Help With Castle Payday

I wanted to say that I have been lurking here for some time and you are a wonderful group of people. I joined because I want to be a part of your community and help others the way I have seen you all do. Now, I have an actual issue that I really need your help with.
I borrowed $700 from Castle Payday...biggest mistake ever! I live in RI.
I have sent an ACH revoke letter to them, and filed a complaint with the BBB.
I have told them I am willing to pay principal and wanted a physical address to which to send money orders as I will not allow ACH or remotely genterated check, etc.
They are, as I expected, threatening me with 3rd party collection and lawsuit and say that I can arbitrate via their tribal arbitration. I maintain they are illegal and the only thing I owe them is the principal.
The want the principal plus $245 extra to call the loan paid in full.
Can someone help me? Can they send to a collection agency and can I be sued? How do I proceed?

no tribal lender can do spit so follow the sticky on dealing with illegal lnders if you haven't already,and file AG,and FTC complaints asap.above all else treat everything they say,or email as complete bullshit until they agree that you owe only the principle,and will accept that.that is what you do.

I was just contacted yesterday by a Mr. Barrone from the legal dept and he was rude and said that I would be served with in the next 72 hours and they're trying to get $846.25 in interest plus $1900.00 in their attorney fees! I sent them a letter stating the facts and that I paid them $525.00 so I overpaid them by $25.00 and placed an ACH stop payment,....this was back in May 2013
Then today someone, a Ms. Deverone?? said that she was given my file by their auditors saying that I'm 50% right and that they're willing to offer me a deal and that she's there to help me.
I haven't call her back yet. I'm trying to find more info so I'm prepared for her. She stated California civil code 1916-1 and said that they only have to be licensed in CA if it was a store but not online. I'm trying to find the code so I can tell her that she's wrong. In CA you have to be licensed even for online..........CORRECT?? Can anyone else give me advice for when I call her back? Please!

tell the bitch she is wrong the california dept of corporations licenses lenders and doesn't subscribe to that point of view,in fact look up that supposed code.i bet it either doesn't exist,or is a different code altogether.to close yes she is full of shit and you can tell her so,and your state has been fighting tribals,and offshore lenders vigorously so let them know of this code.

i just typed that code as a google search and nothing came up.the lying bitch i knew it as no tribal lender is legal in any form.the next move is yours,but i would report them if you haven't already,and ignore their sorry asses.you won't get a refund,but feel lucky you only overpaid 25.00 as alot of unfortunates get close to a thousan over debited before they realize what you know.just ignore them.

I did look up that code but I don't get what she's talking about when it's a payday loan?? Do you know the CA code I can refer to her about that state where they have to be licensed in CA? Oh she also mentioned something about 12% interest that I had to pay or something? The guy yesterday was an a-hole he said that's riduculous I've never heard of that before and I think he's suppose to be some type of attorney........lol

1916.1. The restrictions upon rates of interest contained in
Section 1 of Article XV of the California Constitution shall not
apply to any loan or forbearance made or arranged by any person
licensed as a real estate broker by the State of California, and
secured, directly or collaterally, in whole or in part by liens on
real property. For purposes of this section, a loan or forbearance is
arranged by a person licensed as a real estate broker when the
broker (1) acts for compensation or in expectation of compensation
for soliciting, negotiating, or arranging the loan for another, (2)
acts for compensation or in expectation of compensation for selling,
buying, leasing, exchanging, or negotiating the sale, purchase,
lease, or exchange of real property or a business for another and (A)
arranges a loan to pay all or any portion of the purchase price of,
or of an improvement to, that property or business or (B) arranges a
forbearance, extension, or refinancing of any loan in connection with
that sale, purchase, lease, exchange of, or an improvement to, real
property or a business, or (3) arranges or negotiates for another a

i didn't type it in properly so it does exist,but it has nothing to do with pdl's as there are seperate and specific laws for them.those state that a license is a requirement whether storferont,or online.no tribal piece of shit lender can do shit,and miss rottencrotch knows it.therefore she is throwing it to the wall hoping you buy it.if you haven't reported them first to your AG,and the CA DEPT OF CORPORATIONS do it and ignore future calls from anybody regarding this loan.a waste of your time to engage in a futile debate with evil idiots.

You also need to know that the legal payday loan limit in California is $300 and anything above that is ILLEGAL. With that being said, all you are obligated to pay back is what you borrowed. If you borrowed $500, then payback $500--but not a penny more. If they do not have a license, they do NOT have a leg to stand on in California. If they harass you any more, go to the Dept. of Corporations website and look for the claim form you can fill out against these people. That will get their attention.
So here's a dumb question
Castle Payday makes a point of being outside the laws of your state... why are you paying them back? Have your bank bar them from withdrawing funds. They can't sue you. They can't garnish your wages. They can harass you with phone calls I guess, and maybe report to credit bureau... but so what?

What about in KY? Are these tribal loans illegal in all states. What if they called you prior to signing the "loan" and reviewed the terms of the agreement? Would you still be obligated to pay the full amount and interest? I borrowed 500.00 and was to pay 150.00 twice a month. I started paying 25.00 extra to help paydown the balance. I had them send me an amortization schedule for 25.00 extra twice a month and it will be 2 years before the 500.00 is paid off!
What about in Florida?
I have a payday loan debt consolidation group that I'm working with and I feel like I can trust this company and that they are paying off my debt with the money I pay into an account to come out every month and pay off the principals on the loans I owe on, however, this group called the Harbinger Group has been contacting me in regards to Castle Payday loan saying that they're trying to settle a claim before filing it. However, I feel like they're full of bull! Especially, when I get a confirmation that they have received payment from Castle Payday loan every month. Is anyone else dealing with this crap? Who do I trust?

in no state are tribal loans legal.it doesn't matter whatr terms they put in,or how it's worded.the law is the law,and nothing an illegal says,or puts in their illegal contract changes that.you only owe 500.00 and if you want to pay like they are legal go ahead,but i will never say that,or advise that.last thing since it is illegal those 150.00 debits get deducted from the 500.00 so again chances are you paid,or overpaid this loan.best to check into how much was debited until now.

I have 5 payday loans out....5 are from online and one that is local.... Does anyone know anything about Cashnet USA, Castle Payday, Plain Green, Great Plains Lending and Cash Central.....Please help with information or steps I shoudl take on what to do. Thanks in advance!
