Dear MBPROCESSING,

My name is Jason Burk and It has come to my attention that payday lenders must be licensed by the state of New York in order to offer loans to its residents. Since your company has no license in my state, the loan contract I have with you is not valid. Although I am not legally required to do so, I am willing to repay the principal balance of this loan. To date, I received a deposit of $400 on 01/17/13, and have had 11 bi-weekly withdrawals of $120 debited from my account. This results in an overpayment of $920. 

 At this time I am requesting a return email acknowledging that my loan has been paid in full. Also, I would like a refund of the $920 overpayment. A refund check of $920 should be mailed to me at the address you have on file. 

I am also revoking authorization for ACH withdrawals and any wage assignment I may have signed. I have given a copy of these revocations to both my bank and my employer. Any future attempts to collect funds in this manner will be blocked.
Please respond to this email with acknowledgment that my account has been satisfied in full. Details of when I can expect the refund check, as discussed above, should also be included in the email.Its pretty apparent that this person is trying to be a smart ass. How do I reply to this? FYI the following email is what I sent them orginally



since they either rejected your email,or th person is a smart ass.resend that email.if it is rejected then you should get a message stating as much.

Completely forgot to add the reply they sent me... here it is

we have already removed you from our system as we do not keep customers that do not pay back their loans. We have transferred your account to our outside collection agency. They will add collection costs and interest to your balance plus report the full balance to your credit bureaus. You took out the loan after the governor of New York made the announcement back in February. When you received the loan it was explained to you how to pay it back or pay it down. You chose not to do either that’s why we are having this conversation. Don’t worry you are out of our system we will no longer contact you. Thanks

they can say whatever they want.pdl's have been prohibited in NY for a long while.respond this way:

pdl's have been prohibited for a long time now,and it is up to you to lend in states that allow pdl's and to have license ther as well.btw the AG determines legality of your loans not the governor.you reply is an insult as you owe me you idiots.any outside place will be C&D so fast it's not funny.last thing you cannot report an illegal debt so any activity on my CR will be met with it being disputed off.to close i am not paying another dime so deal with it.

Dear Payday loan lender
You make me laugh, handing me such bullshit. The bottom line is YOU are not licensed to lend in my state. YOUR company is to blame for abusing consumers and lending in states where they are not licensed to do so.

By all means send me to collections. I will simply send the collection agency a cease and desist letter, informing then they are collecting on a non valid debt. Should they choose to ignore my cease and desist, I will happily pursue them for statutory damages under the FDCPA.
So, simply mark my account as paid in full and save your time and money.
Govern yourself accordingly
