof of the deposit in my account from HF, that they are not ruled by the FDCPA, that there are not federal laws in this country regulating online loans and I couldn't do anything, and that he was serving me, and so on). At the end he said he was willing to make a payment plan in order for me to pay back the principal, but "he also said he didn't know how to contact Hydra Fund and that he was aware of how difficult it is to contact that company". I told him at the end that I wanted to pay back the principal to Hydra Fund and NOTHING else, but I had no way of confirming who HF was since didn't even get a loan agreement and had no idea of the company's phone number or contact information.

I am stuck, cause I know I need to return their money. HOwever, I have no clue who this company is.

Please Advice, Madga.

They are handing you a pile of bull shit. Your bank could easily return the money to hydra and you need to send a cease and desist letter to the collection agency.

Send a Cease and Desist letter to the collection agency in writing via certified mail with a return receipt request. After that, if they are still trying to contact you, file a complaint against them to the SAG or FTC.

Dear Sir/Madam,
Re: Accoiunt Number________________
I am requesting that you cease and desist with your efforts to collect on the debt referenced above. I wish to deal with the original creditor and not a collection agency.

Therefore, I request that you cease collection efforts immediately or face legal action under State and Federal consumer protection laws. I hope you would consider giving this letter the attention it deserves.

Sincerely,

@Bongonut: Thank you so much for the letter.

Ok, so I talked to this Dean Jordan from the United company. I asked him how come he knows everything about my debt without knowing Hydra Fund and he told me that his company has a "broker" that buys debts, so they bought mine.

I asked him:

1. If he had a website or some sort of identification for me to know if his company is legit and he told me "no".
2. I asked him his address he gave me this one: POBox 5402, Columbia, South Carolina, 29203. (His phone number is 1-855-847-2682)
3. I asked him if he had an operating License and he got really upset, and started being mean to me, I reminded him he was being recorded and he told me "I don't care if you are recording me" hung up and never gave me his license.

Should I even waste my time sending that cease and desist letter?

Thanks.

By all means, still send certified mail return receipt requested...just because he hung up does not mean they will not contact you again....
