FBD no longer in business

On June 24, I was contacted at my place of employment by a man named Nicholas McCarter. He stated he was an attorney with NCS Financial and was requesting my attorney's information due to the upcoming court date on the 27th of June. I stated that I had no attorney and I wasn't aware of any court date. He then went on to inform me that ThinkCash/First Bank of Delaware had tried contacting me on June 20th 2011 in regards to the payday loan I had taken out in September of 2010(which is true), and that I refused payment(this is not true).

I was terrified I was being sued and was in a hurry to get off the phone because I was at work and am not allowed to take personal phone calls, so I gave this guy my credit card information. Originally he had told me the amount I owed was $830 but because I was unaware of the case against me he would knock it down to $400 if I agreed to pay on the 28th.

After hanging up with this guy, I got to thinking and after getting off work I went home and did research which lead me to this site and many others like it. I immediately contacted my bank and explained the situation and they thought it best to cancel the card. So on the 28th, NCS didn't get my $400.

This Nicholas McCarter then decided he was going to contact my mother at her home on Friday, after not receiving the $400, he claims he got her number off of the loan agreement, and told her pretty much the same thing he told me on the 24th so now she's terrified I'm going to court for this matter.

After he talked to my mom, I got a phone call from a blocked number. I didn't pick up and they left me a voice mail. It was a woman by the name of Linda Baylor. She's claiming to be a process server with the Northumberland County Courts and has a summons she plans to serve me with if I don't contact NCS Financial withing 48 hours. She gave me a case number. As soon as I heard the voicemail I contacted Northumberland County and they have no record of any case number on file. The receptionist even ran my name through the system to make sure there was no case against me under a different number and she came up with nothing.

A friend of mine who had gone through Bankruptcy told me to contact the original lender to get some information from them, but when I attempted to call them I was informed that as of November 16th, 2012 First Bank of Delaware ceased doing business. I would like to pay off the debt, but I'm unsure of who to contact to get into some sort of payment arrangement.


A total pile of crap. I would suggest contacting a consumer attorney at naca.net and sue the collection agencies ass for multiple FDCPA violations and other damages.

some nuggets and tidbits.first FBD officially stopped doing new loans in 2009.a tribal entity called PLAIN GREEN took over and was calling their loans FBD/THINKCASH for the first six months of their existence.if what you state is true then this was a plain green/think cash loan,and not an fbd/thinkcash loan.meaning it was tribal,and illegal.so they sold the debt to a bottomfeeder that breaks the law.i would do as soaplady advised and start compiling proof to sue NCS.i also wouldn't worry about paying as again since 2009 all think cash loans were actually plain green and illegal.
