I got a phone call from Legal Mediation regarding a pay day loan I took out in Va. This company is in Florida. they told me I had to pay 330 by 6pm yesterday or they would be filing charges with my county. That it would be more than bounced check that it would be fraud. the orginal loan was for 500 I have it down to 330. I'm wondering if this is a scare or if they really are going to do all this. I'm going to pay 150 of it today. They also told me that they didn't take parcial payments they need the whole amount. that they weren't a debt collector.


Sounds like evil (and illegal) collection tactic 1A. unless they are a licened attorney in your state they cannot do squat legally speaking. Two, in most states payday loans cannot be prosecuted criminally, especially if you haev already paid something. a few questions for you and maybe we can give some more help

1) what state are you in, I know you said lthe loan was in virginia?

2) can afford to pay the $150 your going to send?

3) will the payday lender let you pay directly?

4) If the answer to Number 3 is no, have you verified with the lender that this florida company is handling your collection.

5) can you provide the full name and address and pohone of this company so I can check it out for you

I just called the actual loan place. they said they cannot accept any payment from me. That they would return it to me. I've already made out the money order to the loan company.

Ask for debt validation. This is not the right process of debt collection. They should provide you some written documents so that you can understand if they are claiming the right amount or not. You should also check if this agency is licensed to do business in your state or not. You can contact Consumer Protection Office of your state and confirm it. Go through this article and know what the right process of debt collection is.
