I am attempting to help my Mom out of a snowball she has gotten into. She has 10 Pay advances out totaling around 4500 as best I can tell. Based on my research on this site and a few minutes spent at the Florida Office of Financial Regulation website-it seems to me that only ONE of them is legal here in Florida.....and that would be Advance America. The rest are:

Cash Taxi
Cash Jar
Custom Payday
Archer Direct
Instant Loans USA
Instant Loans Now
VIP Loan Shop
Fast eFunds

So it is my understanding that to attempt to stop them from debiting her account (which they won't do anyway) she needs to send them some sort of letter, and then take those same letters to the bank requesting that that a hard block be put on her acct and then eventually closed? I already had her open a new checking account to swap her direct deposit to...assuming that I am correct in these steps...where do I find this "letter" and what else do we need to do? Thank you so much for any help..she is truly a good person that just got caught up and did not want to ask for help. Thank you!


How much was originally borrwed, and how much was paid back so far? It very well may be that she has overpaid and is due a refund. On this site, click on forums, then click on payday loan help, then click on sticky on how to deal with illegal lenders. Follow every step, do not skip. Also, on this site is a template for ACH revocation. This is where she tells the bank the names of her lenders, and under federal law they have to provide the request to to the revocation. Talk to the bank manager, not a teller.

Do as bingonut has said and follow the steps in how to deal with illegal lenders. I will also suggest that you file complaints with Florida office of financial regulation on all the lenders listed above.

Also know this, if a lender is not licensed in the state of FL their contracts become void in the state. They will try and scare your mother with lies about having her arrested and law suits but they can not do anything to you in FL. Don't let them scare you just stick to your guns and you will be fine.

I can tell you that thanks to all the information that I received from this site on unlicensed loans in FL I am free and clear of all my payday loans. I still get phone calls on occasion stating that I am going to be charged or served I just let them know that I know its a scam and to stop calling. If they call again I then start calling them over and over again bugging the crap out of them, sometimes I also answer the phone with a horn which makes them really mad. Just know that if the lender is not legal in FL there is nothing they can do to you here as the loan is considered unenforceable and noncollectable.
